Background and Explanation:
Josh Johnson of Kilgore Industries is requesting approval of a Specific Use Permit for electric vehicle (EV)
charging spaces consisting of two (2) Level 2 EV charging stations utilizing three (3) existing parking spaces.
Two of the parking spaces will be converted to one handicapped accessible space. The EV charging spaces
will be located at Trophy Club Town Center Addition BLK A Lot 1, in the south parking lot of Blue 22 and
the Starwood Café. The charging stations will be utilized as electric vehicle charging spaces for the
customer’s electric vehicles. Both stations incorporate LED display screens for branding and messaging.
Financial Considerations:
Not applicable.
Legal Review:
This item is under review by the Town Attorney.

Staff has multiple unanswered questions for the applicant and have been unable to get a response. Staff
is recommending opening the public hearing and continuing the public hearing to the next available
Planning and Zoning Commission meeting in hopes of resolving outstanding questions.

Dear Property Owner:
You are receiving this notice because you own property within 200 feet of, or within, the
boundaries of the subject property that is affected by the proposed changes, which are described
below and shown on a location map on the reverse side.
A request made by Kilgore Industries for a Specific Use Permit to install two (2) Electrical
EV Charging Stations, generally located approximately 315 feet east of Trophy Club Drive
and approximately 200 feet north of SH 114.
Public Hearings will be held at a special called meeting by the Planning & Zoning Commission on
Wednesday, November 16, 2022, and a Public Hearing will be held by the Town Council on
Tuesday, December 13, 2022. Both meetings will be held at 7:00 PM at Town Hall, 1 Trophy Wood
Drive in Trophy Club regarding the above request, and action may be taken on the request at the
public hearing.

(Preliminary Plat Title: The Hawthorn Estates at Trophy Club, 7H)
Consider and possibly act on a request for a Final Plat for The Falcon Estates at Trophy Club, consisting of
3.692 acres out of the Richard W. Allen Survey, Abstract No. 5, located south of Kent Street between
Trophy Club Drive and Mona Vale Road, Trophy Club, Denton County, Texas.

Background and Explanation:
The subject property was formerly used as a gas well site. The property owner is requesting to develop
the property as eight (8) residential lots and one (1) common/open space lot with a public cul-de-sac
street serving each lot.
The proposed Final Plat is located in the R-12 zoning district which requires a minimum lot size of 12,000
square feet, minimum 25 foot front and rear setbacks, and 10 foot side setbacks unless the property is
adjacent to a street, in which case a 20 foot side setback is required. This requirement applies to lots 1
and 8. Lots are required to be 90 feet wide (110 feet when adjacent to a side street) and 110 feet deep
(100 feet for a cul-de-sac lot).
A minimum six foot high masonry screening wall will be required along any lots with side or rear yards
that are contiguous to a primary collector or greater right of way. An HOA lot (9X) is shown between Lot
8 and the future extension of Trophy Club Drive and will accommodate the screening wall.
A homeowner’s association (HOA) will be created with the filing of the Final Plat that will maintain any
common elements. At that time, the subdivider will also be required to pay fee-in-lieu of park land fees.

The applicant is responsible for verifying that the location of the capped wells are not within the buildable
area of any lot. The capped well heads are noted and located along the right-of-way for Aspen Drive. The
Town will not issue a building permit for a building that sits above a capped well, per Texas Railroad
Commission regulations and Town ordinance.
Full civil plans have been submitted and are in review. The civil plans are a separate submission from the
Final Plat.

This item has been reviewed by the Town Attorney.
Staff Recommendation:
Staff recommends approval of the Final Plat subject to the following Subdivision Ordinance
requirements/conditions/revisions:
1. Parkland Fees shall be paid prior to construction beginning and the issuance of building permits.
Article 10.03 Parkland Dedication and Open Space, Section 10.03.009 and Section 10.03.010
2. A Developer’s Agreement shall be signed by the Mayor after engineering plans and cost estimates
have been approved. Division 7. Developer's Agreement, Financial Assurance and Construction
Contracts for Public Improvements, Article 10.02.201 Procedures
3. The Final Plat will be filed of record by the Town in the plat records of the county where the real
property is located after the Town Council has officially acted upon the Final Plat, bonds/securities
have been submitted and approved by the Town and all developer agreements or subdivision
agreements have been executed by all involved parties and accepted by the Town.
4. The gas well sites are not currently served by Trophy Club Municipal Utility District No. 1 and the
wholesale contract for water and wastewater service between the Town of Trophy Club and the
District will need to be amended prior to any construction in order to provide water and
wastewater service.

located south of Trophy Club Drive, approximately 230 feet east of Bobcat Boulevard and approximately
20 feet west of Mossman Lane, Trophy Club, Denton County, Texas.

Background and Explanation:
The subject property was formerly used as a gas well site. The property owner is requesting to develop
the property as seven (7) residential lots and two (2) common/open space lot with a public cul-de-sac
street serving each lot.
The proposed Final Plat is located in the R-12 zoning district which requires a minimum lot size of 12,000
square feet, minimum 25 foot front and rear setbacks, and 10 foot side setbacks unless the property is
adjacent to a street, in which case a 20 foot side setback is required. This requirement applies to lot 1.
Lots are required to be 90 feet wide (110 feet when adjacent to a side street) and 110 feet deep (100 feet
for a cul-de-sac lot).
A minimum six foot high masonry screening wall will be required along any lots with side or rear yards
that are contiguous to a primary collector or greater right of way. The developer anticipated utlilizing the
existing screening wall where possible. Lots 1, 6 and 7 of Block A provide for a five (5) foot wall
maintenance easement adjacent to the open space lots (Lots 8X and 9X) along Trophy Club Drive.
A homeowner’s association (HOA) will be created with the filing of the Final Plat that will own and
maintain any common areas/lots.

The applicant is responsible for verifying that the location of the capped wells are not within the buildable
area of any lot. The capped well heads are noted and located along the right-of-way for Aspen Drive. The
Town will not issue a building permit for a building that sits above a capped well, per Texas Railroad
Commission regulations and Town ordinance.
Full civil plans have been submitted and are under review. The civil plans are a separate submission from
the Final Plat.

Staff Recommendation:
Staff recommends approval of the Final Plat subject to the following Subdivision Ordinance
requirements/conditions/revisions:
1. Parkland Fees shall be paid prior to construction beginning and the issuance of building permits.
Article 10.03 Parkland Dedication and Open Space, Section 10.03.009 and Section 10.03.010
2. A Developer’s Agreement shall be signed by the Mayor after engineering plans and cost estimates
have been approved. Division 7. Developer's Agreement, Financial Assurance and Construction
Contracts for Public Improvements, Article 10.02.201 Procedures
3. The Final Plat will be filed of record by the Town in the plat records of the county where the real
property is located after the Town Council has officially acted upon the Final Plat, bonds/securities
have been submitted and approved by the Town and all developer agreements or subdivision
agreements have been executed by all involved parties and accepted by the Town.
4. The gas well sites are not currently served by Trophy Club Municipal Utility District No. 1 and the
wholesale contract for water and wastewater service between the Town of Trophy Club and the
District will need to be amended prior to any construction in order to provide water and
wastewater service.

Chairperson Rowe asked if there were any public requests to speak. No public requests to speak were

ITASHA – 52 HALAFAX, ROANOKE spoke regarding the Trails PD project with concerns regarding
safety, privacy, and impact on value of home if built behind his property and his neighbors.
REGULAR SESSION
1. Case PD21001 (Trails PD)
A. Conduct a Public Hearing regarding a request to rezone approximately 8.88 acres from R15,
Singlefamily Residential District to a PD, Planned Development District to construct 27 detached
singlefamily residential lots located at 2304 and 2344 Trophy Park Drive.

Town Interim Planner David Jones presented the staff report and was available for questions.
Chairperson Rowe requested a better description regarding the lot sizes.
Mr. Jones state there is a maximum building coverage is 65% regarding the PD.
Chairperson Rowe asked for discussion. Commissioner Biggs inquired the density and Mr. Jones stated last
proposed was lack of open space. Chairperson Rowe asked regarding this proposal had to wait 12mns, Mr.
Jones stated the applicant chose to wait. Commissioner Gibson inquired about the setbacks; Mr. Jones the
density is the number of units divided by the acreage. Mr. Jones also stated they will be going to the 20 feet
building line to be in line with the surrounding neighborhoods.
Applicant – ADAM BUCHEK 8214 MANCHESTER DRIVE, DALLAS – presented and stated there were a
lot of change during Covid and adjustments . Decided to reapply and believe the new plan will be better and
hope the Commissioners will be pleased with the new proposal. Commissioner Rowe asked there is an
access easement to current cell tower, why the landowner is hanging on to ownership. Why not allow you to
purchase the strip of property.
Landowner – JOHN COLMAN – 196 CR 4655 RHOME – holding on to land because does not want to let go
of it, wants to hold on to because has a lease agreement with the tower owners.
Applicant – Buchek continued with his presentation and was available for questions.
Chairperson Rowe asked for discussion or a motion. Commissioner Gibson mentioned there was a history
of rezone adjacent developments might be nice to have something to compare too. Chairperson Rowe what
is the percentage in the last few years on infield compared to full scale developments. Mr. Buchek stated
they average 10 projects a year in 5 years 2/3 on infields. Commission Rowe what percentage have been
Windsor 1/3 but this project will be Drees.
Chairperson Rowe asked if there were any more discussions, there were none. There won’t be any voting
tonight, that will be on 09/14/2021. Applicant asked if this was in the general area of what they wanted.
Chairperson Rowe stated they have made changes.
2. Case PD21002 (Beck Townhomes PD)
A. Conduct a Public Hearing regarding a request to rezone approximately 4.9 acres located east of
Bobcat Boulevard and north of Byron Nelson High School from MH, HUD Code Manufactured Home
and Industrialized Housing District to a PD, Planned Development District to construct 36
Townhomes.
B. Discussion and recommendation regarding a request to rezone approximately 4.9
acres located east of Bobcat Boulevard and north of Byron Nelson High School from MH, HUDCode
Manufactured Home and Industrialized Housing District to a PD, Planned Development District to
construct 36 Townhomes.
Chairperson Rowe opened the public hearing at 7:47 PM.

Town Interim Planner David Jones presented the staff report and was available for questions.
Chairperson Rowe asked to explanation when the details for platting, development, etc…
Mr. Jones stated for it to be approved it would have to take the site plan submitted then addition engineering
standards for drainage, water/sewer would make sure to have what is necessary to serve these townhomes and if
they wouldn’t be able to move forward with the development to start construction. ROWE is any portion in the
FEMA flood plain. Mr. Jones would have to look if its in the flood plain. Commissioner Gibson stated was there a
flood or drainage study completed? Commissioner Biggs stated its green space because its flood plains.
Commissioner Gibson regarding the trail is it own by applicant, how they will build a road? Mr. Jones it is not owned
by applicant would have to work out with the property owner and the easement.
RENE – the land where the trail goes across is owned by NISD and the access easement is in place and a request
has been made for utilities.
YOSHUA – 6623 CRESTLAND AVE, DALLAS – is with Beck Ventures has been developing TC for over 30 years,
those two lots are MH housing. This project has been designed to be highend product. The civil engineer will be
working with the town to comply.
Commissioner Gibson stated regarding ISD easement how can it impact the trail, will there be a trail over the road
or a crosswalk. Yoshua have not spoken about bringing sewer line to the property, best option was to speak with
ISD and they are on board with the plans.
Chairperson Rowe stated that the density will always be a concern, doesn’t make sense to put that amount of
rooftop. Addressed the homeowners apologized about being told that it was going to stay green space. Something
specific needs to be done with the trail design and taking care of pedestrians. FEMA shows flood plain on map,
requested applicant and staff to make sure before the next meeting.
Commissioner Blake stated people will be curious with the finish floor plans and the road between the two sections
will it be a bridge situation.
Mr. Duboe gave clarification on the next meeting so other people can come with their concerns.
RENE stated the $600k none will be sad but if the land is not in the flood plain, they could allow more space that will
increase the value of the townhomes.
ITA stated that is a private land what was told cannot blame the landowner, can’t build a home right behind our
homes. Don’t see how the value of the townhomes is going to help ours.
DENISE stated main concern is the safety of the kids, trail was built on the school property. ISD is not aware that it
could be an issue.
YOSHUA stated that the ISD is will aware of the plans.
Chairperson Rowe asked for discussion. There were no further discussions.

Director Cox provided a staff update and was available for questions.

Commissioner Gibson inquired about new tenants moving into the town center, Blue 22 finished out.
Grant Gould – 4514 HOPKINS AVE, DALLAS is the leasing agent at Trophy Club town center and updated the
Commissioners with current tenants and proposed tenants.

Chairperson Rowe asked if there were any public requests to speak. No public requests to speak were submitted.
REGULAR SESSION
1. Case TUP 21-001 (PD-30 Lot 2)
Discussion and recommendation regarding a request for a Temporary use Permit to allow a
construction trailer on Trophy Club Town Center Addition Block A Lot 2, generally located
approximately 730 feet east of Trophy Club Drive and approximately 100 feet north of SH 114,
currently zoned PD-30, Planned Development.
Director Matt Cox presented the staff report and he was available for questions.
Chairperson Rowe called for a motion. Commissioner Biggs moved to recommend approval, with a
second by Commissioner Rowe. Chairperson Rowe called for a vote. The motion was passed
unanimously 7-0 (unanimous).

Chairperson Rowe called for a motion. Commissioner Stevens moved to recommend approval, seconded by
Commissioner Branum. Chairperson Rowe called for a vote. The motion passed unanimously 7-0
(unanimous).
3. Case PD-21-003 (The Trophy Townhomes – 401 Trophy Wood Drive)
a. Conduct a Public Hearing regarding a request to rezone and establish a Planned Development for
up to 7 town home lots along with one open space lot and one common private street lot on
property described as Lot 3R2, Block A, Trophy Wood Business Center, an addition to the Town
of Trophy Club, located at 401 Trophy Wood Drive in the Town of Trophy Club, Tarrant County,
Texas, currently zoned PD-25, Planned Development.
b. Discussion and recommendation regarding a request to rezone and establish a Planned
Development for up to 7 town home lots along with one open space lot and one common private
street lot on property described as Lot 3R2, Block A, Trophy Wood Business Center, an addition
to the Town of Trophy Club, located at 401 Trophy Wood Drive in the Town of Trophy Club, Tarrant
County, Texas currently zoned PD-25, Planned Development.
Chairperson Rowe opened the public hearing at 7:05 PM.
Public comments were presented by the following individuals opposing the PD:

Chairperson Rowe closed the public hearing at 7:44 PM.
Applicant Armr, 9 Lake Circle Dr., Trophy Club, TX gave a presentation of the proposed development along
with PowerPoint slides and was available for questions.
Discussion focused on the color schemes, the use of a private gate, establishing an HOA, the HOA to cover
cost on any future water line repairs, going with minimum lighting, recommendation of lower intensity, having
MUD look into the per-tree ordinance, accessory structure requirements clarity on the PD, issues about having
a cut through and traffic flow. Discussion about building materials, concerns about privacy of the residents on
Jamie Court.
Chairperson Rowe asked for further discussion or a motion. Commissioner Stevens motioned for approval with
the following changes to the PD:
1) Remove “must utilize 3 architectural enhancements” replace with “must utilize the following architectural
enhancement…”
2) Remove maximum pitch of 6:12 (all roofs will be flat)
3) Add language specifying an HOA will be created

4) Add language prohibiting accessory structures
Chairperson Rowe called for a motion. Commissioner Stevens moved to recommend approval of the request with
the amendments listed, seconded by Barbarin.
Chairperson Rowe called for showing of hands vote. Motion passed 6-1 with Commissioner Poole opposing.
4. Case PP021-007 (The Trophy Preliminary Plat)
Discussion and recommendation regarding a request for a Preliminary Plat consisting of 7 town
home lots along with one open space lot and one common private street lot on property
described as Lot 3R2, Block A, Trophy Wood Business Center, an addition to the Town of Trophy
Club, located at 401 Trophy Wood Drive in the Town of Trophy Club, Tarrant County, Texas,
currently zoned PD-25, Planned Development.

by Commissioner Biggs.

5. Case PD-21-004 (Beck Townhomes)
a. Conduct a Public Hearing regarding a request to rezone and establish a Planned Development for
up to 35 townhome lots along with open space lots on two tracts totaling approximately 4.9 acres
located east of Bobcat Boulevard and north of Byron Nelson High School in the Town of Trophy
Club, Denton County, Texas, currently zoned MH, HUD-Code Manufactured Home and
Industrialized Housing District.
b. Discussion and recommendation regarding a request to rezone and establish a Planned
Development for up to 35 townhome lots along with open space lots on two tracts totaling
approximately 4.9 acres located east of Bobcat Boulevard and north of Byron Nelson High
School in the Town of Trophy Club, Denton County, Texas, currently zoned MH, HUD-Code
Manufactured home and Industrialized Housing District.

Chairperson Rowe asked for discussion or a motion. Commissioner Biggs motion to approve with the following
changes to the PD:
1) Meet or exceed buffer to typical Trophy Club single-family/non single-family standard.
2) Include sidewalk standards.
3) Indicate landscaping along perimeter, screening of northern lots.
4) Shift northwest parking further west.
5) Realign private road turning north to tract 1HB to address sharp curve.
6) Consider removing Lot 33.

Chairperson Rowe called for a motion. Commissioner Branum moved to recommend approval, second by
Commissioner Jablonski.
Chairperson Rowe called for showing of hands vote. Motion passed 5-2 with Chairperson Rowe and
Commissioner Biggs opposing.
6. Receive updates on previous cases heard by Commission and active development in Town.
Director Cox stated there were none.
