Minutes P&Z 02/20/2003MINUTES OF A PUBLIC HEARING & REGULAR SESSION FOR THE TOWN OF TROPHY CLUB PLANNING AND ZONING COMMISSION 20 FEBRUARY 2003 The Planning and Zoning Commission of the Town of Trophy Club, Texas met in a Public Hearing and a Regular Session on 20 February 2003, at 7:00 pm in the Public Works Conference Room of the Public Works Building, 100 Municipal Drive, Trophy Club, Texas 76262. CALL TO ORDER AND ANNOUNCE A QUORUM. Chairman Hill called the meeting to order at 7:00 pm, and announced a quorum was present. PUBLIC HEARING 2. PLANNING & ZONING COMMISSION TO OPEN PUBLIC HEARING. 3. PLANNING & ZONING COMMISSION TO CONDUCT A PUBLIC HEARING RELATIVE TO THE FOLLOWING: Chairman Hill read the caption into the record, Planning & Zoning Commission Public Hearing & Regular Session Meeting 20 February 2003 A. AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS, REPEALING ORDINANCE NO. 2002-21 P&Z, WHICH AMENDED ORDINANCE 2001-25 P&Z, THE SAME BEING AN ORDINANCE REPEALING ORDINANCE NO. 96-09 OF THE TOWN AND ADOPTING NEW PROVISIONS FOR PD PLANNED DEVELOPMENT NO. 16, A CERTAIN TRACT OF LAND DESCRIBED AS A 23.5361 ACRE TRACT OF LAND AND GENERALLY KNOWN AS THE KNOLL; ADOPTING PROVISIONS TO AMEND EXHIBIT C, DEVELOPMENT STANDARDS AND SINGLE FAMILY HOUSING REGULATIONS, BY CHANGING PARAGRAPH M, UTILITIES, IN ITS ENTIRETY, TO ALTER THE REGULATIONS FOR THE LOCATION AND SCREENING OF ELECTRIC TRANSFORMERS; PROVIDING FOR AN AMENDMENT TO THE OFFICIAL ZONING MAP OF THE TOWN; PROVIDING THAT SUCH TRACT OF LAND SHALL BE USED IN ACCORDANCE WITH THE REQUIREMENTS OF THE COMPREHENSIVE ZONING ORDINANCE AND ALL OTHER APPLICABLE ORDINANCES OF THE TOWN; PROVIDING A CUMULATIVE CLAUSE; PROVIDING FOR SAVINGS; PROVIDING SEVERABILITY; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. (REP -03-014) Mr. Spain addressed the Commission. In response to Commissioner Reed's question from the previous meeting, Mr. Spain will have the Covenants, Codes and Restrictions for the Knoll revised to hold the property owners with the transformer boxes located on their lots responsible for the maintenance of the live screening. At the initial installation of the landscaping, the plants will be hand -watered in conjunction with drip watering, The landscaping will consist of a Dwarf Burford Holly hedge surrounded by Yaupon Holly shrubs, There were no requests to speak from the public. 4. PLANNING & ZONING COMMISSION TO CLOSE PUBLIC HEARING AND/OR CONTINUE TO A DATE CERTAIN. A motion was made to close the public hearing. DISCUSSION AND CONSIDERATION OF APPROPRIATE ACTION RELATIVE TO THE PLANNING & ZONING COMMISSION'S RECOMMENDATION TO THE TOWN COUNCIL REGARDING THE ADOPTION OF THE FOLLOWING: A.
