The Trophy Club Town Council met in a Regular Meeting on Monday,September 27, 2021.The meeting was held at Town
Hall, 1 Trophy Wood Drive in the Council Chambers.

CALL TO ORDER AND ANNOUNCE A QUORUM
Mayor Fleury called the meeting to order at 7 PM and noted a quorum present, noting that all five Council Members were
present.
INVOCATION
Pastor Joel Quile, of the Trophy Club Bara Church delivered the Invocation. He prayed for the Council, First Responders,the
Medical Community, as well as peace, building bridges, not taking sides, protection and most of all, to love well within our
Town,Country,and World.
PLEDGES
Council Member Monger led the pledges to the American Flag and Texas Flag.
ANNOUNCEMENTS AND REPORTS
1. Trophy Club Women's Club Fall Garage Sale—Saturday,October 9,2021 from 9 AM—2 PM.W.Carroll)
Town Manager Carroll reported the Trophy Club Women's Club Fall Garage Sale will be held on Saturday, October 9, 2021;
from 9 am—2 pm. Permits are available for purchase at Tom Thumb with proceeds benefitting the scholarship program for
graduating BNHS High School Seniors.
Mayor Fleury added that this special event requires purchasing a permit,just like any other event. She encouraged residents
that would like to participate to purchase their$20 permit. She also shared that the Trophy Club Women's Club is the largest
collector of donations for charity within the Community,who give thousands annually to those in need,especially women and
children. She reminded everyone that is participating to be kind when approached about their permit as the volunteers are
just doing their job and giving back to the Community.
2. National Night Out—October 5,2021 from 6 PM—10 PM.(W.Carroll)
Mr.Carroll reported National Night Out will be held on October 5, 2021;from 6 pm—10 pm. The premise of said event is for
citizens to get to know their neighbors. He shared that the Fire and Police Departments will stop by for a visit with all HOAs
that register and noted for additional information; contact Officer Shereen Contreras. Mayor Fleury encouraged all residents

to engage within their community to not only see old friends but to meet new ones.
3. Business Spotlight—Pastaza Italian Restaurant.(Mayor Fleury)
Town Governance Officer Vacek stated that Pastaza Chef Joseph Ajro was in the kitchen filling orders and would be bringing a
pizza to share later in the evening.

4. Issuance of Proclamation 2021-24 proclaiming October 5,2021,as National Night Out. (Mayor Fleury)
Mayor Fleury read and moved to approve Proclamation 2021-24. Council Member Monger seconded the motion.The motion carried
as follows:

Mayor Fleury presented Proclamation 2021-24 to Chief Arata and Chief Taylor and thanked them.
5. Issuance of Proclamation 2021-25 proclaiming Breast Cancer Awareness Month. (Mayor Fleury)
Mayor Fleury read and moved to approve Proclamation 2021-25. Council Member Sheridan seconded the motion. The motion
carried as follows:

Mayor Fleury gave a shout out to Sarah Hamp who was recognized as the 2019 Breast Cancer Awareness Recipient. Ms. Hamp
is the Founder of the Facebook Group"Pink Life" and has taken a position with Cancer StrongHER(www.cancerstrongher.org)
encouraging all to take advantage of the support offered through this organization. Mayor Fleury also announced that on
October 2,2021,Shannon Brewing Company would be hosting a"Brews&Blues for Boobs"Fundraiser encouraging all to attend.
Lastly,Mayor Fleury presented Proclamation 2021-25 to Sharon David,Assistant to the Town Governance Officer and three year
Breast Cancer Survivor.
CONSENT AGENDA
Mayor Fleury highlighted Item #7 to announce the November 8, 2021 Town Council Regular Meeting will be rescheduled to
November 11, 2021 in conjunction with the Canvass of the Town's Special Election.
Council Member Sheridan requested that Items 10 and 11 be addressed individually with the other preliminary plats.
6. Take appropriate action approving the Regular Meeting Minutes of September 13,2021.(L.Vacek)
7. Take appropriate action to reschedule the Regular Town Council Meeting of November 8,2021 to Thursday,November

15. Conduct a Public Hearing to consider proposed Annual Service and Assessments to be levied against the assessable
property within the Town of Trophy Club Public Improvement District No.1(The Highlands at Trophy Club)pursuant to
the provisions of Chapter 372 of the Texas Local Government Code as amended.(M. Erwin)
Mayor Fleury declared the Public Hearing open at 7:16 pm and asked if anyone had registered to speak. Town Governance Officer
Vacek confirmed there were no speakers for the Public Hearing. Mayor Fleury declared the Public Hearing closed at 7:17 pm and addressed
Item 16.
16. Take appropriate action to approve Ordinance 2021-19 for the adoption of the Tax Rate for Public Improvement
District No.1(The Highlands at Trophy Club).(M.Erwin)
Mayor Pro Tern Lamont made a motion to approve Ordinance 2021-19 adopting the Tax Rate for Public Improvement District No.1(The
Highlands at Trophy Club). Council Member Monger seconded the motion. The motion carried as follows:

17. Case PD-21-001(The Trails)
A. Conduct a Public Hearing regarding a request to rezone approximately 8.88 acres from R-15, Single-Family
Residential District to a PD,Planned District to construct 27 detached Single-Family Residential lots located at 2304
and 2344 Trophy Park Drive.
Mayor Fleury declared the Public Hearing open at 7:18 pm and asked if anyone had registered to speak. Town Governance
Officer Vacek confirmed the applicant had registered to speak.
David Jones presented said item stating that citizen calls had been received with some in favor and some in opposition. He
reported that Staff does not recommend approval of this request due to the proposed increase in density and reduction in lot
size as compared to the current R-15 Zoning. He added that the Planning and Zoning Commission denied this request at their
September 14, 2021 Meeting. Mayor Fleury closed the Public Hearing at 7:25 pm and recognized the applicant, Mr. Buczek.
Adam Buczek, with the Skorburg Company, 8214 Westchester Drive, Suite 900, Dallas, Texas 75225, provided a presentation
on proposed rezoning for The Trails.

B. Discussion and action on recommendation regarding a request to rezone approximately 8.88 acres from R-15,
Single-Family Residential District to a PD,Planned District to construct 27 detached Single-Family Residential lots
located at 2304 and 2344 Trophy Park Drive.
Mayor Fleury inquired on Mr. Buczek's comment during his presentation regarding the decision being a political issue. Mr.
Buczek stated from a land use planning perspective,he wondered why the Planning&Zoning Commission denied this request.
He added that the Town does not owe any explanation as he was not given much feedback on the denial,other than a density
issue. He stated that two Planning Commissioners, at their recent meeting stated the value had been established while two
Churchill Downs residents approached him with changing their position due to the price per foot being higher than expected.
Mayor Pro Tern Lamont asked if the situation regarding the parking had been resolved. Mr. Buczek confirmed the 20 ft
requirement was met. Mayor Pro Tern Lamont also asked of the builder, Drees Homes, and if there was a requirement that
the builder is not changed out with another. Mr.Buczek replied that the builder would be Drees Homes;if approved,and gave
his word for the record.
Council Member Sheridan commented that he was not in favor of siding utilized as part of the percentage of masonry. Mr.
Buczek stated this could be struck-out. Council Member Sheridan asked if there was another way to provide tower access and
do away with the 20 ft. He asked if it was part of the lease. Mr. Buczek confirmed that was in the recoded instrument and
noted that they have provided an additional access point. Council Member Sheridan also indicated that he was not a fan of
110 ft to the opposing streets but understood this was an engineering standard that was met. Lastly,he noted the lack of open
space but added that the property is close to all the Parks. Mr.Buczek confirmed and mentioned they had paid all their fees.
Council Member Sheridan asked if anyone could report on the two P&Z Commissioners' reasoning behind approving the
request. Mr. Rhylan Rowe,Chairman of the Planning&Zoning Commission addressed the Council and explained the vote.
Council Member Shoffner referenced last year's Council Meeting Minutes in regards to this request where he shared his opinion
that his biggest concern was density. He stated that he still felt the exact same way. He stated that the current zoning was
appropriate for the proposed property,and was willing to compromise to R-12 zoning adding more density creates traffic issues
as he referenced Teague,Nall and Perkins'view on traffic for the area. Mr.Buczek asked if Council would table the item tonight
for further review of the R-12 zoning.
Council Member Shoffner recommended that said item be brought back to the Council without prejudice,whether the item is
tabled or denied. Mr. Buczek noted the setbacks conform to the R-10 zoning and if they remained the same, he would
appreciate the chance to submit a revised project. Mr. Carroll confirmed the item would have to be sent back to the Planning
&Zoning Commission.
Council Member Shoffner made a motion to deny the rezoning request without prejudice. Council Member Sheridan seconded
the motion.The motion carried as follows:

Mayor Fleury announced that Pastaza was unable to attend tonight as the Business Spotlight due to orders pouring in and
looked forward to have them at a future Council Meeting. She proceeded with Item 10.
10. Take appropriate action regarding a request for a preliminary plat for Lots 1-10, Block A, The Hawthorn Estates at
Trophy Club, consisting of 3.692 acres out of the Richard W. Allen Survey, Abstract No. 5, and the John R. Michael
Survey, Abstract No. 820, located south of Kent Street between Trophy Club Drive and Mona Vale Road, Trophy
Club,Texas.(D.Jones)
David Jones presented the preliminary plat request for the Hawthorn Estates. He reported that staff is recommending approval
of this request. Mayor Fleury called upon Mr. Hands to speak. Mr.Timothy Hands, 2886 Redfern,shared he moved to Trophy
Club 7 years ago because they love the community and the rules in effect that make it a safe place to live. He referenced the
section 14.03.037 1 of the code stating, "No structure shall be built over an abandoned well". He also referenced the 2015
International Building Code that defines a structure that is built or constructed,pointing out that a public road falls under this
specific definition as well as a parking lot,and a cul-de-sac. Mr. Hand stated he is opposed to all the proposed plats as they do

not follow section 14.03.037 I.
After a discussion relating to an environmental review and right-of-way;Council Member Sheridan made a motion to approve
the preliminary plat subject to specifically identifying the exact location of each capped wellhead on the final plat and add a
note on the final plat that no capped well head is to be on a residential lot. Council Member Shoffner offered a friendly
amendment to the motion to include the word"private,residential lot". Mayor Pro Tern Lamont seconded. The question was
called and the amendment carried as follows:

11. Take appropriate action regarding a request for a preliminary plat for Lots 1-4, Block A,The Maple Estates at Trophy
Club,consisting of 1.821 acres out of the Thomas J.Allen Survey,Abstract No.7, located north of Milsons Point Drive,
Trophy Club,Texas.(D.Jones)
David Jones presented the preliminary plat for The Maple Estates. He reported that staff is recommending approval of this request.
Mayor Fleury asked Mr. Hands if he wanted to speak on said item. Mr. Hands stated his previous comments on Item 10 also
applied to Items 11, 18, 19 and 20.
Council Member Sheridan voiced his concern over the environmental aspect of this project. He thanked the citizens for the
feedback received but announced that it be understood,that these tracts would be built on,as that is the right of the owner.
He added that the Council's responsibility is to make sure there is good transparency. A discussion ensued related to the
capped depth of the well sites. Mr. Carroll explained the exact depth is not known at this time but that the depth will be
included. He noted that the Railroad Commission confirmed that the gas wells were capped per their standards.
Council Member Sheridan made a motion to approve the preliminary plat subject to specifically identifying the exact location
of each capped wellhead on the final plat and add a note on the final plat that no capped wellhead is to be on a private,
residential lot. Council Member Shoffner seconded the motion.
Mayor Fleury asked for confirmation that the preliminary plat presented meets the minimum standards for approval. Mr.
Carroll confirmed that was correct. Mayor Fleury confirmed with Mr. Dodd that having clarified that the preliminary plat
presented meets the minimum standards for approval;this places the Council in the position to perform their ministerial duty
to approve the plat. Mr. Dodd confirmed this was correct. Council Member Shoffner commented on the 10 foot depth
requirement performed at 3 feet and does this apply to keep the 3 feet depth. Mr. Dodd confirmed this was correct. It was
noted that the depth of the capped well is far greater that just 3 feet as there are different stratus levels. Mr. Carroll stated
the grading plan would be reviewed and any issues will be addressed at that time.

18. Case PP-21-002(The Willow Estates at Trophy Club)
Take appropriate action regarding a request for a preliminary plat for Lots 1-10,Block A,The Willow Estates at Trophy
Club, consisting of 4.208 acres out of the Rosalinda Allen Survey, Abstract No. 17, located west of Highland Court,
Trophy Club,Texas.(D.Jones)
David Jones presented the preliminary plat for The Willow Estates,noting that the next 3 plats are before the Council due to a variance
request associated with them to the length of the cul-de-sac. The applicant has agreed to add additional fire hydrants as staff is

recommending approval of this request. Mayor Fleury called upon Mr.Hand to speak followed by Charles Little.
Mr.Hands added to his previous comments a concern related to capped wells;where studies have shown they can leak.
Mr.Charles Little,2621 Morgan Lane,thanked Mr.Hand for his comments and stated he had served in the military. He also shared concerns
over the addition of Beck Properties adding more homes to Trophy Club. He noted the welfare of children by far out way the risks. Mayor
Fleury thanked Mr.Little for his service to our country.
Council Member Sheridan thanked Mr.Little for his service. He asked for clarification on the legal definition of structure,which has a definite
definition in platting,zoning and building code regulations. Mr.Jones explained that the Subdivision Ordinance and Zoning each have their
own definition. Mayor Fleury asked if the plat meets the minimum requirements and standards. Mr.Carroll confirmed this was correct,
other than the variance for the 600 feet within the cul-de-sac. Town Attorney Dodd confirmed this puts the Council in a position to provide
a ministerial duty to approve it. Council Member Shoffner stated his dislike of"ministerial duty", but if zoning was met,Council has to
approve. In response to the length of the cul-de-sac as far as the variance being requested;Mr.Jones confirmed all three requests were over
600 feet but under 1,000 feet.
Mayor Pro Tern Lamont made a motion to approve the request for a preliminary plat for Lots 1-10,Block A,The Willow Estates at Trophy
Club,consisting of 4.208 acres out of the Rosalinda Allen Survey,Abstract No.17,located west of Highland Court,Trophy Club,Texas,and
have the exact location of each capped wellhead on the final plat and not allowed on private,residential property. Council Member Monger
seconded the motion. The motion carried as follows:

19. Case PP-21-003 (The Oak Estates at Trophy Club)
Take appropriate action regarding a request for a preliminary plat for Lots 1-9,Block A,The Oak Estates at Trophy Club,
consisting of 4.339 acres out of the Thomas J.Allen Survey,Abstract No.7,located west of Milsons Point Drive,Trophy
Club,Texas.(D.Jones)
David Jones provided a presentation on The Oak Estates, with this proposal being an R-15 Zoning, meeting all the standards with the
exception of the 600 feet cul-de-sac length. He reported this case has the same concession by the applicant as the previous case,to install
additional fire hydrants at the final plat phase as recommended by Town Staff. Mayor Fleury called on Mr.Hand. He declined to speak as
he had the same previously made comments. Mayor Fleury duly noted same.
Mr.Jonathan Harris,2877 Milson's Point;referenced Lot 635111,owned by the Highlands of Trophy Club Neighborhood Association. He
reported opening up a title request at Independence Title of Roanoke as well as talked with the HOA,who has no impression that Beck
Properties had access to the property. Mr.Harris recommended tabling this item until verification of the title request had been received
that Beck Properties had access to build on this lot. He also noted along the fence line;a blind spot is created for children who maybe playing.
Mr.Harris asked Chief Taylor,with the location of his home,how long he estimates to arrive at his house with cars parked on both sides of
the street. Mr.Harris also inquired of the width of this particular street being wide enough to accommodate fire apparatus,as the minimum
is 26 feet and the street provides 30 feet. Mr.Carroll asked Chief Taylor at what point would the Fire Department review the number/location
of fire hydrants as well as the safety aspect of the project. Chief Taylor confirmed the Fire Marshall and all departments involved would have
discussions,as detailed plats are available.
Council Member Shoffner asked Mr.Dodd if the Town has a piece of property that is land-locked,does the Town have to provide access.
Mr. Dodd stated that you could not lock someone out. Mayor Fleury asked Mr. Carroll if the preliminary plat meets the minimum
requirements and standards. Mr.Carroll confirmed this was correct,as with the previous plat,with the exception of the 600 feet depth.
Mayor Fleury asked Mr.Dodd what the requirements were for Council to consider this request. Mr.Dodd confirmed that it is the Councirs
responsibility to provide its ministerial duty under municipal law.
Mayor Pro Tern Lamont made a motion to approve the request for a preliminary plat for Lots 1-9,Block A,The Oak Estates at Trophy Club,
consisting of 4.339 acres out of the Thomas J. Allen Survey,Abstract No.7,located west of Milsons Point Drive,Trophy Club,Texas,and have
the exact location of each capped wellhead on the final plat and not allowed on private,residential property. Council Member Shoffner

Take appropriate action regarding a request for a preliminary plat for Lots 1-10,Block A,The Cypress Estates at Trophy
Club,consisting of 3.581 acres out of the Richard W. Allen Survey,Abstract No.5,located south of Nottingham Drive at
Annandale Drive,Trophy Club,Texas.(D.Jones)
David Jones provided a presentation on The Cypress Estates,with this proposal being an R-12 Zoning and confirmed all standards are met,
with the exception of the 600 feet cul-de-sac length as staff was recommending approval. He reported that the final plat phase would show
right of access. Mr.Jones responded to Council Member Sheridan's comment related to the wording change of the Staff Report noting a
couple of gas wells were potentially outside the right of way. Mayor Fleury noted Mr.Hand's previous comments. Mayor Pro Tern Lamont
asked Mr.Dodd if the Council has the requirement and obligation to adhere to ministerial duties with this request. Mr.Dodd confirmed that
it was the Council's responsibility to provide its ministerial duty and under municipal law,as a Council Member could be liable individually.
Mayor Pro Tern Lamont made a motion to approve the request for a preliminary plat for Lots 1-10,Block A,The Cypress Estates at Trophy
Club,consisting of 3.581 acres out of the Richard W.Allen Survey,Abstract No.5,located south of Nottingham Drive at Annandale Drive,
Trophy Club,Texas,and have the exact location of each capped wellhead on the final plat and not allowed on private,residential property.
Council Member Monger seconded the motion. The motion carried as follows:

Mayor Fleury thanked the residents who spoke tonight and their involvement in the Community.
21. Presentation by Teague,Nall,and Perkins on Drainage Project located at Indian Creek Drive.(W.Carroll)
Mr.Carroll reported necessary property had been obtained for project,which includes an additional easement. He stated that the next
phase will be presented by Teague,Nall,and Perkin(TNP). Mr.Tom Rutledge of TNP provided presentation on the Drainage Project with
the next step being this project going out to bid on October 3, 2021 with bids to be opened on October 26, 2021 and present a
recommendation at the November 8,2021 Town Council Meeting. Mayor Fleury reminded Mr.Rutledge of the November Council Date
moving to November 11,2021 and thanked him for his presentation.
22. Future Agenda Items List.(W.Carroll)
Mr.Carroll presented the Future Agenda Items List. Mayor Pro Tern Lamont requested the Election to reauthorize the Sales
Tax for Street Maintenance be added to the list as it will require an election be held May 2022 as will be called by February
2022. Mr.Carroll recommended adding the extension of the CCPD Sales Tax on the May 2022 Election. He stated the CCPD
Sales Tax was extended for 5 years,with only 2 years left as it would eliminate some police related General Fund expenses.
PUBLIC COMMENTS
Mayor Fleury asked if anyone had registered to speak. Town Governance Officer/Town Secretary Vacek confirmed there were
no speakers for Public Comment.
EXECUTIVE SESSION
23. Executive Session pursuant to the following section of the Texas Government Code Annotated,Chapter 551(Texas
Open Meetings Act)
Mayor Fleury recessed the meeting into Executive Session at 8:46 pm pursuant to Chapter 551,Section 551.074 of the Texas

Mayor Fleury reconvened the meeting into Regular Session at 8:53 pm.

25. Approve Resolution 2021-12 appointing Board Members to the following Boards/Commissions:
a) Animal Shelter Advisory Board
b) Building Standards Commission
c) Crime Control and Prevention District
d) Economic Development Corporation 4B
e) Ethics Commission
f) Parks and Recreation Board
g) Planning and Zoning Commission
h) Tax Increment Reinvestment Zone No.1
1) Zoning Board of Adjustment
Mayor Pro Tern Lamont made a motion to approve Resolution 2021-12 appointing Board Members to A)Animal Shelter Advisory Board,B)
Building Standards Commission, C) Crime Control and Prevention District, D) Economic Development Corporation 4B, E) Ethics Review
Commission,F)Parks and Recreation Board,G)Planning and Zoning Commission,H)Tax Increment Reinvestment Zone No.11)Zoning Board
of Adjustment with all appointments made being denoted within Resolution 2021-12 Exhibits A through I which are part of the official record
of the Town. Council Member Monger seconded the motion. The motion carried as follows:
AYE: Sheridan, Monger,Shoffner, Mayor Pro Tern Lamont, Mayor Fleury
NAY: None
ABSENT:None
Mayor Fleury thanked all 55 applicants and expressed that she is looking forward to working alongside all Committee
Members. She also thanked Mayor Pro Tern Lamont and Council Member Monger who served on the sub-committee with
her and conducted 47 interviews.
ADJOURNMENT
Mayor Fleury adjourned the meeting at 8:58 PM.
