street at 1 Durango Drive.
b. Take appropriate action regarding a request for a variance to allow a garage to face the
street at 1 Durango Drive.
The Board of Adjustment was originally scheduled to hear this case on August 12 th. The meeting was not
held due to lack of a quorum.
Background and Explanation:
Approval of a variance is being requested to allow a garage to face the street in the R-8 Single
Family District. The subject property is 9,632 square feet in area. The previous house located at
1 Durango Drive in the Village West, Section B subdivision burned down in February 2021 and
the owners are rebuilding with a different floorplan. Previously, the garage was at the front of
the house with a j-swing driveway, but in an effort to increase the size of the house, the owners
propose to move the garage to the back and face it toward the side street.
In the R-8 district, garages are not allowed to face the street on all lots 9,000 square feet or larger,
and no garages are allowed to face a side street, regardless of lot size. This request is not
compliant with either current requirement; however, it does not appear that these two
requirements were in effect in the 1980s and 1990s when this subdivision was developed. There
are many houses adjacent to the subject property that have garages facing the side street on lots
that are over 9,000 square feet (Exhibit D). Written requirements from that time period were
also found stating that a garage cannot face SH 114, Trophy Lake Drive, or Village Trail which
indicates that a garage could face any other street in the area.

The proposed house, including the garage, is compliant with all setbacks, easements, maximum
lot coverage, and minimum floor area (Exhibit C).
Public notice was published in the newspaper and sent to those who own property within 200
feet of the subject property. To date, staff has received zero inquiries.
Zoning Board of Adjustment Authority:
The Zoning Board of Adjustment has the authority to act upon a request for variance. The
following should be considered in determining the validity of a hardship.
1. Is the request owing to a distinct condition inherent in the property itself (e.g., irregularly-
shaped lot, unusual topography, etc.)?
2. Is the condition unique to the property (e.g., unusual slope, odd location, etc.)?
3. Is the condition self-imposed or self-created?
4. Is the request owing to a financial hardship?
5. Will a literal enforcement of the zoning ordinance result in an unnecessary hardship?
6. Will the hardship prevent any reasonable use whatsoever?
7. Will the granting of the variance be contrary to public interest?
8. Is the request within the spirit of the ordinance and does it further substantial justice?
The decision of the Board is final.

CALL TO ORDER AND ANNOUNCE A QUORUM
Chairperson Sanders called the July 8, 2021 Zoning Board of Adjustment meeting to order at 6:00 PM and
announced a quorum.

CITIZEN PRESENTATIONS
Citizens are allowed four (4) minutes to address the Board regarding an item over which the Board has policy or
oversight authority as provided by Texas law, the ethics order, or other policy order.
Chairperson Sanders asked if there were any public requests to speak. No public requests to speak were
submitted.
REGULAR SESSION
1. Tabled Agenda Item – Case ZBA-21-002 (113 S. Greenhill Trail)
Take appropriate action regarding a request for a special exception to allow a fence to encroach on
the front setback at 113 S. Greenhill Trail.
Chairperson Sanders called for a motion to remove the item from the table. Secretary Murtaugh moved to remove
the item from the table, with a second by Board Member Kesterson. Chairperson Sanders called for a vote. The
motion passed unanimously 4-0.
Town Planner Lisa Payne presented the staff report and was available for questions. The applicant, Michael
Machado, explained that due to the Board’s comments at the last meeting, he has decided to replace almost all
of the wrought iron with a board-on-board wood fence to obstruct views into his garage area. The only exception
is the 3’ wide section that extends from the garage wall. All wood fencing will be painted to match the posts. There
were no public comments.

Chairperson Sanders called for a motion. Secretary Murtaugh moved to approve the special exception with the
condition that a solid wood fence is installed, with a second by Board Member Kesterson. Chairperson Sanders
clarified that the material of the fence should not be considered during the vote as the request is only to allow the
setback encroachment. However, Chairperson Sanders allowed the motion to stand as-is and called for a vote.
The motion passed unanimously 4-0.
2. Take appropriate action regarding the April 8, 2021 Zoning Board of Adjustment meeting minutes.
Chairperson Sanders asked the Board for any corrections or additions. There were none.
Chairperson Sanders called for a motion. Board Member Kesterson moved to approve the April 8, 2021 Zoning
Board of Adjustment meeting minutes, with a second by Vice Chairperson Jeff Sims. Chairperson Sanders called
for a vote. The motion passed unanimously 4-0.
3. Take appropriate action regarding the May 13, 2021 Zoning Board of Adjustment meeting minutes.
Chairperson Sanders asked the Board for any corrections or additions. There were none.
Chairperson Sanders moved to approve the May 13, 2021 Zoning Board of Adjustment meeting minutes, with a
second by Secretary Murtaugh. Chairperson Sanders called for a vote. The motion passed unanimously 4-0.
4. Receive Town Planner updates on previous cases heard by the Board and active development in Town.
Town Planner Lisa Payne provided a staff update and was available for questions.

Chairperson Sanders adjourned the meeting at 6:17 PM.
