EXPLANATION: The signs requested by the applicant exceed both the Town sign regulations and the Special Event Ordinance regulations for number of signs allowed, size of sign allowed, and duration of display allowed. The applicant requests a meritorious exception for this event, which is a fund raiser to benefit wounded warriors. TOWN COUNCIL GOAL(S): Goal #2: Business-Friendly Economic Development Create effective working relationships with businesses and developers Retain / Develop existing businesses Promote new commercial opportunities Goal # 3: Strong Partnerships and Community Involvement Create a positive regional identity Foster a well informed community Forge collaborative relationships with other governmental and public entities Support citizen volunteer opportunities Promote recreational / active lifestyle opportunities for all ages RECOMMENDATION AND JUSTIFICATION TO COUNCIL: The benefactors of this event are wounded warriors and the residents of Trophy Club, staff, and Council are very supportive of the armed forces. The banners will help publicize the event to contribute to a successful outcome. Staff recommends approval. Town Council 2 of 5 Meeting Date: September 6, 2011 TOWN COUNCIL STAFF REPORT September 6, 2011 Request for Meritorious Exception - Signage SUBJECT: Consider and take appropriate action regarding a request for meritorious exception for temporary special purpose signs for a Wounded Warriors event scheduled for October 1, 2011. APPLICANT: Gene Popik On behalf of Wounded Warriors Inc. Wounded Warriors Project www.TCSWW.org SPECIAL PURPOSE SIGNAGE REGULATIONS Chapter 5-General Land Use, Article IV-Sign Regulations defines a Special Purpose Sign as a temporary sign that is either on-premise or off-premise that provides identification or information pertaining to a special event or occurrence sponsored by a non-profit or civic organization. Section 4.05-Temporary Signs, Subsection E. Special Purpose Signs: Allows the non-profit organization to place one (1) special purpose sign no more than four (4) square feet on a premise or lot for up to fourteen (14) days prior to the event, and shall be removed within twenty-four (24) hours following the event. SPECIAL EVENT SIGNAGE REGULATIONS The special events ordinance allows staff to approve one banner, up to 50 sq. ft. in size, and to allow informational and directional signs on the day of the event – those signs cannot exceed 4-sq. ft. in size. This request exceeds both the Town sign regulations and the Special Event Ordinance regulations. REQUEST Gene Popik, organizer of the Trophy Club event to benefit Wounded Warriors, is asking for an exception to the sign regulations to allow: Town Council 3 of 5 Meeting Date: September 6, 2011 (1) Two banners (2) Each banner may be a maximum size of 36 sq. ft. (3) Banners to be allowed for more than 14 days prior to the event, specifically up to 23 days before the event; (4) All signage to be removed within forty-eight (48) hours following the event. EXAMPLES OF BANNERS: 6 x 6 sq. ft.: Town Council 4 of 5 Meeting Date: September 6, 2011 8 or 9 x 4 sq. ft.: PLANNING AND ZONING COMMISSION RECOMMENDATION: On August 18, 2011, the Planning and Zoning Commission heard this request, unanimously support the event, and unanimously recommended that the Town Council grant approval for this request: Commissioner Sheridan made a motion recommending approval of the request, with nods from all Commissioners. Commissioner Reed seconded the motion, with all other Commissioners voicing a second and Commissioner Richert asking all the veterans on the Commission to second the motion. The motion was unanimously approved. TOWN COUNCIL ACTION Section 4.10-Meritorious Exceptions and Appeals (Chapter 5, Article IV) A primary objective of the sign regulations is to ensure against signage of low visual quality. On the other hand, another primary objective is to guard against over control. It is not the intent of the sign criteria to discourage innovation. It is conceivable that signage proposals, while nonconforming and not allowable to the sign regulations, may have merit to the particular site or situation. Upon request, the Town Council, upon recommendation by the Planning and Zoning Commission, shall hear and shall seriously and fairly consider a request for a meritorious exception.
