ORD 2024-14 Appointing Municipal Court Judge TOWN OF TROPHY CLUB, TEXAS ORDINANCE NO. 2024-14 AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS PROVIDING FOR THE APPOINTMENT OF THE MUNICIPAL COURT JUDGE AND ALTERNATE JUDGES OF THE MUNICIPAL COURT OF RECORD IN THE TOWN OF TROPHY CLUB; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town of Trophy Club is a home rule municipality acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, Town's Home Rule Charter provides for Town Council appointment of one or more persons to serve as Municipal Court Judges for the Trophy Club Municipal Court of Record No. 1; and WHEREAS, Section 7.02.031 of the Town's Code of Ordinances (the "Code") provides that the Town Council shall appoint a presiding judge and, at its discretion, appoint one or more alternate judges and that the presiding judge and the alternate judges shall be appointed for terms of two (2) years each and shall have the authority provided by state law; and WHEREAS, Section 7.02.031 of the Code and Chapter 30 of the Texas Government Code, relating to municipal courts of record, provide that the judge of the municipal court of record shall be appointed by the Town Council by ordinance; and WHEREAS, the Town of Trophy Club has entered into an interlocal agreement with the City of Roanoke for the administration of Municipal Court Services for the Town of Trophy Club, which provides that Trophy Club shall appoint the current presiding judge of the Roanoke Municipal Court as the Presiding Judge for the Trophy Club Municipal Court and shall appoint the two (2) current associate judges of the Roanoke Municipal Court as associate judges for the Trophy Club Municipal Court; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS, THAT: SECTION 1. In accordance with the Code of Ordinances of the Town of Trophy Club, Texas, as amended, the Town Council hereby finds that the following persons possess all qualifications necessary to serve as Judges of the Trophy Club Municipal Court and the Town Council hereby appoints such persons to serve as Judges of the Trophy Club Municipal Court of Record No. 1 effective October 1 , 2024, in the capacity as set forth below for the period of two (2) years, with such terms expiring on October 1 , 2026. This Ordinance shall be cumulative of all provisions of ordinances and of the Code of Ordinances of the Town of Trophy Club, Texas, as amended, except where the provisions of this Ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event the conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the Town Council that the phrases, clauses, sentences, paragraphs, and sections of this Ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the Town Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section.
