Background and Explanation: According to Sec. 14.02.251 of the Code of Ordinances, construction offices that are used temporarily by contractors during the construction of buildings must obtain a Temporary Use Permit (TUP) through approval from Town Council, after recommendation by the Planning & Zoning Commission. In addition, the allowed time period may tie into the schedule of construction, with annual renewal through this same process, if necessary. The applicant is requesting approval of a TUP to allow one construction trailer, temporary fencing, and Conex storage boxes to locate on the hotel portion of the PD-30 property while construction is ongoing. The construction trailer will be located in an open area that will later be landscaped and the Conex storage boxes will be set in parking spaces near the masonry screening wall to the east. A 6 foot tall chain link fence will connect to either side of the masonry screening wall in order to surround the entire lot for security. Refer to Exhibit A for layout details. Construction of the Aloft hotel and all infrastructure on this lot is expected to be complete by May 2021, so the applicant requests that the TUP is active until May 31, 2021, if approved. Background and Explanation: The applicant recently purchased this one acre tract of land that had previously been owned by a single family for decades and never platted. The purpose of the preliminary plat is to identify the new lot layout and the plan for drainage and utilities. The proposed preliminary plat is located in the R-12 Single Family zoning district and divides the tract into two lots of approximately a half acre each which exceeds the 12,000 square foot minimum lot size requirement. The lot width and depth of both lots also exceed the minimum requirements. The plat notes a 25 foot front building line (setback), matching the regulation found in the Town’s Code of Ordinances. Although side and rear building lines are not often labeled on plats, the 10 foot side building line along the western property line of Lot 1, Block A is shown to avoid conflict. Lot 1, Block 3 of Hogan’s Glen, Phase 2 is an open space lot that is only 10 feet wide at the corner of Meadowbrook Lane and Meadowbrook Lane and could easily be overlooked when setbacks are called into question. Since the proposed Lot 1, Block A is not a corner lot along a side street, it does not have an increased side yard setback requirement. There is an existing 8 inch water line that runs on the north side of Meadowbrook Lane’s right-of-way (ROW) and an existing 8 inch sanitary sewer line that runs on the south side of Meadowbrook Lane’s ROW. The plat includes labels where 1 inch taps will be installed on the water line for each lot and where 4 inch sanitary sewers will be installed to cross the ROW to the lots. A 5 foot utility easement has been added to both properties to account for existing overhead power lines along the rear property lines and the lots will be graded to drain toward the street, but it is not necessary to add any other utility or drainage easements according to the surveyor and confirmed by the Town’s Engineer. With the issuance of a demolition permit, the buildings shown on the preliminary plat have now been removed and the property has been mowed. The trees shown on the plat remain. Discussion included an explanation about why the SUP is necessary, how the proposal compares to existing signs, and the location of the proposed sign. Staff report was presented by Town Planner Lisa Payne and she was available for questions. Discussion included how the proposed sign does not fit into a PD-30 signage category, that it will be visible from SH 114, and that it was shown on the site plan. Chairman Beach called for a motion. Vice Chairman Rowe moved to recommend approval as presented, seconded by Commissioner Gibson. Chairman Beach called for a vote.
