AN ORDINANCE OF THE TOWN OF TROPHY CLUB,
TEXAS AMENDING ORDINANCE NO. 87-05 BY
AMENDING SECTION 1 BY AMENDING SUBSECTION (A)
TO REFLECT THAT NO PERSON HAVING SUPERVISION
OR CONTROL OVER REAL PROPERTY WITHIN THE
TOWN SHALL ALLOW WEEDS OR GRASS TO GROW OR
BRUSH TO ACCUMULATE TO A HEIGHT GREATER
THAN TWELVE (12) INCHES; AMENDING SUBSECTION
(B) OF SECTION 1 BY PROVIDING THAT THE OWNER
OF ANY LOT, TRACT OR PARCEL OF LAND OF TWO (2)
ACRES OR MORE IN SIZE MUST KEEP THE PROPERTY
FREE FROM GRASS AND WEEDS IN EXCESS OF
TWELVE (12) INCHES IN HEIGHT, PROVIDED,
HOWEVER, THAT WHERE LAND IS REGULARLY
CULTIVATED, THE PROHIBITION CONTAINED IN
SECTION 1 SHALL APPLY ONLY TO THAT PART OF
THE PROPERTY WITHIN 100 FEET OF AN ADJACENT
PROPERTY OR RIGHT-OF-WAY; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A SAVINGS
CLAUSE; PROVIDING AN EFFECTIVE DATE.
WHEREAS, during the past several months, North Central Texas has experienced severe
grass fires which resulted in significant property damage; and
WHEREAS, in order to reduce the Town's exposure to that fire hazard, the Town
Council of the Town of Trophy Club, Texas desires to extend the duty to remove grass and
weeds in excess of 12 inches to all lands within the Town except those that may be regularly
cultivated.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
Section 1. Amendment. Ordinance No. 87-05 of the Town of Trophy Club, Texas
is hereby amended in the following particulars, and all other sections, subsections, paragraphs,
sentences, phrases and words of the said Ordinance are not amended but are hereby ratified and
affirmed:
A. Section 1 of Ordinance No. 87-05 is amended so that it shall hereafter read as
follows:
"Section 1. (a) It shall be unlawful for any person, firm, corporation,
partnership, sole proprietorship or any other entity recognized in law owning,
leasing, claiming, occupying or having supervision or control of any real

property, occupied or unoccupied, improved or unimproved, within the corporate
limits of the Town, to permit or allow grassy or weeds to grow or brush to
accumulate grow to a height greater than twelve (12) inches upon any such real
property, or allow or permit any objectionable or unsightly matter to accumulate
or be present upon any such property.
(b) With respect to lots, tracts or parcels of land of two (2) or more acres under
single ownership, the provisions of this Section shall be applicable efily to the
entire lot, tract or parcel of land; provided however, that in the event any such
lot, tract or parcel of land is regularly cultivated, only that area of the lot, tract
or parcel of land within one hundred (100) feet from any adjacent property under
different ownership and any adjacent or contiguous right-of-way, alley, utility
easement or other public right-of-way, shall comply with terms of subsection (a)
of this Section. Property lying more than 100 feet north of the north right-of-way
line of Marshall Creek Road shall not be subject to the requirements of subsection
(a) of this Section."
Section 2. Savings. This Ordinance shall be cumulative of all other ordinances of the
City affecting the City's boundaries and shall not repeal any of the provisions of those
ordinances except in those instances where the provisions of those Ordinances are in direct
conflict with the provisions of this Ordinance.
Section 3. Severability. The sections, paragraphs, sentences, phrases, clauses and
words of this Ordinance are severable, and if any section, paragraph, sentence, phrase, clause
or word in this Ordinance or application thereof to any person or circumstance is held invalid
or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity
of the remaining portions of this Ordinance, and the Town Council hereby declares that it would
have passed such remaining portions of this Ordinance despite such invalidity, which remaining
portions shall remain in full force and effect.
Section 4. Effective date. This Ordinance shall become effective from and after its date
of passage as provided by law.
