Greenhill Trail) Take appropriate action regarding a request for a special exception to allow a fence to encroach on the front setback at 113 S. Greenhill Trail. Background and Explanation: The owner of the subject property is requesting approval of a special exception so that he may finish construction of a fence and automatic gate 3’ in front of the façade of his house. Section 14.02.351(c)(1) of the Town’s Code of Ordinances states: “Front elevation. All fences shall be located a minimum of ten feet (10') behind the front elevation of the primary structure.” An exception is being sought because the garage is at the front of the house (facing the side) and the applicant would like to enclose the driveway around his garage to make it a secure space. As shown in Exhibit C, the new 6’ tall fence encroaches 3’ into the 25’ front setback at the front corner of the house, and due to the curved front property line and setback, the encroachment increases to about 10’ as you follow the fence from the house to the side property line. The applicant began construction without realizing he’d need a special exception to build a fence and gate in the proposed location. The photos in Exhibit D show that the fence and walk-through gate have already been constructed, but the automatic driveway gate is awaiting approval from the Board and a permit to be issued. Zoning Board of Adjustment Authority: Section 14.02.351(P) of the Trophy Club Code of Ordinances authorizes the Zoning Board of Adjustment to consider and allow waivers to the fence requirements as a Special Exception. The language from the ordinance reads: Page 2 of 2 “The Zoning Board of Adjustment shall have the power to grant a Special Exception waiving or modifying these regulations where the literal enforcement of this Ordinance would result in practical difficulty or unnecessary hardship and the relief granted would not be contrary to the public interest but would do substantial justice and would be in accordance with the spirit of this Ordinance. A public hearing is not required for Zoning Board of Adjustment consideration of a Special Exception under this Section. 1. For the purpose of this Ordinance, the following are established as general conditions, all of which are to be met upon the granting of any special exception. a. No diminution in value of surrounding properties would be suffered; and b. Granting the permit would be of benefit to the public interest or surrounding properties; and c. Denial of the permit would result in unnecessary hardship to the owner seeking it; and d. A zoning restriction as applied to the owner’s property interferes with the reasonable use of the property, considering the unique setting of the property in its environment; and e. By granting the permit, substantial justice would be done; and f. The use must not be contrary to the spirit of the Ordinance. 2. The burden of demonstrating that all general conditions have been met and that a Special Exception is appropriate is upon the person requesting the Special Exception. The Zoning Board of Adjustment may require a person requesting a Special Exception to provide proof as the Board determines necessary and appropriate for the Board to evaluate the application for Special Exception.” The decision of the Board is final. Background and Explanation: The owner of the subject property is requesting approval of a special exception so that he may construct a fence that encroaches on the side yard setback adjacent to a side street. Section 14.02.351(c)(2) of the Town’s Code of Ordinances states: “Side yard adjacent to side street. Side yard fences shall be located within the side yard building setback, and shall not extend beyond the building line of the side yard adjacent to a side street.” An exception is being sought in order to construct a fence around the pool that the property owner is planning to build. The applicant’s property backs up to the golf course and there is currently no fence, but one will be required when a pool is built. The proposed fence will be constructed just inside the large shrubs that round the southern corner of the property as shown on Exhibits B & C. There is a 20’ setback adjacent to the side street and the applicant would like to build a fence approximately 14’ from the street which would be about 7’ inside the property line. That equates to a 13’ encroachment into the 20’ side setback. The fence will be built inside utility and drainage easements, but that is common practice for fences since property lines are often within easements. The fence is required to be constructed with wrought iron along the golf course, but wood may be used along the rest of the fence line if the applicant so chooses. Background and Explanation: The applicant is requesting approval of a variance to encroach 37’ into the 40’ rear setback in order to reconstruct a building that had to be demolished. Last year, the roof caved in on the northern building of the subject property that operated as a daycare and the business had to move out. In order to make the property useable again, the applicant would like to rebuild in the same location that was approved by variance in 1995 (Exhibit E) and by site plan in 1996 (Exhibit D), which references the granted variance. Also approved in 1996 was an encroachment into the 10’ utility easement along the rear property line (Exhibit F). In 1995, the Trinity Learning Center (as it was formerly known) was granted a variance by the ZBA for the rear yard to be reduced from 15’ to 3’. The property was (and still is) zoned Neighborhood Services (NS) which has a 30’ rear setback, but at the time of first submittal, the NS district had a 15’ rear setback requirement. This is explained in the attached ZBA Order (Exhibit E). Since that time, the NS district regulations have been amended again to add a 40’ setback when adjacent to residentially zoned or developed property. At the time the subject property was developed, there were no adjacent residences and as stated in the ZBA Order, the adjacent property was intended for open space. Trinity Learning Center tried to purchase more land from the adjacent property owner, but was rejected. Page 2 of 2 Exhibit C shows the location of the current setbacks and easements that affect the site and proposed building to be reconstructed. This item has come back to the ZBA for approval because the building has been damaged by more than 50% which means it has lost its legal nonconforming status which allowed it to be located 3’ from the rear property line. Public notice was published in the newspaper and sent to those who own property within 200’ of the subject property. To date, staff has received no inquiries. Zoning Board of Adjustment Authority: The Zoning Board of Adjustment has the authority to act upon a request for variance. The following should be considered in determining the validity of a hardship. 1. Is the request owing to a distinct condition inherent in the property itself (e.g., irregularly- shaped lot, unusual topography, etc.)? 2. Is the condition unique to the property (e.g., unusual slope, odd location, etc.)? 3. Is the condition self-imposed or self-created? 4. Is the request owing to a financial hardship? 5. Will a literal enforcement of the zoning ordinance result in an unnecessary hardship? 6. Will the hardship prevent any reasonable use whatsoever? 7. Will the granting of the variance be contrary to public interest? 8. Is the request within the spirit of the ordinance and does it further substantial justice? The decision of the Board is final.
