Mayor Tiffany called the meeting to order at 6:00 pm announcing a quorum was present for the
meeting with all Council members in attendance.

1. Dr. Hancock, Medical Director TC Fire, to present to Council the Fire
Department’s receipt of the American Heart Association Gold Mission Lifeline
Award (Fire Chief Wise)
Fire Chief Jason Wise announced that this was the fifth year in a row that the Trophy
Club Fire Department had received this Gold Mission Lifeline Award from the
American Heart Association. He then introduced Trophy Club resident, Dr. Rob
Hancock, Medical Director for the Trophy Club Fire Department.
Dr. Hancock gave a brief history of this award. He explained that the AHA
developed the Mission: Lifeline Recognition Program to recognize emergency
service organizations that meet the guidelines from the AHA and the American
College of Cardiology in the pre-hospital care of patients with ST-Elevation
Myocardial Infarction (STEMI), the deadliest form of heart attack.
2. BADGE PINNING FOR NEW POLICE OFFICERS AND FIRE PERSONNEL (Acting
Police Chief Tillman & Fire Chief Wise)
Police Chief/Interim Town Manager Patrick Arata introduced Acting Police Chief
Bobby Tillman and Fire Chief Jason Wise. Tillman spoke of the public safety
community being deeply rooted in traditions and spoke of the important tradition of
the badge that must never change. He explained that there are three times in the
career of an officer when a badge is presented: at graduation from the academy,
upon promotion, and at retirement.
Chief Wise explained that these men and women will take an oath tonight to protect
life and property and it was important that they be recognized for their service in the
community.
Judge Eric Ransleben issued the Oath of Office to the following Fire and Police Officers:

The Mayor and members of the Town Council expressed appreciation for these
officers’ service to the Town of Trophy Club.
3. Working for You. . . Trophy Club
a) Update on Arts & Culture Ad-Hoc Committee
Mayor Tiffany explained the new Arts & Culture Ad-Hoc Committee and reviewed
the process for appointments to the Town’s Boards and Commissions. She
stressed the importance of these Boards and Commission to the community.

b) Update from Town Council Members
Council Member Bauer thanked the team in the Finance Department for all their
work on the budget.
Council Member Flynn thanked the school crossing guards.
Mayor Pro Tem Sheridan reported on the work of the Budget Subcommittee, with
the approval of the budget to be on the September 11, 2023 Town Council
Meeting agenda.
Council Member Oldham expressed appreciation for the full house for tonight’s
meeting.
Mayor Tiffany stressed the importance of investing in your neighborhood and
community. She expressed her sincere appreciation for all the support, love, and
outreach to her following the recent death of her husband.
c) Update from Town Manager (Patrick Arata, Interim Town Manager)
Interim Town Manager Arata announced that a joint meeting with the Town
Council and the Economic Development Corporation was being planned.
He stated that Town Staff had been working on the upcoming fiscal year’s
budget, the Employees Benefit Fair, and the transition to a new IT provider.
Arata announced that the additional twenty-minute gap between middle school
and high school start times had helped the traffic flow.
Mayor Tiffany reported that five (5) candidates for the Town Manager position
would be interviewed Thursday, August 31, 2023.
d) Quick Civic Tip (Dean Roggia, Town Attorney)
Town Attorney Dean Roggia reviewed a PowerPoint presentation reviewing the
process to place an item on the agenda, as well as the agenda order and
preparation. Roggia also reviewed the following sections from the Town Charter:
§ 3.113 Interference in Town Manager Appointments and Removals or Duties
and § 1.02.001 Town Manager – Signatory Authority.

Mayor Pro Tem Sheridan made the motion to approve Consent Agenda Items #4-10.
The motion was seconded by Council Member Beach and passed unanimously with a
vote of 7-0.

11. Case PD-AMD-23-002 (First Finance Bank)

Mayor Tiffany filed a Conflict-of-Interest form with the Town Secretary’s Office pertaining to this
item and left the Council Chambers at this time. Mayor Pro Tem Sheridan presided over this
item.
a. Conduct a public hearing to consider a rezoning request made by B&S
Southern Sign & Crane Service to amend Planned Development District-13
(PD-13), Tract 4A to accommodate signage. The subject property is legally
described as The Village at Trophy Club, Lot 4, approximately 1 acre, Denton
County, Texas and is generally located at the northwest corner of Trophy Club
Drive and SH114. The property is addressed as 95 Trophy Club Drive (M. Cox)
Mayor Pro Tem Sheridan stated that he was a customer of First Financial Bank;
however, he did not have a conflict of interest in considering this item.
Sheridan opened the Public Hearing at 6:37 PM and asked Community Development
Director Matt Cox to review the item. Cox stated that First Financial Bank had
requested an amendment to PD-13 to allow for an additional sign on the front (east)
elevation/main entry along Trophy Club Drive, increase the signage on the south
elevation, and to allow LED lighting in the existing monument sign. Sign visibility
from SH 114 and along Trophy Club Drive would be improved with this request.
P&Z Chair Mike Biggs addressed the Council and stated that the bank is the only
building that would be affected by this amendment. He stated that this approval by
the P&Z Commission was business friendly. The P&Z Commission approved the
request at their meeting held on August 10, 2023
The Mayor Pro Tem closed the Public Hearing at 6:41 PM.
b. Consider and possibly act on a recommendation to the Trophy Club Town

Following general comments from the Town Council, Council Member Oldham also
stated that she had an account at First Financial Bank but did not have a conflict of
interest.
Council Member Beach made the motion to adopt an Ordinance approving the

The motion was seconded by Council Member Monger and passed unanimously with
a 6-0 vote.

12. Case SZ-23-001 Triple Crown Estates, Rezoning
a. Conduct a public hearing to consider a rezoning request made by Vasquez
Engineering LLC to change the zoning from R-15 Single-Family Residential
District to R-12 Single-Family Residential District on approximately 2.991 acres
of land out of the Mary Medlin Survey, Abstract No. 832, Denton County, Texas.
The property is generally located south of Trophy Park Drive, west of Balmoral
Drive, and east of Annandale Drive, within the Town of Trophy Club. The
property is currently addressed as 2304 Trophy Park Drive (M. Cox)
Mayor Tiffany opened the Public Hearing at 6:44 PM.
Matt Cox, Community Development Director, gave a brief background on the
requested rezoning from R-15 Single-Family Residential District to R-12 Single-
Family Residential District. The size of the proposed lots was the basis for the
requested change in zoning.
Planning Consultant Helen-Eve Beadle was present and explained the differences in
the two zoning districts. She stated that at the time of packet preparation, Town Staff
had not received any notices of opposition to the request. Two individuals spoke in
opposition to the requested rezoning at the P&Z Commission meeting. They were in
favor of the project, but they wanted the overhead power lines to be buried.
P&Z Chairman Biggs reported that there were simply too many questions about the
power lines and several Commissioners expressed concern about the amount of

electricity going through the power lines. He stated that he felt like that was the
reason that the request did not pass the P&Z Commission. It is not required that the
power lines be buried.
Biggs gave a brief history of past efforts to develop this piece of property.
Juan Vasquez of Vasquez Engineering LLC spoke in favor of the requested
rezoning, along with the Property Owner/Developer Nathan Jeppeson, 2032
Churchill Downs.

Council Members discussed the request and asked questions of the Town Attorney.
Council Member Flynn pointed out that burying the power lines was a separate issue
from the rezoning request. This request was a straight zoning change request.
Mayor Pro Tem Sheridan made the motion to deny the requested rezoning of
approximately 2.991 acres of land out of the Mary Medlin Survey, Abstract No. 832,
Denton County, Texas, the property is generally located south of Trophy Park Drive,
west of Balmoral Drive, and east of Annandale Drive, within the Town of Trophy Club
(2304 Trophy Park Drive).
The motion to deny the requested rezoning was seconded by Council Member
Monger. With a vote of 4-3, the motion to deny the requested rezoning passed.

13. Consider and take appropriate action to appoint a Town Secretary effective
August 29, 2023 (Denise Deprato, Human Resources Director)
Director of Human Resources Denise Deprato introduced Tammy Dixon who had
accepted the conditional offer for the position of Town Secretary. Ms. Dixon gave a brief
background of her career.

Upon motion by Council Member Flynn, seconded by Council Member Beach, the Town
Council voted unanimously (7-0) to appoint Tammy Dixon as the Town Secretary
effective August 29, 2023.
14. Consider and take appropriate action to on review of Community Pool – Phase II
(Stacey Bauer, Council Member)
Comments were made from the following persons:
Wendie Bailey, 201 Durango – requested the $700,000 slide be reconsidered in Phase
II; add a heater to enable year-round use; open special programs for special needs
persons; and have more flex space rather than just a party room.
Lisa Finch, 2721 Waverley Drive – requested the pool be heated to have more year-
round options for swim teams and others as well as programs for special needs persons.
She presented a proposal for options to extend the life of the pool.
Dean Murray, Chairman of the Parks and Recreation Board told the Council that the
Board had voted to proceed with Phase II of the Pool Project as planned. He stated that
a slide is not a bad idea and would benefit the pool. The addition of a heater is not part
of this phase of the pool.
Council Member asked questions from Mr. Murray and the recommendation of the Parks
and Recreation Board. He pointed out that the slide was relocated on the plans to avoid
elimination of the kiddie pool.
Council Member Monger asked for a presentation over Phase II.
Interim Town Manager Arata reported that costs for Phase II would be presented to the
Town Council for funding later. The funds have not been obligated at this time.
Mayor Pro Tem Sheridan made the motion to take no action at this time. The motion
was seconded by Council Member Oldham and passed unanimously (7-0).
Council Member Beach asked for clarification on how Phase II will move forward.
Interim Town Manager Arata explained that when Phase II has been finalized, Town
Staff will come back to the Town Council with the request to move forward with the
project and to fund the project. The swim team’s suggestions will be forwarded to the
Parks and Recreation Board for their consideration.
Arata suggested that the Council could make suggestions for some of these additional
items for the pool be added to the Capital Improvement Plan.
Mayor Tiffany moved Agenda Items #17 and #16 to be heard before Agenda Item #15.
17. Consider and take appropriate action regarding improvements to the Bobcat Blvd
and the High School exit/entrance crosswalk to add pavement striping/marking
and a second set of flashing lights and any other improvements required (Council
Members Jeff Beach and Stacey Bauer)

Council Member Beach stated that this intersection was unsafe and suggested that
improvements be made. He reviewed a slide that showed the proposed additional
crosswalk at this intersection.
Following discussion by the Town Council, the motion was made by Council Member
Beach to direct Town Staff to investigate the potential of improvements at this location.
The motion was seconded by Council Member Monger and passed with the unanimous
(7-0) vote of the Town Council.
16. Future Agenda Items List (Patrick Arata, Interim Town Manager)
Interim Town Manager Arata reviewed the revised Future Agenda Items list.
Mayor Pro Tem Sheridan requested a future workshop on traffic control at the High
School. Council Member Oldham supported his request.
Mayor Tiffany has submitted a Conflict-of-Interest for Agenda Item #15. She turned the meeting
over to the Mayor Pro Tem and left the Council Chambers.
Mayor Pro Tem Sheridan called for a short break and recessed the open meeting at 7:57 PM.
The meeting was reconvened at 8:03 PM.
15, Discuss and consider the request of Hogan’s Glen HOA (Mayor Pro Tem Sheridan)
Mr. Sheridan gave a brief update of this issue that was considered by the Town Council at the
June 13, 2023, meeting. Council Members agreed that a full and complete release from the
HOA was needed, and everyone wanted to support the payment agreed upon.
Town Attorney Dean Roggia explained that the Town should tie the funds offered to Hogan’s
Glen HOA to a scope of work in a drainage easement obtained for a public purpose. He
reviewed the necessary steps to protect the Town in the future.

attract highly qualified new talent and to retain a skilled workforce. Council’s commitment to
maintain the Compensation Pay Plan at the 50th percentile of the Town’s benchmark agencies,
and provide annual merit increases to reward employees meeting performance standards is
accomplished through this policy. In addition, the policy requires an annual Town Council review
of the Compensation Pay Plan in an effort to maintain Council’s directives and commitment to
employees.

WHEREAS, on January 21, 2023, Town Council requested a Compensation Policy be
put forth for their consideration and approval; and
WHEREAS, the Town Council is committed to providing fair compensation for work
performed by Town employees; and
WHEREAS, the Town Council is dedicated to maintaining the Town’s Compensation
Pay Plan at the 50th percentile of the Town’s benchmark agencies, and
WHEREAS, Town Council recognizes the hard work and dedication of Town
employees and is committed to providing annual merit increases to employees meeting
performance standards.
WHEREAS, upon consideration, the Town Council finds and determines it to be in the
best interests of the Town to adopt Exhibit “A” as the Town’s Compensation Policy.
NOW, THEREFORE BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN

Section 1. That the Town Council has reviewed the Compensation Policy and hereby

Compensation Policy

1. PURPOSE
The Compensation Policy is established to set forth Town Council’s direction and philosophy on the
Town’s Compensation Pay Plan for all employment Classifications. The Town’s compensation
philosophy is to recognize and reward employee performance and maintain a competitive pay structure
to retain and attract a highly qualified workforce.
2. POLICY
2.1. Compensation Pay Plan
2.1.1. Town Council shall approve a Compensation Pay Plan annually, no later than the first
meeting each September to establish the base salary Pay Range of all Town
Classifications.
2.1.2. The Town Manager and/or their designee shall conduct an annual review to ensure the
Town is remaining competitive and paying fair market value for the duties in which staff
are performing. The annual review and recommendation to Town Council may include
the following data:
• A compensation study of the Town’s 22 Benchmark Agencies
• Federal Cost of Living Adjustment
• Metroplex municipalities annual pay adjustments
• Dallas/Fort Worth Living Wage
2.1.3. The Town shall conduct a Compensation Study of the Town’s Benchmark Agencies and
set the minimum pay range for each classification at the 50th Percentile, at least every
three years.
2.1.4. The Town Manager and/or designee may request adjustments to the Compensation Pay
Plan throughout the year, for example to include necessary new classifications and
reclassification, as needed.

2.1.5. Town Officer Authority
2.1.5.1. The Town Manager, Town Secretary, and the Town Attorney have the
authority to set their staff salaries within the Pay Range set forth by Town
Council.
2.2. Performance Merit Increases
During the annual budget process, Town Council shall consider performance merit increases for
full-time staff meeting performance standards.
2.3 The Town Council Finance sub-committee shall provide Town Council regular updates during
the annual budget process.
3. DEFINITIONS
Benchmark Agencies
Local municipalities that are comparable to or competitors of the Town, used to compare salary
data for similar classifications.
Classification
A specific job outline, including, but is not limited to, classification title, Fair Labor Standards
Act (FLSA) Status, reporting and supervisory structure, job summary, duties and responsibilities,
qualifications, and work environment.
Compensation Pay Plan
A defined base salary Pay Range for all Town Classifications used to set guidelines to
compensate fair market value for a body of worked performed.
Pay Range
A span between a minimum and maximum base salary for a specific Classification.

Background and Explanation:
Town Council established a strategic initiative to train and retain a skilled workforce. Town
Council has directed staff to update the Compensation Pay Plan annually in an effort to remain
competitive and to attract highly qualified new talent and retain a skilled workforce. During the
January 21, 2023, Council Meeting, staff presented Council with an overview of the 2023
Compensation Survey results. Town Council approved adjustments to maintain the
Compensation Pay Plan at the 50th Percentile of the Town’s benchmark agencies. The amended
Compensation Pay Plan attached provides a 4% market adjustment across all classifications. The
4% market adjustment will assist the Town with maintaining the 50th percentile requirement set
forth by Town Council.
Financial Considerations:
Costs associated with the Compensation Pay Plan adjustments are included in the Fiscal Year
2023/24 proposed budget.

School exit/entrance crosswalk to add pavement striping/marking and a second set of flashing
lights and any other improvements required in an amount not to exceed $18,000 (P. Arata)

Background and Explanation:
At the intersection of Bobcat Blvd and the southeast entry/exit of Byron Nelson Hish School
(across from the Wonderland Montessori), there is currently one flashing pedestrian crosswalk.
This crosswalk is primarily used for students crossing Bobcat Blvd. Staff has attached a map of
this intersection for reference (Exhibit A). Currently, the students have an unprotected crosswalk
(east and west) against the flow of traffic entering and exiting the campus. At council’s request,
staff has gathered bids for two (2) additional crosswalk flashers, striping on west side of
intersection to match east side, and adding concrete ADA ramps to our ROW to match east side.
A new module will be added to have all four (4) synchronized. The streets department will
manage the striping and concrete work. Consolidated Light Controls will provide and install the
crosswalk flashers.
Financial Considerations:
Funding for the project is through the Street Maintenance Fund, Signs and Markings line item 10-
360-65510, with a current remaining balance of $21,033.54 for this current fiscal year.

Background and Explanation:
Annually, the Town Council accepts the Service and Assessment Plan update for Authorized
Services (Emergency Services) for the Town of Trophy Club Public Improvement District No. 1
(The Highlands at Trophy Club), sets the date for a Public Hearing and authorizes the publication
of Notice, and directs the mailings of such Notices as required by law. This notice states the
approximate Total Annual Cost of the Authorized Services, which is figured after receiving the
Fire Rate from Trophy Club Municipal Utility District (TCMUD) No. 1.
Financial Considerations:
The Emergency Services District (ESD) in the PID pays for $541,701 worth of fire expenditures.
This is the district’s portion of fire services, the remainder is paid through the MUD’s property
tax rate. If the ESD assessment was not in place the Town would be responsible for covering those
expenditures.

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TROPHY
CLUB, TEXAS ACCEPTING AN ANNUAL SERVICE AND ASSESSMENT
PLAN UPDATE FOR AUTHORIZED SERVICES (EMERGENCY
SERVICES) FOR THE TOWN OF TROPHY CLUB PUBLIC
IMPROVEMENT DISTRICT NO. 1 (THE HIGHLANDS AT TROPHY
CLUB); SETTING A DATE FOR A PUBLIC HEARING; AUTHORIZING
THE PUBLICATION OF NOTICE AND DIRECTING THE MAILING OF
NOTICES AS REQUIRED BY LAW; ENACTING OTHER PROVISIONS
RELATING THERETO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on March 16, 2007, the Town received a petition meeting the
requirements of Sec. 372.005 of the Public Improvement District Assessment Act (the
“Act”) requesting the creation of a public improvement district over a portion of the area
of the Town to be known as The Town of Trophy Club Public Improvement District No.
1(the “District”); and
WHEREAS, the petition contained the signatures of the owners of taxable property
representing more than fifty percent of the appraised value of taxable real property liable
for assessment within the District, as determined by the then current ad valorem tax rolls
of the Denton Central Appraisal District and the signatures of property owners who own
taxable real property that constitutes more than fifty percent of the area of all taxable
property that is liable for assessment by the District; and
WHEREAS, on May 7, 2007, after due notice, the Town Council of the Town (the
“Town Council”) held the public hearing in the manner required by law on the advisability
of the Improvement Projects and services described in the petition as required by Sec.
372.009 of the PID Act and made the findings required by Sec. 372.009(b) of the PID Act
and, by Resolution No. 2008-08, adopted by a majority of the members of the Town
Council, authorized the District in accordance with its finding as to the advisability of
certain public improvement projects and services; and
WHEREAS, on May 18, 2007, the Town published notice of its authorization of the
District in the Trophy Club Times, a newspaper of general circulation in the Town; and
WHEREAS, no written protests of the District from any owners of record of
property within the District were filed with the Town Secretary within 20 days after May
18, 2007; and
WHEREAS, on May 21, 2007, the Council adopted a resolution (the “Cost
Resolution”) determining the total costs of the District improvements, directing the filing
of a proposed assessment roll, and directing related action; and

WHEREAS, pursuant to Sections 372.013 and 372.014 of the PID Act, the Town
Council has directed the preparation of a Service and Assessment Plan Update for
Authorized Services for the District (the “Plan”), such Plan is attached hereto as Exhibit
“B”, covers a period of at least five years, and defines the annual indebtedness and the
projected costs of the Authorized Services, as identified and defined in the Plan; and
WHEREAS, the Plan Update includes an assessment plan that apportions the cost
of the Authorized Services to be assessed against property in the District and such
apportionment is made on the basis of special benefits accruing to the property because
of the Authorized Services; and
WHEREAS, after determining the total cost of the Authorized Services, the Town
Council directed the preparation of an Assessment Roll that states the assessment
against each parcel of land in the District and such Assessment Roll is attached to and a
part of the Plan; and
WHEREAS, the Town Council notes that the Plan and Assessment Roll may be
amended with such changes as the Town Council deems appropriate before such Plan
and Assessment Roll are adopted as final by the Town Council; and
WHEREAS, the Town has determined to call a public hearing regarding the levy
of assessments pursuant to the Plan and the Assessment Roll pursuant to Section
372.016 of the Act; and
WHEREAS, the Town desires to publish notice of a public hearing to adopt the
Plan and Assessment Roll in order to provide notice to all interested parties of the Town’s
proposed levy of assessments against property in the District, pursuant to Section
372.016 of the Act; and
WHEREAS, the Town desires to file the Annual Service Plan Update and
Assessment Roll with the Town Secretary such that they are available for public
inspection pursuant to Section 372.016 of the Act.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS, THAT:
Section 1. Findings. The findings and determinations set forth in the preambles
hereto are hereby incorporated by reference for all purposes.
Section 2. Calling Public Hearing. The Town Council hereby calls a public hearing
(the “Public Hearing”) for 6:00 p.m. on September 25, 2023 at the regular meeting place
of the Town Council of the Town of Trophy Club, Texas, Trophy Club Town Hall, 1 Trophy
Wood Drive, Trophy Club, Texas, to consider approving the Updated Plan, with such
changes and amendments as the Town Council deems necessary, and the Assessment
Roll with such amendments to the assessments on any parcel as the Town Council
deems necessary. After all objections made at such hearing have been heard, the Town
Council may (i) levy the assessments as special assessments against each parcel of
property in the District as set forth in the proposed Updated Plan and Assessment Roll; 32

(ii) specify the method of payment of the assessment, and (iii) provide that assessments
be paid in periodic installments. Notice of the hearing setting out the matters required by
Section 372.016 of the Act shall be given by publication at least eleven (11) days before
the date of the hearing, in a newspaper of general circulation in the Town. Notice of such
hearing shall also be given by the mailing of a copy of the notice containing the information
required by Section 372.016(b) of the Act at least eleven (11) days prior to the hearing to
the current address of each owner of property liable for an assessment in the proposed
Assessment Roll as reflected on the tax rolls of the Denton Central Appraisal District. All
residents and property owners within the District, and all other persons, are hereby invited
to appear in person, or by their attorney, and contend for or contest the Plan and the
Assessment Roll, and the proposed assessments and offer testimony pertinent to any
issue presented on the amount of the assessments, purpose of the assessments, special
benefit of the assessments, and the costs of collection and the penalties and interest on
delinquent assessments. At or on the adjournment of the hearing conducted pursuant to
Section 372.016 on the proposed assessments, the Town Council must hear and pass
on any objection to a proposed assessment. The Town Council may amend a proposed
assessment on any parcel. The failure of a property owner to receive notice does not
invalidate the proceeding.
Section 3. Publication and Mailing of Notice. The Town Council hereby directs
Town Staff or designee to cause the publication of Notice of the Public Hearing
substantially in the form attached as Exhibit “A”; such publication to occur at least eleven
(11) days before the date of the hearing. Further, the Town Council hereby directs Town
Staff to give Notice of Hearing by the mailing of a copy of the notice at least eleven (11)
days prior to the hearing to the current address of each owner of property liable for an
assessment in the proposed Assessment Roll as reflected on the tax rolls of the Denton
Central Appraisal District.
Section 4. Conduct of Public Hearing. The Town Council shall convene at the
location and at the time specified in the notice described above for the public hearing and
shall conduct the public hearing in connection with its approval of the Plan and the
Assessment Roll and the levy of the proposed assessments, including costs of collection
and penalties and interest on delinquent assessments. At such public hearing, the Town
Council will hear and pass on any objections to the Plan and the Assessment Roll and
the levy of the proposed assessments (which objections may be written or oral). At or on
the adjournment of the hearing, Council may amend a proposed assessment on any
parcel. After all objections, if any, have been heard and passed upon, the Town may (i)
levy the assessments as special assessments against each parcel of property in the
District as set forth in the Plan and Assessment Roll, (ii) specify the method of payment
of the assessment, and (iii) provide that the assessments be paid in periodic installments.

Section 5. Filing of Plan Update and Assessment Roll. The Plan Update and
Assessment Roll shall be filed in the office of the Town Secretary and be made available
to any member of the public who wishes to inspect the same. A copy of the Annual Service
and Assessment Plan Update for Authorized Services is attached hereto and
incorporated herein as Exhibit “B”.
Section 6. Effective Date. This Resolution shall become effective upon its passage
in accordance with law.

TOWN OF TROPHY CLUB
NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN THAT a public hearing will be conducted by the Town
Council of the Town of Trophy Club, Texas on the 25th day of September, 2023 at 7:00 p.m.
at the Trophy Club Town Hall at 1 Trophy Wood Drive, Trophy Club, Tarrant County, Texas
76262. The public hearing will be held to consider proposed assessments to be levied
against the assessable property within THE TOWN OF TROPHY CLUB PUBLIC
IMPROVEMENT DISTRICT NO. 1 (the “District”) pursuant to the provisions of Chapter 372
of the Texas Local Government Code, as amended.
The general nature of the improvements are emergency services (the “Authorized
Services”), including, without limitation, fire suppression and control, inspection services,
arson investigations, hazardous material response, search and rescue, emergency
recovery and extraction, pre-hospital medical stabilization or transportation of persons who
are sick, injured, wounded, or otherwise incapacitated or helpless including basic life
support ambulance services, advanced life support ambulance services, air ambulance
services, and quick-response unit services provided by the Town. The Town has provided
such services pursuant to an annual assessment within the District since 2007.
The total annual cost of the Authorized Services for the Town’s fiscal year 2023-2024
is approximately $541,701.
The boundaries of the District are described as follows:
The District includes approximately 609.683 acres located within the
corporate limits of the Town of Trophy Club, Denton County, Texas. The
District is generally located to the north of Oakmont Drive, Oak Hill Drive and
the Quorum Condominiums, east of the Lakes Subdivision and Parkview
Drive, south of the Corp of Engineers Property and west of the Town’s eastern
town limits. The District is more particularly described by metes and bounds
and such description is available for inspection at Town Hall, 1 Trophy Wood
Drive, Trophy Club, Texas 76262.
All written or oral objections will be considered at the public hearing.
A copy of the Service and Assessment Plan for Authorized Services and proposed
Assessment Roll, which includes the assessments to be levied against each parcel in the
District, is available for public inspection at the office of the Town Secretary, Town of Trophy
Club, at 1 Trophy Wood Drive, Trophy Club, Texas 76262.

Texas Property Code Section 5.014(A) Notice
(Required Before Contract Execution)
NOTICE OF OBLIGATIONS RELATED TO PUBLIC IMPROVEMENT DISTRICT
A person who proposes to sell or otherwise convey real property that is located in a public improvement
district established under Subchapter A, Chapter 372, Local Government Code (except for public
improvement districts described under Section 372.005), or Chapter 382, Local Government Code, shall
first give to the purchaser of the property this written notice, signed by the seller.
For the purposes of this notice, a contract for the purchase and sale of real property having a performance
period of less than six months is considered a sale requiring the notice set forth below.
This Notice requirement does not apply to a transfer:
1) Under a court order or foreclosure;
2) By a trustee in bankruptcy;
3) To a mortgagee by a mortgagor or successor in interest or to a beneficiary of a deed of trust by
a trustor or successor in interest;
4) By a mortgagee or a beneficiary under a deed of trust who has acquired the land at a sale
conducted under a power of sale under a deed of trust or a sale under a court-ordered foreclosure
or has acquired the land by a deed in lieu of foreclosure;
5) By a fiduciary in the course of the administration of a decedent’s estate, guardianship,
conservatorship, or trust;
6) From one co-owner to another co-owner of an undivided interest in the real property;
7) To or from a government entity; or,
8) Of only a mineral interest, leasehold interest, or security interest.
The following notice shall be given to the prospective purchaser before the execution of a binding contract
of purchase and sale, either separately or as an addendum or paragraph of a purchase contract. In the event
a contract of purchase and sale is entered into without the seller having provided the required notice, the
purchases, subject to certain exception, is entitled to terminate the contract.
A separate copy of this notice shall be executed by the seller and the purchase and must be filed in the real
property records of the county in which the property is located at the closing of the purchase and sale of the
property.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN THAT a public hearing will be conducted by the Town
Council of the Town of Trophy Club, Texas on the 25th day of September, 2023 at 6:00
p.m. at the Municipal Building at 1 Trophy Wood Drive, Trophy Club, Texas 76262. The
public hearing will be held to consider proposed assessments to be levied against the
assessable property within THE TOWN OF TROPHY CLUB PUBLIC IMPROVEMENT
DISTRICT NO. 1 (the “District”) pursuant to the provisions of Chapter 372 of the Texas
Local Government Code, as amended.
The general nature of the improvements are emergency services (the “Authorized
Services”), including, without limitation, fire suppression and control, inspection services,
arson investigations, hazardous material response, search and rescue, emergency
recovery and extraction, pre-hospital medical stabilization or transportation of persons
who are sick, injured, wounded, or otherwise incapacitated or helpless including basic life
support ambulance services, advanced life support ambulance services, air ambulance
services, and quick-response unit services provided by the Town. The Town has provided
such services pursuant to an annual assessment within the District since 2007.
The total annual cost of the Authorized Services for the Town’s Fiscal Year 2023-
2024 is approximately $541,701.
The boundaries of the District are described as follows:
The District includes approximately 609.683 acres located within the
corporate limits of the Town of Trophy Club, Denton County, Texas. The
District is generally located to the north of Oakmont Drive, Oak Hill Drive
and the Quorum Condominiums, east of the Lakes Subdivision and
Parkview Drive, south of the Corp of Engineers Property and west of the
Town’s eastern town limits. The District is more particularly described by
metes and bounds and such description is available for inspection at Town
Hall, 1 Trophy Wood Drive, Trophy Club, Texas 76262.
All written or oral objections will be considered at the public hearing.
A copy of the Service and Assessment Plan for Authorized Services and proposed
Assessment Roll, which includes the assessments to be levied against each parcel in the
District, is available for public inspection at the office of the Town Secretary, Town of
Trophy Club, at 1 Trophy Wood Drive, Trophy Club, Texas 76262.

AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS
ADOPTING AND APPROVING THE BUDGET FOR THE FISCAL YEAR
BEGINNING OCTOBER 1, 2023 AND ENDING SEPTEMBER 30, 2024,
AND MAKING APPROPRIATIONS FOR EACH DEPARTMENT,
PROJECT, OPERATION, ACTIVITY, PURCHASE, ACCOUNT AND
OTHER EXPENDITURES; PROVIDING FOR EMERGENCY
EXPENDITURES AND EXPENDITURES AS ALLOWED BY

WHEREAS, the Town of Trophy Club is a home rule municipality regulated by
state law and it’s Charter; and
WHEREAS, the Charter of the Town provides that the Town Manager shall
prepare a proposed budget annually and submit that budget to Council; and
WHEREAS, the proposed budget for the Town of Trophy Club, Texas (the
“Town”) which has been filed with the Town Secretary is a budget to cover all proposed
expenditures of the Town for the fiscal year beginning October 1, 2023, and ending
September 30, 2024; and
WHEREAS, the budget shows as definitely as possible each of the various
projects for which appropriations are set up in the budget, shows the estimated amount
of money carried in the budget for each of such projects, and otherwise complies with
all requirements of the home rule Charter for the Town; and
WHEREAS, public notice of a public hearing on the proposed annual budget,
stating the date, time, and place and subject matter of the public hearing, was given as
required by the laws of the State of Texas and Town Charter; and
WHEREAS, the Town Council has studied the budget and listened to the
comments received at the public hearing and has determined that the budget attached
hereto is in the best interest of the Town of Trophy Club.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:

SECTION 1.
APPROVING THE BUDGET
The all funds summary attached hereto as Exhibit “A” and incorporated herein
is approved and adopted for the fiscal year beginning October 1, 2023, and ending
September 30, 2024; and there is hereby appropriated from the funds indicated and for
such purposes, respectively, such sums of money for such departments, projects,
operations, activities, purchases, accounts and other expenditures as proposed in the
attached budget.
SECTION 2.
PROVIDING EMERGENCY EXPENDITURES
Pursuant to state law, no expenditure of the funds of the Town shall hereafter be
made except in compliance with the budget and applicable state law; provided,
however, that in case of grave public necessity emergency expenditures to meet
unusual and unforeseen conditions, which could not by reasonable, diligent thought and
attention have been included in the original budget, may from time to time be authorized
by the Town Council as amendments to the original budget. Pursuant to Town Charter,
the Council may make emergency appropriations to address a public emergency
affecting life, health, property or the public peace.
SECTION 3.
BUDGET FILED
The Town Council shall cause to be filed a true and correct copy of the approved
budget, along with this Ordinance, with the Town Secretary and in the office of the
County Clerk of Denton County, and Tarrant County, Texas. Additionally, a copy of the
budget shall be posted on the Town’s internet website.
SECTION 4.
CONFLICT
Any and all ordinances, resolutions, rules or regulations in conflict with this
Ordinance are hereby repealed and rescinded to the extent of the conflict herewith.
SECTION 5.
SEVERABILITY
If any section, article, paragraph, sentence, clause, phrase or word in this
Ordinance or application thereof to any person or circumstance is held invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of this Ordinance, and the Town Council hereby
declares it would have passed such remaining portions of this Ordinance despite such
invalidity, which remaining portions shall remain in full force and effect.

SECTION 6.
SAVINGS
All rights and remedies of the Town of Trophy Club, Texas, are expressly saved
as to any and all provisions of any other Ordinance affecting budget requirements,
which have secured at the time of the effective date of this Ordinance.
SECTION 7.
ENGROSSMENT AND ENROLLMENT
The Town Secretary of the Town of Trophy Club is hereby directed to engross and
enroll this Ordinance by filing this Ordinance in the ordinance records of the Town as
required in the Town Charter.
SECTION 8.
EFFECTIVE DATE
This Ordinance shall be effective from and after its date of passage in
accordance with law, and it is so ordained.

Agenda Item:
Conduct a Public Hearing regarding the proposed fiscal year October 1, 2023, to September 30,
2024, budget pursuant to Section 9.05 of the Town Charter and Local Government Code
102.006; making appropriations and providing for expenditures (P. Arata).
Background and Explanation:
The proposed Fiscal Year 2024 budget has been presented to Council on August 14, 2023 – All
Funds.
Financial Considerations:
The Fiscal Year 2024 Budget represents the financial plan for the upcoming fiscal year.

NOTICE OF PUBLIC HEARING
Tuesday, August 29, 2023
The Town Council for the Town of Trophy Club, Texas will hold a Public Hearing on the
Fiscal Year 2023-24 Annual Program of Services (Budget), on Monday, September 11,
2023, at 6:00 p.m. in the Town Council Chambers at Town Hall, located at 1 Trophy
Wood Drive, Trophy Club, Texas. The meeting will be held for the purpose of receiving
community input on the Budget.
THIS BUDGET WILL RAISE MORE PROPERTY TAXES THAN LAST YEAR’S
BUDGET BY $904,831 OR 8.7% AND OF THAT AMOUNT $44,835 IS TAX REVENUE
TO BE RAISED FROM NEW PROPERTY ADDED TO THE TAX ROLL THIS YEAR.
All interested citizens are encouraged to attend and express their views. A copy of the
budget document is available at Town Hall, Monday thru Friday, from 8:00 a.m. to 5:00
p.m.

Flashing lights at the existing roundabout crosswalk.
The Town has received the original signage plan for the round-a-bout at Trophy
Club Dr. and Trophy Lake. During the June 27th Council meeting, Councilmember
Beach directed Director of Community Development Matt Cox to complete
additional research on alternative options for the flashing lights at the next
Council meeting.

Develop a Strategic Plan for the Town addressing future goals with budgetary
needs for each department.
Future Agenda Items have 3 Categories:
Council requested items that need additional research and will be brought back for public discussion at a Council Meeting.
For agenda items with significant research time Council will be updated.
Council requested future agenda items that need to be addressed.
Researched agenda items that are scheduled to be reported to Council. (first 2-4 weeks)
The Future Agenda Items list will be attached to the Council Meeting agenda to provide Council with a status on all items.
During Council meetings, the future agenda items will be reviewed and removed if completed or added if new agenda
items need to be addressed. Footnotes may be added.
The Town Council decided on the Hogan’s Glen drainage matter during the June
13th Council meeting by approving $150,000 from the stormwater drainage
funds to the HOA to mitigate the stormwater siltation. On August 28, 2023, the
Council directed the Town Attorney to create an easement agreement with the
HOA.
Short-Term rentals.
Councilmember Sheridan would like to review short-term rentals before they
become an issue within the Town. During the June 27th Council meeting, Town
Attorney David Dodd presented a short-term rental process. Councilmember
Bauer would like additional definitions of the word “owner” to be defined in the
registration ordinance. The Town has passed this topic to our new Legal Counsel
to review and re-visit at a future Council meeting.
The strategic plan will be addressed at a future workshop.
August 28, 2023
Town staff to provide a plan of action for trash baskets in Town-Owned inlets.
Councilmember Sheridan would like staff to prepare a plan of action to install
trash collector baskets in storm drain inlets in the Town with a not to exceed
amount of $75,000. Also, provide a plan to have PD30 put in trash collector
baskets when phase 3 begins. Interim Town Manager Arata discussed the item
with the Finance subcommittee on June 27th.

discuss and learn about the best solution for traffic control by the High School.
Mayor Tiffany would like to fully update and revise the 1997 comprehensive
land plan.
On August 25, 2020, Mayor Pro Tem Philip Shoffner added the Traffic Mitigation
future agenda item. This item was removed from future agenda items on
January 10, 2023. On August 18, 2023, Interim Town Manager Patrick Arata
added the Roundabouts back to the future agenda item. ¹

Trophy Club park revenues.
Councilmember Bauer would like to explore current and new options for
revenue at Trophy Club Park.
Legal description guidelines.
Councilmember Oldham would like our Community Development Standards to
incorporate legal description guidelines in the review process for the
preparation of all real property descriptions, either for or on behalf of the Town
of Trophy Club, Texas.
Trophy Club community pool.
Councilmember Bauer would like to re-visit Phase 2 of the Trophy Club
Community Pool. The request includes looking at the whole project, including
slides, finances, and Parks Board recommendations.
