Fees in order to impose a surcharge on PID residents for the Annual Capital Improvements and
Maintenance Charge due to MUD1 pursuant to the Amended and Restated Contract for
Wholesale Water Supply and Wastewater Treatment Services and Water and Wastewater
Operational Services between the Town and MUD1.
Explanation: In accordance with the Amended and Restated Contract for Wholesale Water
Supply and Wastewater Treatment Services and Water and Wastewater Operational Services
entered into by the Town and Trophy Club MUD1 on April 15, 2014 the PID residents will be
required to pay their fair share of any new debt issued by the MUD as well as the non-
operational O&M component of the MUD’s overall tax rate. That amount has been calculated
at $8.90 per PID water customer per month (see attached spreadsheet). In order to affect this
surcharge, Council will have to amend the fee schedule to include this new surcharge. The
proposed amendment to the Fee Schedule will be considered on the Sept. 23, 2014 agenda
along with any other fee changes that are included in the proposed FY15 budget. The proposed
effective date (October 2014) of the fee schedule amendment would assume that the MUD will
issue $5.7M by December 31, 2014 and the subsequent Interest Only payment would be due in
August 2015. Delaying the effective date until the debt is actually issued would require the PID
residents to pay the same interest rate expense over a shorter time period, thus increasing the
monthly surcharge. There is a provision in the agreement to ‘true up’ the financial effects of the
proposed surcharge at the end of each fiscal year.

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF
TROPHY CLUB, TEXAS, AMENDING RESOLUTION NO. 2012-08
ADOPTING THE MUNICIPALITY OF TROPHY CLUB HANDBOOK FOR
ELECTED AND APPOINTED OFFICIALS TO ADD A SECTION
ENTITLED “RESIDENCY REQUIREMENT/TEMPORARY CHANGE IN
RESIDENCY STATUS” IN ORDER TO PROVIDE A PROCESS FOR
MEMBERS SERVING ON BOARDS, COMMISSIONS AND
CORPORATIONS TO REQUEST THAT COUNCIL REVIEW THEIR
RESIDENCY STATUS WHEN THEY TEMPORARILY RESIDE OUTSIDE
OF THE TOWN LIMITS IN THOSE CIRCUMSTANCES WHERE
RESIDENCY IS NOT REQUIRED BY TOWN CHARTER OR STATE
LAW; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Town benefits by having its citizens involved in local government
through service on various Town Council appointed boards, commissions, and
corporations and has established several appointed bodies that perform various
functions for the Town; and
WHEREAS, the Town initially adopted the Municipality of Trophy Club Handbook
for Elected and Appointed Officials” (hereinafter “Handbook”) to establish guidelines and
procedures for Town Council appointed bodies and to ensure uniform treatment of all
persons applying for and serving on those bodies; and
WHEREAS, the guidelines established in the Handbook are in addition to those
requirements imposed by the Texas Open Meetings Act, Town Charter, and other
applicable state law; and
WHEREAS, the Town Council has determined it appropriate to amend the
Handbook by adding a section entitled “Residency Requirement/Temporary Change in
Residency Status” to provide a process for Council review in the event that a person
serving on a Board, Commission or Corporation temporarily relocates from the Town for
those positions where residency is not required by Charter or state law; and
WHEREAS, the passage of this Resolution amends Resolution No. 2012-08
adopting the Handbook as more particularly set forth below without altering, modifying
or repealing any other provision of the Handbook; and
WHEREAS, the Town Council has determined that adoption of this revised
Handbook will be beneficial to the Town and its residents and serve the public welfare.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:

Section 1. That the foregoing recitals are adopted and incorporated herein as
findings.
Section 2. That the Town Council hereby amends Resolution No. 2012-08 by
adding a section entitled “Residency Requirement/Temporary Change in Residency
Status” to provide a process for Council review in the event that a person serving on a
Board, Commission or Corporation temporarily relocates from the Town for those
positions where residency is not required by Charter or state law, and
Section 3. That a section entitled “Residency Requirement/Temporary Change
in Residency Status” shall be added to the Handbook and shall be and read in its
entirety as follows:
Residency Requirement/Temporary Change in Residency Status
In addition to the residency requirement for citizens making application to
serve on Town Boards, Commissions, and Corporations, a person serving
as a member must reside within the Town of Trophy Club during his or her
term of service in order to continue serving. However, if during the term of
appointment or during the time frame for reapplication, the residency
status of a then current member of a Board, Commission or Corporation
temporarily changes, the member may request that the Council review
his/her specific circumstances affecting residency. If the temporary
change in residency status does not disqualify a member of a Board,
Commission, or Corporation from continuing to serve either because of a
Charter or state law requirement for service on his/her respective Board,
Commission, or Corporation, the Council may authorize the continued
service or reappointment of the member until such time as the member
returns to permanent residency status.
Section 4. That this Resolution shall become effective upon its passage, and
that upon passage of this Resolution, the Handbook shall be amended as set forth
hereinabove.

Consider and take appropriate action regarding an Ordinance amending the Fiscal Year 2013-
2014 Budget of the Town (Budget Amendment No. 3) making appropriations in accordance with
the Town Charter related to Outside Legal Services, Engineering, Property Insurance, Building
Maintenance, Property Maintenance, and Prior Year Encumbrances.
Explanation:
It is not uncommon for situations to arise throughout the Fiscal Year that force departments to
exceed their budgets. In Fiscal Year 2013-2014 those instances are minimal. In the General
Fund, expenditures for Outside Legal Services ($15,000), Engineering ($40,000), Property
Insurance ($5,000), and Building Maintenance ($10,000) have exceeded their respective
budgets and require increased appropriations. Outside Legal Services requires increased
appropriation due to higher than anticipated need for these services in Fiscal Year 2014.
Engineering requires increased appropriation due to higher than anticipated development in
Fiscal Year 2014. Property Insurance requires increased appropriation due to higher than
anticipated premiums in Fiscal Year 2014. Building Maintenance requires increased
appropriation due to higher than anticipated building repairs in Fiscal Year 2014. The increased
General Fund appropriations are offset by increased Developer’s Fees of $40,000 and increased
Sales Tax of $30,000. In the Trophy Club Park Fund, Property Maintenance requires an
increased appropriation in the amount of $15,000 primarily due to gate repairs which is offset
by increased Park Revenues of $15,000. In the Street Maintenance Sales Tax Fund, Street
Maintenance requires an increased appropriation in the amount of $50,774 due to prior year
encumbrances for a truck replacement and mobile wash system.

AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS
AMENDING THE FY 2013-2014 BUDGET OF THE TOWN OF TROPHY
CLUB, TEXAS (AMENDMENT NO. 3); PROVIDING FOR THE
INCORPORATION OF PREMISES; PROVIDING FOR AN AMENDMENT
TO APPROPRIATE FUNDS NEEDED FOR ENGINEERING SERVICES,
SPECIALIZED OUTSIDE LEGAL SERVICES, PROPERTY INSURANCE,
BUILDING MAINTENANCE, PROPERTY MAINTENANCE, AND PRIOR
YEAR ENCUMBRANCES; PROVIDING A SAVINGS AND REPEALER
CLAUSE; PROVIDING FOR SEVERABILITY; PROVIDING FOR
ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Town of Trophy Club, Texas Fiscal Year 2013-2014 Budget was
adopted within the time and in the manner required by State Law; and
WHEREAS, the engineering services, specialized outside legal services,
property insurance, facilities maintenance, and property maintenance needs of the
Town have changed due to higher than anticipated need for engineering services,
higher than anticipated development, higher than anticipated need for specialized
outside legal services, higher than anticipated property insurance premiums,
unforeseen building repairs, and unforeseen property repairs; and
WHEREAS, this amendment increases the appropriation for Engineering in the
Planning and Zoning Department by $40,000, due to higher than anticipated
development in the Town, and this expenditure is offset by increased Developer Fees of
$40,000; and
WHEREAS, this amendment increases the appropriation for Professional
Outside Services in the Legal Department in the General Fund by $15,000 due to higher
than anticipated utilization of specialized outside legal services; and
WHEREAS, this amendment increases the appropriation for Building
Maintenance by $10,000 and Insurance by $5,000 in the Facilities Maintenance
Department in the General Fund, due to unforeseen facility maintenance and higher
than anticipated property insurance premiums; and
WHEREAS, this amendment increases revenue from Sales Tax in the General
Fund by $30,000; and
WHEREAS, this amendment increases the appropriation for Property
Maintenance in the Trophy Club Park Fund by $15,000 primarily due to gate repairs,
and this increase in expenses is offset by higher than anticipated Park Revenues of
$15,000; and

WHEREAS, this amendment increases the appropriation for Street Maintenance
in the Street Maintenance Fund by $50,774 due to encumbrances from the prior year for
a truck replacement and mobile wash system; and
WHEREAS, the Town Council of the Town of Trophy Club, Texas hereby finds
and determines that it is prudent to amend specific line items due to the costs
associated with the outside legal services, increased development, property insurance
premiums, facilities maintenance, property maintenance, and prior year encumbrances;
and
WHEREAS, the Town Council of the Town of Trophy Club, Texas further finds
that the amendment, as set forth in Exhibit “A”, will serve the public interest and is
necessary to support Town operations; and
WHEREAS, the Town Council of the Town of Trophy Club, Texas finds and
determines that the change in the Budget for the stated municipal purpose serves best
interests of the taxpayers, is necessary and warrants action at this time;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
SECTION 1.
INCORPORATION OF PREMISES
That the above and foregoing premises are true and correct and are incorporated
herein and made a part hereof for all purposes.
SECTION 2.
AMENDMENT
The Town of Trophy Club, Texas, Fiscal Year 2013-2014 Budget is hereby
amended to fund the line items as stated in Exhibit “A”, a copy of which is attached
hereto and incorporated herein. This Amendment No. 3 (Exhibit “A”) to the Original
Budget of the Town of Trophy Club, Texas, for the Fiscal Year 2013-2014 shall be
attached to and made part of the Original Budget by the Town Secretary and shall be
filed in accordance with State Law. This Ordinance is hereby adopted and shall
constitute the third amendment that has occurred since the October 1, 2013 effective
date of the Town’s Fiscal Year 2013-2014 Budget.
SECTION 3.
SAVINGS AND REPEALER
That this Ordinance shall be cumulative of all other Ordinances of the Town
affecting the Fiscal Year 2013-2014 Budget of the Town and shall not repeal any of the
Ordinances are in direct conflict with the provisions of this Ordinance; whether such
Ordinances are codified or uncodified, and all other provisions of the Ordinances of the

Town of Trophy Club, codified or uncodified, not in conflict with the provisions of this
Ordinance, shall remain in full force and effect.
SECTION 4.
SEVERABILITY
If any section, article, paragraph, sentence, clause, phrase or word in this
Ordinance, or application thereof to any person or circumstance, is held invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of the Ordinance, and the Town Council hereby
declares it would have passed such remaining portions of the Ordinance despite such
invalidity, which remaining portions shall remain in full force and effect.
SECTION 5.
ENGROSSMENT AND ENROLLMENT
The Town Secretary of the Town of Trophy Club is hereby directed to engross
and enroll this Ordinance in the Ordinance records of the Town and to properly record
this Ordinance in accordance with the Town Charter.
SECTION 6.
EFFECTIVE DATE
This Ordinance shall take effect from and after its date of passage in accordance
with law, and it is so ordained.
PASSED AND APPROVED by the Town Council of the Town of Trophy Club,
