Chairman Hill opened the Regular Session. *REGULAR SESSION 7. PRESENTATION, DISCUSSION. AND APPROPRIATE ACTION RELATIVE TO SIDING SPECIFICATIONS FOR SINGLE FAMILY RESIDENTIAL STRUCTURES. Chairman Hill gave a brief overview of this agenda item, The property owner's ('Winters) at 104 Fairway Village recently replaced their roof and the contractor failed tc pull a permit. The material used for the job was determined to be non-compliant with the Town's roofing ordinance. The Winters contended that the portion of the structure that was redone is in fact a wall and not a roof. The position of the building official, Randy Briggs is that the shingles do violate the roof ordinance, Section 3(A) "installed as a roof covering on any building or struct! The Winters went before the Town Council to seek relief from the ordinance, The Council forwarded the issue to the Commission for a determination of whether or not the material used was an appropriate siding material. The Commission discussed the information presented, The general consensus of the Commissioners was that the structure in question was a wall and not a roof, Karen Mitchell suggested an amendment to the Comprehensive Zoning Ordinance in order to allow for mansard roofs to be handled through criteria specific to that zoning district and that style of house, The Commission concurred with the suggestion, This item will be forwarded to the Town Council at their 15 April 2004 meeting. 8. PRESENTATION, DISCUSSION AND APPROPRIATE ACTION RELATIVE TO A FENCE WAIVER REQUEST TO THE REQUIREMENTS SET FORTH IN TOWN ORDINANCE NO. 2002-42 P&Z, SECTION 3 ENTITLED "FENCES", SUBSECTION "B" ENTITLED "HEIGHT REQUIREMENTS", (1) PERTAINING SPECIFICALLY TO THE HEIGHT OF REAR AND SIDE YARD FENCES, AND SUBSECTION "B" (3) OF THE SAME SECTION, PERTAINING TO THE PLACEMENT OF A SIDE YARD FENCE ADJACENT TO A SIDE STREET, FOR A PROPERTY LOCATED AT 1 GLEN EAGLES COURT, LOT 79 OF THE LAKE FOREST VILLAGE PHASE III ADDITION. Commissioner Sheridan said he did not think the proposal would provide. the Men Eagles Court residents with substantial screening, as was originally intended. The Commission agreed that a dense landscape screen would be needed in order to adequately screen the two adjoining properties (the Church and the Glen Eagles Court residences), Ms. Sanders said she would take the Commission's suggestions back to the Church for their direction and subsequent revision to the landscape proposal, A motion was made to table this item until the Commission is given a revised plan, Motion: Sheridan Second: Stephens Ayes: Hill, Moss, Reed, Rodgers Nays: None Action: 6-0 Motion carried. 10.
