Minutes TC 12/09/1985MINUTES OF REGULAR MEETING TOWN OF TROPHY CLUB TROPHY CLUB, TEXAS THE STATE OF TEXAS ) COUNTY OF DENTON ) The Town Council of the Town of Trophy Club met in Regular Session on Monday, December 9, 1985. The meeting was held at the Municipal Utility District Building, 100 Water Plant Road, Trophy Club, Texas. The meeting was open to the Public, and the following officers and members were present: Jim Carter Terry Vance Bettye Dayton George Doran Ted Neidenberger Absent: Aldo Martignago Mayor Mayor Pro Tem Council Member Council Member Council Member Also present were members of the Town staff; John Hill John Jacobs David Nolte Donna We I sh Attorney City Treasurer City Marshal City Secretary constituting a quorum, the meeting was called to order. CALL TO ORDER: Mayor Carter called the meeting to order at 7:OOPM. Mayor Pro Tern Vance led the Invocation. PLEDGE OF ALLEGIANCE: Marshal Nolte led the Pledge of Allegiance. PUBLIC HEARING: MUNICIPAL BUDGET FOR JANUARY 1° 1986 TO SEPTEMBER 30, 1986. Mayor Carter introduced the City Treasurer John Jacobs: Mr. Jacobs stated that this would be a nine month budget. The largest expenditures in the budget would be for law enforcement, general administration and professional services connected with the Master Plan. Mr. Jacobs stated that all officers of the City are volunteer except for clerical help. He pointed out that the professional services would be a great help to the Planning and Zoning Commission in developing zoning ordinances and in the Master Plan. Mr. Jacobs reviewed the balance of the budget and explained each item. Mayor Carter asked if anyone in attendance would like to ask questions or comment on the budget. Mr. Fred Allen, 1022 Trophy Club Drive, asked if the auto fee had been passed yet and if so how much would it be. Mayor Carter stated that it had not been passed but would be $7.50 when approved by the Council. Mr. Ron Groh, 506 Indian Creek Drive, asked how many law enforcement officers would be stationed in Trophy Club. Mayor Carter stated that there would be one officer at all times in Trophy Club. Ms. Gi Gi Sullivan, Manager of the Plantation, asked if the people living in the Plantation would also have to pay the auto registration fee. Mayor Carter stated that all residents in Trophy Club would be required to register their cars. COUNCIL COMMENTS ON BUDGET: -Mayor Pro Tem Vance stated that the money to pay for the law enforcement would come from the C.I.A. He reviewed a time -table that was prepared showing dates when C.I.A. functions could be turned over to the City. The plan currently being reviewed by the C.I.A.. Mayor Pro Tem Vance stated that the C.I.A. and the City had been studying the feasibility of transferring most of the C.I.A. functions to the City by the end of 1986. Instead of C.I.A. dues, the residents would be paying a tax which would be deductible. -Council Member Neidenberger stated that he felt the money allocated in the budget for engineering fees might not be enough. Council Member Doran made a motion to accept the budget as presented, Council Member Dayton seconded, motion carried unanimously. A copy of the budget is on file at the City office and filed with these minutes. CONSIDERATION OF DISBURSEMENTS Mayor Pro Tem Vance made a motion to approve the disbursements for the month of November, Council Member Doran seconded, motion carried unanimously. PRESENTATIONS BY COUNCIL Council Member Dayton expressed concern over the vandalism recently on the golf course~ Dirt bikes have done damage to the golf course two times in one week. Roger Brown, of Independent American, stated that the Developer had asked the Corps of Engineers to put up a deterrent between Trophy Club and their open land. He stated that if the City also requested their help it might have more influence. Mayor Carter suggested the City and the Developer write a letter to the Corp of Engineers asking them to put up some kind of deterrent to keep the dirt bikes out. Mayor Carter also suggested a reward system for anyone providing information as to who is doing this damage or any other crime within the City. -Council Member Dayton stated that she felt a Committee should be set up to discuss coordinating the C.I.A. functions into City responsibilities. Council Member Dayton suggested this in an earlier meeting and feels this would be the time to start the Committee working. Council Member Dayton made a motion to appoint a committee to start working as soon as possible to work on the conversion. Mayor Carter asked if there was a second to the motion. There was none, motion dies for lack of second. PRESENTATIONS BY CITIZENS Mr. Allen, 1102 Trophy Club Drive, asked who the Citizens should go to to get answers on how the C.I.A. will turn functions over to the City. Mayor Carter stated that Council Member Doran has been chairing that Committee. He told Mr. Allen that members of the C.I.A. and the City Council are aware of the procedures that will take place, and would be glad to answer questions. SECURITY STUDY COMMITTEE Marshal Nolte introduced Lieutenant Will Malden, of the Denton County Police Department. Mr. Malden stated that he felt it was a priviledge to be working in Trophy Club. Mr. Malden has worked with the City of Irving for 16 years and is very active in the neighborhood watch program. Marshal Nolte stated that Sheriff Kaisner was on his way to the City and the Denton County Sheriff's Department. The Contract was amended at an earlier meeting by the City Council. CONSIDERATION OF ORDINANCE/RESOLUTIONS: SECOND READING AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS CREATING AND ESTABLISHING A MUNICIPAL COURT; PROVIDING FOR A REGULAR MUNICIPAL JUDGE AND ALTERNATE JUDGES; PROVIDING FOR THE FILLING OF A VACANCY IN THE OFFICE OF MUNICIPAL JUDGE AND MUNICIPAL COURT CLERK; PROVIDING FOR THE APPOINTMENT OF A MUNICIPAL COURT CLERK; PROVIDING FOR THE SETTING OF COURT SESSIONS; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EFFECTIVE DATE. Mayor Carter asked if anyone would like to speak pertaining to the Ordinance. Mrs. Barbara Allen, 1022 Trophy Club Drive, asked how the Court will be funded. Mayor Carter stated that clerical help was in the budget and there would be revenue from the fines imposed. Mr. Allen, 1022 Trophy Club Drive, asked if a Judge had been appointed. Council Member Neidenberger stated that under the statutes in which Trophy Club incorporated, the Mayor could be appointed as Judge. Mayor Pro Tem Vance made a motion to approve the Ordinance as written, Council Member Doran seconded, motion carried unanimously. Council Member Neidenberger made a motion to appoint Mayor Carter as Judge, Mayor Pro Tem Vance seconded, motion carried unanimously. NEXT ORDINANCE: AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS, MAKING PROVISIONS REQUIRING A SINGLE FAMILY RESIDENCE LICENSE; PROVIDING A LICENSE FEE AND A REINSPECTION FEE; PROVIDING STANDARDS; PROVIDING FOR INSPECTION OF CERTAIN RECORDS AND THE PREMISES; PROVIDING FOR AN APPEAL TO THE BOARD OF ADJUSTMENTS AND APPEALS; PROVIDING A PENALTY CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE. Mayor Carter asked if anyone would like to speak pertaining to the Ordinance. Mr. Dick Covert, representing land owners in Trophy Club, stated that he represents rental property owners in 11 areas of Texas. He stated that the $75.00 rental fee, if imposed, would be 6 times higher than any other rental fee in the State. Mr. Bob Bush, an attorney representing Mr. Terrel, owner of the Quorum and Townhomes, stated that in Arlington there was litigation involving Ordinances like these. He felt that there would be questions concerning descrimination over certain areas of the Ordinance. Mr. Bush felt that the Ordinance as written was vague, and asked the Council to please take time to review the Ordinance before adopting it. The Council felt that since several questions and valid points had been brought up, the Ordinance should be reviewed further. Council Member Doran made a motion to table this Ordinance with the provision that Mr. Bush and Mr. Covert document their thoughts on the Ordinance for the Council. Mayor Pro Tem Vance seconded the motion, motion carried unanimously. At this point in the meeting, police protection contract to Kaisner stated that he looked Club. Mayor Carter signed the approval. Sheriff Kaisner presented the the Mayor to sign. Sheriff forward to working with Trophy contract with the Council's CONSIDERATION OF ORDINANCES/RESOLUTIONS: FIRST READING The City Secretary read the captions of four Ordinances to be introduced for first reading. Mr. Barry Knight, Attorney for Independent American, introduced Mr. Dan Sass, who presented a slide presentation showing several different kinds of "special residential'' housing. At the regular Council meeting on December 16th, a Public Hearing will be held on special residential ordinances. EXECUTIVE SESSION At this point in the meeting the Council adjourned into Executive Session~ OPEN SESSION Mayor Pro Tem Vance made a motion for the City to pay the bill presented by Valuation Research, with the stipulation that Mayor Carter talk with the firm concerning the amount. Council Member Neidenberger seconded the motion, motion carried unanimously.
