TOWN COUNCIL AND PLANNING AND ZONING COMMISSION
OCTOBER 15TH, 1990
THE STATE OF TEXAS
COUNTY OF DENTON
The Town Council and Planning and Zoning Commission met in
Joint Session for a Public Hearing on Monday, October 15th,
1990 at 10:00 P.M. The meeting was held at the Municipal
Utility District Building, 100 Municipal Drive, Trophy Club,
Texas. The meeting was held within the Town boundaries and
was open to the Public.

Mayor Carter called the Public Hearing to order at 10:05 P.M.
CONSIDERATION AND TO TAKE ANY NECESSARY ACTION REGARDING THE
APPLICATION OF STEVE TURNER, REPRESENTING INDEPENDENT
AMERICAN DEVELOPMENT CORPORATION PHASE II, FOR A SITE PLAN
FOR AN APPROXIMATELY 2.106 ACRE TRACT OF LAND (TRACT I)
LOCATED ON THE NORTHEAST SIDE OF TROPHY CLUB DRIVE, OPPOSITE
THE INTERSECTION THEREOF WITH MUNICIPAL DRIVE, AT 300 TROPHY
CLUB DRIVE. SAID TRACT COMPRISES A PART OF PLANNED
DEVELOPMENT DISTRICT NO. 9 AND THE APPLICANT IS SEEKING A
"PROFESSIONAL OFFICE" DESIGNATION.
Commissioner Paige made a motion to open the Public Hearing.
Commissioner Williams seconded the motion. Motion carried
unanimously.

Co -Chairman Booker asked if there were any comments from the
Public regarding the Site Plan submitted for this tract of
land. There were no comments made by the public.
Co -Chairman Booker asked Dan Boutwell for a brief report on
the proposed Site Plan. Dan Boutwell, Town Planner, stated
the Site Plan would simply designate a specific use which is
Professional Office. The tract already has existing
structures and improvements in place.
Commissioner Paige made a motion to recommend approval of the
Site Plan designating Professional Office Use at 300 Trophy
Club Drive. Commissioner Morey seconded the motion. Motion
carried unanimously.
Council Member Vance made a motion to accept Planning and
Zoning Commissions recommendation. Council Member Sylvia
seconded the motion. Motion carried unanimously.
CONSIDERATION AND TO TAKE ANY NECESSARY ACTION REGARDING THE
APPLICATION OF SUNBELT SAVINGS, FSB FOR A CHANGE IN ZONING
FROM R-7.5 SINGLE FAMILY RESIDENTIAL DISTRICT TO P.D.,
PLANNED DEVELOPMENT DISTRICT FOR MULTI -FAMILY DEVELOPMENT,
INCLUDING CONDOMINIUMS AND APARTMENT USES ON AN APPROXIMATE
5.3459 ACRE TRACT OF LAND (TRACT 2) LOCATED AT THE NORTHEAST
CORNER OF THE INTERSECTION OF QUORUM DRIVE AND COUNTRY CLUB
DRIVE AND BEING ALL OF TROPHY CLUB QUORUM CONDOMINIUMS, AN
ADDITION TO DENTON COUNTY, TEXAS ACCORDING TO THE PLAT
THEREOF RECORDED IN CABINET "C", SLIDE 358 OF THE PLAT
RECORDS OF DENTON COUNTY, TEXAS.
Co -Chairman Booker asked if there were any comments from the
public regarding the rezoning of this tract of land.
The following residents were opposed to the rezoning request:

Sonja Taber 505 Indian Creek Drive
Co -Chairman Booker asked for Dan Boutwell, Town Planner, to
give a brief report on this rezoning request. Dan Boutwell
stated that Trophy Club has no multi -family zoning district.
The Quorum was zoned as R-7.5 Single Family Residential as a
valid non -conforming use. There are existing multi -family
structures and improvements existing on this tract of land.
The setbacks vary from 1 foot to 8 feet. All future
developments of this type should have a minimum of 20 foot
setbacks. The parking requirements for multi -family require
168 spaces for this site. This Site Plan indicates that only
155 are provided. There are at least 10 dwelling units
located in an area that has been designated as being a
potential flood plain.

Dan Boutwell recommended that no new development of this
tract be allowed. The Site Plan does not designate any
screening of trash dumpsters. The trash dumpsters should be
screened by a fence or wall of at least eight feet in height.
Signage on the site must comply to the sign regulations of
the Town.
Commissioner Williams made a motion to recommend approve of
the rezoning from R-7.5 to P.D. as per Site Plan contingent
upon screening of trash dumpsters and all signage on this
tract must conform to sign regulations of the Town.
Commissioner Morey seconded the motion. Motion carried
unanimously.
Council Member Engelbeck made a motion to continue the Public
Hearing until November 5th, 1990 at 7:00 P.M. Council Member
Hill seconded the motion. Motion carried unanimously.
CONSIDERATION AND TO TAKE ANY NECESSARY ACTION REGARDING THE
APPLICATION OF SUNBELT SAVINGS, FSB FOR A CHANGE IN ZONING
FROM R-7.5 SINGLE FAMILY RESIDENTIAL TO P.D., PLANNED
DEVELOPMENT DISTRICT FOR MULTI -FAMILY DEVELOPMENT, INCLUDING
CONDOMINIUMS AND APARTMENT USES ON AN APPROXIMATELY 4.1824
ACRE TRACT OF LAND (TRACT 3) FRONTING ON THE SOUTH SIDE OF
INDIAN CREEK DRIVE IN THE 300 BLOCK OF INDIAN CREEK DRIVE,
BEING ALL OF TROPHY CLUB INDIAN CREEK TOWNHOMES, AN ADDITION
TO DENTON COUNTY, TEXAS, ACCORDING TO THE PLAT THEREOF
RECORDED IN CABINET "C", SLIDE 357 OF THE PLAT RECORDS OF
DENTON COUNTY, TEXAS.
Co -Chairman Booker asked if there were any comments from the
Public regarding the rezoning of this tract of land.
The following residents were opposed to the rezoning request:

Co -Chairman Booker asked Dan Boutwell, Town Planner, to give

this application requests rezoning from R-7.5 to P.D. The
purpose of this request is solely to bring the existing
development into compliance with the Town of Trophy Club's
zoning ordinance. The properties current use represents a
non -conforming use. The applicant does not propose to
construct or to alter any existing facilities. The Site Plan
does not indicate any screening of the trash dumpster. The
gravel parking area located at the western border of the
property appears to be located partially off-site. Parking
surfaces dedicated for the use of this site must be located
on this site. Also, parking surfaces must be constructed of a

dust free surface (concrete or asphalt).
Commissioner Morey made a motion to recommend approval of the
rezoning request contingent upon the trash dumpsters being
screened with a eight foot fence or wall, the gravel parking
area being paved with concrete and submittal of a revised
site plan. Commissioner Williams seconded the motion. Motion
carried unanimously.
Council Member Vance made a motion to accept Planning and
Zoning Commissions recommendation and include relocating the
sign to be on site. Council Member Engelbeck seconded the
motion. Motion carried unanimously.
CONSIDERATION AND TO TAKE ANY NECESSARY ACTION REGARDING
PROCEDURAL AMENDMENTS TO THE COMPREHENSIVE ZONING ORDINANCE
TO SPECIFY REQUIREMENTS AND PROCEDURES FOR A) SITE PLAN AND
APPROVAL THEREOF APPLICABLE TO THE FOLLOWING ZONING
DISTRICTS: P.D. PLANNED DEVELOPMENT DISTRICT; CG, COMMERCIAL
GENERAL; CR, COMMERCIAL RECREATIONAL; AND GU, GOVERNMENTAL
USE; B) THE GIVING OF PUBLIC NOTICE AND THE HOLDING OF
PUBLIC HEARINGS WITH RESPECT TO AMENDMENTS TO THE
COMPREHENSIVE ZONING ORDINANCE AND THE REGULATIONS AND ZONING
DISTRICT BOUNDARIES THEREIN PROVIDED FOR; AND C) THE
APPOINTMENTS, REMOVAL, OPERATIONS AND CONDUCTING OF BUSINESS
OF THE TOWN'S PLANNING AND ZONING COMMISSION.
Commissioner Morey made a motion to recommend approval of the
procedural amendments to the Comprehensive Zoning Ordinance
to the Town Council. Commissioner Williams seconded the
motion. Motion carried unanimously.
Council Member Vance made a motion to change Page 7.8
Paragraph H to allow the Town Council to appoint the Planning
and Zoning Chairman. Council Member Sylvia seconded the
motion. Motion carried unanimously.
Council Member Vance made a motion to continue the Public
Hearing until November 5th, 1990 to give the Town Attorney a
chance to review these proposed changes. Council Member Hill
seconded the motion. Motion carried unanimously.

ADJOURN
Commissioner Williams made a motion to adjourn the Public
Hearing. Commissioner Paige seconded the motion. Motion
carried unanimously.
