Minutes TC 06/10/1985MINUTES OF REGULAR MEETING TOWN OF TROPHY CLUB OF DENTON COUNTY, TEXAS JUNE 10, 1985 THE STATE OF TEXAS COUNTY OF DENTON The Town Council of the Town of Trophy Club, of Denton County, met in Regular Session, open to the Public, at 7:OOPM, 100 Water Plant Road, Trophy Club, Texas, within the boundaries of the Town. The following officers and members were present: Jim Carter Terry Vance Bettye Dayton Aldo Martignago Ted Neidenberger David Nolte Absent: George Doran Mayor Mayor Pro Tem Council Member Council Member Council Member Marshal Council Member constituting a quorum, with the following members of the City staff: Ken Dipple Donna Welsh Hutchison Price Boyle & Brooks City Secretary CALL TO ORDER Mayor Carter called the meeting to order at 7:OOPM. INVOCATION The Invocation was given by Mr. Jerry Svore, 250 Oak Hill Drive. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by David Nolte. CONSIDERATION OF MINUTES Mayor Pro Tem Vance made the motion to approve the minutes of the May 20, 1985 meeting with corrections, Council Member Martignago seconded, motion carried. Council Member Dayton made a motion to approve the minutes of the May 27, 1985 meeting with corrections, Council Member Martignago seconded, motion carried. COMMITTEE REPORTS Loren Alexander, Chairman of the Planning and Zoning Commission, reported to the Council that the Council is working on several projects. At the Commission's last meeting, an I.B.M. representative gave a presentation on the company's plan for their development near Trophy Club. Part of the development could be in the town's limits. The members of the Planning and Zoning Commission will work closely with I.B.M. as the development progresses. Mr. Alexander stated that Bruce Benton will be working on the Highway 114 study. The Commission is also working on the building codes and the Master Plan. A monthly report will be given to the Council on each project. -2 - Marshal David Nolte- Security Study Committee. Mr. Nolte reported to the Council that the Security Study Committee was in the process of studying the cost involved in buying equipment such as vehicles, radio equipment, dispatch equipment, etc. The Committee also met with Randy Kaisner, Denton County Sheriff, at their last meeting. Mr. Kaisner is also going to submit a list of costs for providing security for the community. The Committee will make a report to the Council at the next regular meeting. City Identification Committee. Mayor Carter reported that the Identification Committee is working on a seal and flag for consideration. The Committee consists of Sachi Nakashima, Ed Lenz and Linda Pederson. Highway 114 Power Poles. Mayor Carter reported to the Council that in order for the Community to succeed in having the poles relocated, a Committee should be set up to organize the effort. Mayor Carter felt that the following outline for a Committee should be formed at a City wide meeting. Chairman 2 Co -Chairmen Publicity Transportation Legal Mayor Carter stated that Mr. John Mayall had volunteered to provide trans- portation to anyone who would go to Austin for the hearing.'Mayor Carter._ also talked with Mr. Carol Huntress who volunteered his legal staff to help the Committee. Council discussion ensued, after which it was the sense of the Council to form a Committee for residnets of Trophy Club to formulate plans to go to Austin to express concern over the location of the power poles. Council Member Dayton made the motion to form the Committee, Council Member Martignago seconded, motion carried unanimously. The meeting will be held on Wednesday June 19th at 7:OOPM. Meeting place to be announced. Vance Booker- Parks and Recreation Committee. Mr. Booker reported to the Council that the Committee had talked with Carter and Burgess, an Engineering firm concerning development of a sight plan. The Committee would like to see recreation areas, jogging trails, open areas for meeting places, etc. Mr. Booker had also talked with a landscape firm concerning some of these areas. He stated that these people are aware that this is on a contingency basis. If the City receives matching funds for these projects, these firms will be considered for their services. -3 - Mr. Booker told the Council that the proposal to the state would be refined and reviewed by the Council before being submitted. CONSIDERATION OF ORDINANCES ORDINANCE NO. 0-85-12 The Caption reads: AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS ADOPTING AND AMENDING THE 1982 EDITION OF THE UNIFORM BUILDING CODE; PROVIDING AN ENFORCEMENT CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY, AND DECLARING AND EMERGENCY. Mayor Pro Tem Vance made a motion to adopt the Ordinance as written, Council Member Neidenberger seconded, motion carried unanimously. A copy of this Ordinance is filed with the minutes. ORDINANCE NO. 0-85-13 The caption reads: AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS, ADOPTING AND AMENDING THE 1984 EDITION OF THE NATIONAL ELECTRICAL CODE; PROVIDING AN ENFORCEMENT CLAUSE; PRO- VIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY, AND DECLARING AN EMERGENCY. Council Member Neidneberger made a motion to adopt the Ordinance as written, Council Member Martignago seconded, motion carried unanimously. A copy of this Ordinance is filed with the minutes. The next Ordinance to be considered by the Council was the 1982 Plumbing Code. Mr. John Peters, Vice -President of the M.U.D. Board asked to address the Council. He stated that the M.U.D. District has had a Plumbing Code in place since Novem- ber 1982. This a requirement by the State in order to have State approved water. Mayor Carter asked Mr. Peters if the M.U.D. Board or a representative would consider meeting with the Planning and Zoning Commission to review both codes. Mr. Alexander, Chairman of the Planning and Zoning Commission, will put this item on the next agenda. Mayor Pro Tem Vance made a motion to table this Ordinance until the parties involved can review the two codes, Council Member Neidneberger seconded, motion carried unanimously. ORDINANCE NO. 0-85-14 The caption reads: AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS, ADOPTING AND AMENDING THE 1985 EDITION OF THE UNIFORM FIRE CODE; PROVIDING AN ENFORCEMENT CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY, AND DECLARING AN EMERGENCY. Council Member Martignago made a motion to adopt the Ordinance as written, Council member Neidneberger seconded, motion carried unanimously. -4 - ORDINANCE NO. 0 85-13 The caption reads: AN ORDINANCE ESTABLISHING AND LEVYING A PRIVATE CLUB REGISTRATION PERMIT FEE AND A PRIVATE CLUB LATE HOURS PERMIT FEE IN ACCORDANCE WITH THE TEXAS ALCOHOLIC BEVERAGE CODE, SECION 11.38; PROVIDING A PENALTY NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE AND DECLARING AN EMER- GENCY. Council Member Neidenberger made a motion to adopt the Ordinance as written, Council Member Martignago seconded, motion carried unanimously. PRESENTATION BY CITIZENS Mr. Jack Olsen- 8 Palmetto Court Mr. Olsen stated that he was pleased the Council was considering an Ordin- ance dealing with animals at large. He expressed concern over the number of animals being allowed to run loose. Mayor Carter thanked Mr. Olsen for his comments.
