Jaramillo). 13.Consider and take appropriate action regarding an office copier lease for an annual amount not to exceed $12,072, lease agreement total over 4 years 3 months (48 months + 3 month period so that the agreement coincides with the Town’s budget/fiscal year) $51,306 (P. Arata). 14.Discussion of Financial Long Range Planning relating to the consideration of proceeding with a new Certificate of Obligation bond issue to fund road replacements and repairs over the next 3 years for an amount not to exceed $7,000,000 (P. SAVINGS AND REPEALER This Ordinance shall be cumulative of all other ordinances of the Town affecting the regulation of land and zoning and shall not repeal any of the provisions of those ordinances except in those instances where the provisions of those Ordinances are in direct conflict with the provisions of this Ordinance whether such Ordinances are codified or uncodified, and all other provisions of the Ordinances of the Town of Trophy Club, codified or uncodified, not in conflict with the provisions of this Ordinance, shall remain in full force and effect. Notwithstanding the foregoing, any complaint, action, cause of action or claim which prior to the effective date of this Ordinance has been initiated or has arisen under or pursuant to such repealed Ordinance(s) shall continue to be governed by the provisions of that Ordinance and for that purpose the Ordinance shall be deemed to remain and continue in full force and effect. SECTION 4. SEVERABILITY The sections, paragraphs, sentences, phrases, clauses and words of this Ordinance are severable, and if any section, paragraph, sentence, phrase, clause or word in this Ordinance or application thereof to any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance, and the Town Council hereby declares that it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. 37 ORD 2023-09 P&Z Page 3 of 4 SECTION 5. PENALTY It shall be unlawful for any person to violate any provision of this Ordinance, and any person violating or failing to comply with any provision hereof shall be fined, upon conviction, in an amount not less than One Dollar ($1.00) nor more than Two Thousand Dollars ($2,000.00), and a separate offense shall be deemed committed each day during or on which a violation occurs or continues. The penalty provided by this section shall be cumulative of all other penalties allowed by law, including without limitation, civil remedies available for enforcement of this Ordinance. SECTION 6. PUBLICATION The Town Secretary of the Town of Trophy Club is hereby directed to publish the Caption, Penalty and Effective Date of this Ordinance as required by Section 52.011 of the Texas Local Government Code. Strategic Link: Infrastructure & Development – Foster a business-friendly environment. Background and Explanation: The subject property was formerly used as a gas well site. The property owner has applied for a Final Plat to develop the property as nine (9) residential lots and one (1) open space lot. The Preliminary Plat was approved by the Planning & Zoning Commission on September 14, 2021 and by Town Council on September 27, 2021. The proposed preliminary plat is located in the R-12 zoning district which requires a minimum lot size of 12,000 square feet, minimum 25 foot front and rear setbacks, and 10 foot side setbacks unless the property is adjacent to a street, in which case a 20 foot side setback is required. Lots are required to be 90 feet wide (110 feet when adjacent to a side street) and 110 feet deep (100 feet for a cul-de-sac lot). Cul-de-sac streets are limited to 600 feet in overall length as measured from the street centerline of the intersecting street and the radius point of the cul-de-sac. The proposed cul-de-sac street exceeds 600 feet and the variance was approved by the Town Council when the Preliminary Plat was approved in 2021. Variance approval considered the provision of multiple fire hydrants and the number of lots. A homeowner’s association (HOA) will be created with the filing of the final plat that will maintain any common elements. At that time, the subdivider will also be required to dedicate fee-in-lieu of parkland. 68 Page 2 of 3 The applicant submitted preliminary engineering plans and they are in review by the Town Engineer and the Trophy Club Municipal Utility District No. 1. The applicant is responsible for verifying the location of the capped wells is not within the buildable area of any lot. The Town will not issue a building permit for a building that sits above a capped well, per Texas Railroad Commission regulations. The capped well heads are located within the right-of-way for the proposed Rose Drive. The Commission has previously directed well heads be illustrated and identification numbers be included on the construction plans. The locations are identified on the grading plans and staff has requested the well heads and identification numbers be added to all sheets in the construction set. Additionally, the gas well sites and associated easements have been abandoned. The applicant has been informed that the pipelines to the well sites have been removed. Prior questions on other gas well sites regarding pipelines remaining have activated the requirement of a “pot-holing” note and execution being added to the construction plans and notification at the preconstruction meeting. “Pot-holing” is the act of locating subsurface utilities. The access (Rose Drive) for the subdivision is provided through the existing Highlands Court which will become a right-of-way. The applicant has submitted the right-of-way document, referenced as a separate instrument, and the Town Attorney and staff are reviewing documentation. A ten (10) foot utility easement, for franchise utilities, along both sides of Rose Drive on the Town of Trophy Club land will be required. Staff requested the applicant prepare and provide the separate instrument document for the ten (10) foot utility easement that parallels both sides of Rose Drive. Staff has received the separate instrument easement and it is under review by the Town Attorney. Upon approval of the Town Attorney the easement and right-of-way document will be filed prior to filing the Final Plat. Financial Considerations: Not applicable. Legal Review: This item is currently under review by the Town Attorney. Staff Recommendation: Staff recommends approval of the Final Plat as presented. Planning & Zoning Commission Recommendation: The Planning & Zoning Commission raised the question regarding the existing screening wall being removed or remaining along the shared property boundary for Lot 14 (partial) through Lots 19, Lots 22 through 23, Block G of The Highlands at Trophy Club Neighborhood 1, Phase 1C-2. The applicant intends to retain the screening wall on the lots referenced above. The residents utilize the wall as their property fence and the applicant does not want to disrupt the neighborhood by removing the fence they have enjoyed for years. The grading plans along the portion of the wall refenced to remain in this location illustrate the wall remaining. Planned Development District-27 (PD-27) does not reference a masonry screening wall being prohibited and the wall is an existing condition. Fence permits will regulate the remaining fences to be erected. The council will be provided updates on items that require significant time. The Future Agenda Items list will be placed on the Council Meeting agenda to provide a status on all items. The current list will be reviewed and as items are completed, said items will be removed. The Council may add items as needed to the list. 1) Receive an update regarding Entryway Monumentation/Landscaping for the Town of Trophy Club. Currently, we have entryway designs and golf statue pictures in hand. We put the project on hold until the May 17th meeting because Mayor Fleury is on the Public Arts Subcommittee. During the executive session on May 17th, we will ask for a subcommittee appointment in her place. Halff has completed renderings for 3 major intersections. A meeting is needed with the Art Subcommittee to approve the renderings and/or ask for changes and choose an intersection for the first project. Once this is done it will be taken to Council final approval and funding of the first intersection. 2) Develop a Strategic Plan for the Town addressing future goals with budgetary needs for each department. At the director’s advance, we put a pin in the strategic plan until we get direction from the new Mayor and Council. 3) Modifying the Existing Veteran’s Memorial to include “Space Force”. The POW and MIA monument was moved last year and replaced with the Space Force monument. The new POW and MIA monument was installed on January 23, 2023, and the unveiling event is scheduled for May 20th from 10:00 am-11:00 am. Staff have identified 6 citizens in the Trophy Club with members of their families that have either been POWs or MIA. Those individuals will be personally invited to the unveiling. The Recreation team will be working with the Veteran’s Committee on the order of events for the ceremony. 4) Hogans Glen Drainage. After the Council meeting on April 25th, Council requested to meet in an Executive session at 5 PM on the May 17th Council meeting. They also requested that an engineer estimate and scope of work for the stormwater infrastructure in Hogan’s Glen be reviewed. Patrick met with TNP on the Hogan’s Glen engineer estimate and will discuss it with Council during the Executive session. 73 1 5 5 1 5) Flashing lights at the existing roundabout crosswalk. The Town has received the original signage plan for the round-a-bout at Trophy Club Dr. and Trophy Lake. Staff will present options for signage to be replaced or added to this intersection during the June 13th Council meeting. 6) Adjustment to Subdivision Standards requiring lot drainage to public improvements, prohibiting lot- to-lot drainage, and prohibiting open storm inlets on a residential lot; allow for special exceptions by P&Z and Council, where engineering presents a significant critical need; Allow for grandfather of the existing approved drainage plans. Councilman Sheridan and Matt Cox met with TnP on April 14th. At this time, TnP will let us know what they can add to the engineering civil standards. Matt will send it to Dennis for review after he receives it from TnP. 7) Charter Review Sub Committee to address ethical issues. Specifically, code of fair campaign practices. Items 1,2,5,7. Do we want to keep this on the future agenda items? If so, we will need to go out for a charter subcommittee. 74
