Ms. Huggins: This is a final plat for the first phase of NH 7. There are 114 residential lots and 1 open space on 32 acres. All are lot type 3 lots located in Planned Development No. 27 and the plat complies with PD-27. As noted in the staff report, there are a number of trees on the western end of this phase of this subdivision. A tree survey was done by the applicant and the mitigation does meet the tree ordinance requirements. The applicant is working with the Town to improve drainage along the northern end of the subdivision to preserve the pedestrian trail. That will be done under a separate contract. There are some additional revisions needed to the construction documents and those must be revised and approved by the Town engineer and Town staff prior to placement of this plat on a Council agenda. There is a requirement that a plat must be heard by Council within 30 days of consideration of the Planning and Zoning Commission. If that does not happen, the plat receives automatic approval. Because there are some comments remaining to be addressed on the infrastructure construction documents, we’ve asked the applicant to agree to waive the 30-day requirement in case those documents are not approved by the date that this plat is scheduled to go to Council, which would then delay it to a future Council meeting date possibly beyond the 30-day requirement. The applicant has provided that waiver. Staff recommends approval of this plat. Tom Rutledge: There are some pending construction comments and we’ll get those reviewed prior to Council consideration of this plat. Chairman Hill then called on the Commissioners for comments or discussion. Commissioner Sheridan asked that Trophy Park Drive be identified on the plat. REVIEW AND RECOMMENDATION Gas Well Site 4H This phase of Neighborhood 8 has a number of lots adjacent to a gas well site. The applicant’s engineer has provided an exhibit showing that the distance from wellhead to habitable structure shall be a minimum of 200-ft. To build a habitable structure on a lot adjacent to a gas well, the builder will be required to submit a survey, signed and sealed by a licensed surveyor, verifying the distance from the nearest point of the habitable structure to the nearest wellhead. This has been noted on the plat (Note #8). Concrete Trail – Common Area Amenity with Public Access A 6-ft. concrete trail will be constructed in open space Lot 2X, Block J and shall be owned and maintained by the HOA for Neighborhood 8. The trail will be constructed during the next phase (Phase 2B) of this neighborhood. The trail will move out of the open space at Sheffield Dr. and run along Exeter Drive to (future phase) Nottingham and Annandale Drives to connect with the sidewalks along Trophy Park Drive. The property is zoned Planned Development No. 27 (PD-27) and is located in the area referred to as “Village Center” which allows for such uses as retail, offices, municipal facilities and religious institutions. The architectural and site design standards for Village Center in PD-27 do not apply to religious institutions; therefore, the design and development standards in the Town of Trophy Club Code of Ordinances apply. ANALYSIS Total Land: 7.0441 acres Lot 1 – 6.3702 acres and Lot 2 – 0.6739 acres Primary Structure: 21,857 Square Feet Accessory Structures: 60’x30’x11’ Pavilion 13’x15’x10’7” Storage Building This site consists of two lots. The church building with a traditional steeple and sanctuary, parking lot and accessory structures will be located entirely on Lot 1 and are not adjacent to residential zoned property. Lot 2 will consist of landscaping, irrigation, and a 7-ft. concrete trail which will be dedicated to the Town as public access for Trophy Club residents to walk or bike from Trophy Club Drive to Independence Park East. A decorative wrought iron fence will separate the two lots. The Town will ultimately own and maintain Lot 2, Block 1, Trophy Club Drive Church Addition. PLANNING & ZONING COMMISSION STAFF REPORT July 5, 2012 Site Plan - Lot 1 & 2 Trophy Club Drive Church Addition Planned Development No. 27 Church of Jesus Christ of Latter-Day Saints Planning and Zoning Commission Page 19 of 25 Meeting Date: July 5, 2012 Parking and Paving All entrance drives from Trophy Club Drive and Bobcat Blvd. shall be accented with decorative street treatments – brick pavers or stamped or stained concrete. The applicant has not indicated this on the site plan but a note will be added to the site plan prior to Council review of the plan. Ten (10) percent of the parking area shall have decorative street treatment – brick pavers or stamped or stained concrete. The applicant has not indicated this on the site plan but a note will be added to the site plan prior to Council review of this plan. The parking proposed on the site significantly exceeds the parking requirement per Town regulations. A total of 110 parking spaces are required. The applicant has provided 240 parking spaces, including 8 handicap parking spaces. Photometrics Spill lighting from parking lot lights measure between 0.1 and 0.5 foot-candles at the outside perimeter of the parking lots. The parking lot light poles are 18-ft. in height. All parking lot lighting is fully shielded as required by ordinance and the light measurement at the property line is 0.0 foot-candles. This meets the requirements of the Town’s lighting provisions. Two (2) additional light poles, 20-ft. in height, are on site and direct lighting upwards to illuminate the steeple. The parking lot light poles and steeple light poles do not exceed the Town’s regulations which state that light poles shall not exceed 25-ft. in height. Elevations The church will have a brick exterior. The exterior elevations meet the requirements of the Town’s masonry provisions with the following exception. Steeple: The height of the cupola and steeple exceed the 40-ft. height distance. Top of cupola is at approximately 45-ft., exceeding the maximum by 5-ft. The steeple is at 70-ft., which exceeds the height limit by 35-ft. There is a provision in the ordinance which allows an additional 10 feet in height for things such as this; however, the Commission and Council must approve anything taller than the 10 feet additional height. Also, as noted above, two (2) light poles, 20-ft. in height, direct lighting upwards to illuminate the steeple. Storage Building The architectural elevations for the 13-ft. x 15-ft. storage building are shown on Sheet A701 of the Site Plan package. The storage building will have brick exterior to match the church brick exterior. At a height of 10-ft., 7-inches, the Planning and Zoning Commission Page 20 of 25 Meeting Date: July 5, 2012 building exceeds the maximum height allowance of 8-ft. for a storage facility. Within the parameters of a Planned Development this type of adjustment to the regulations may be made. Pavilion The applicant plans to build a 60-ft. x 30-ft. pavilion at the southern end of Lot 1 as noted on the site plan. The pavilion is 11-ft. in height which meets the Town’s regulations of a 20-ft. maximum height for this type of use. The pavilion will have a full pitched shingle roof. The applicant plans to construction the pavilion using steel poles. The Town’s regulations require wood poles but aluminum poles may be used if the poles have a wood grain (look) finish. Staff believes steel poles would be a good choice to provide structural integrity to the facility. The “look” of the poles, however, is at the discretion of the Planning and Zoning Commission and Town Council. This type of adjustment to the regulations may be made within the parameters of a Planned Development. Fencing A 6-ft. wrought iron fence with concrete mow strip will be placed on the property line between Lots 1 and 2 of the site. The fence will be owned and maintained by the church. Monument Sign The site plan indicates one monument sign measuring approximately 43-square feet in size. The Town’s Sign Regulations permit one monument sign not to exceed 50-square feet. The sign is lit by an external ground light. The Town’s sign ordinance requires that external lighting shall be down-lighted and shall not be seen from the property line of the site on which the sign is located. The light cast from the source may be visible at the property line of an abutting residential property, but any spillover light cannot exceed 0.02 foot-candle of luminance. The light shines upward at the monument sign and will be visible from the property line of the site. The proposed light is shown on Sheet SD307 of the Site Plan package. The Planning and Zoning Commission and Town Council may make this type of adjustment to the regulations within the parameters of a Planned Development. Dumpster The dumpster enclosure will be located next to the storage building on the northwest corner of the site. Three sides will be masonry (brick) to match the primary structure. The fourth side will have a metal gate. The details are shown on Sheet SD308 of the Site Plan package. Planning and Zoning Commission Page 21 of 25 Meeting Date: July 5, 2012 Tree Preservation There are 144 trees on this site, all of which will be removed. Seven (7) are protected trees: six (6) Elm and one (1) Oak, for a total of 85 caliper inches of protected trees to be removed. Prior to removal of these trees a Tree Removal Permit must be obtained. The applicant must mitigate 1.5 caliper inches per 1” removed for a total of 128 caliper inches required to be replaced on the site. The applicant is proposing to plant 379 caliper inches in replacement of the protected trees lost. The landscape regulations require trees to be planted along the frontage of major streets, one for each 30 linear feet. Thus, this site requires 20 trees planted along Trophy Club Drive and 16 trees planted along Bobcat Blvd. The proposed landscape plan provides for a total of approximately 21 trees to be planted along the roadways of Bobcat Blvd and Trophy Club Drive. The pattern of planting is in clustered form similar to what occurs naturally rather than linear. Interior Landscaping In accordance with the Town’s requirements, a minimum of 10% of the gross parking areas shall be devoted to living landscaping which includes grass, ground cover, plants, shrubs and trees. Additionally, the ordinance provides that one (1) tree is to be planted for each 400 square feet or fraction thereof of required interior landscape area. The applicant is providing 34 trees, from the approved Tree Planting & Replacement List, to be planted within the parking areas. This exceeds the 29 trees required by ordinance. Lot 2 Landscaping Landscaping located on Lot 2 consist of the perimeter landscaping, which has a combination of Yaupoun Holly trees, Oak trees, and multiple shrubs. The nearest edge of a parking surface is located on Lot 1 and is approximately 160 feet from the Lot 2 south property line. Additional landscaping is provided around the parking area on Lot 1. Entire Site – Landscaping Overall, the proposed landscape plan provides for extensive landscaping of approximately 62% of the site, which significantly exceeds the Town’s requirement of 15%. A substantial portion of the landscaping is proposed for yard areas along Bobcat Blvd and Trophy Club Drive. In addition, 95 trees of 3 to 4 inch caliper and 23 two-inch caliper trees are proposed for the site. With the additional shrubs, flowering plants, and turf, staff feels this more than mitigates the shortfall of trees proposed along the roadways. Within the parameters of a Planned Development, this type of adjustment to the regulations may be made. Planning and Zoning Commission Page 22 of 25 Meeting Date: July 5, 2012 SUMMARY In certain instances, the purposes of the zoning ordinance may be achieved by the development of planned units which do not conform in all respects with the land use pattern designated on the Zoning Map or the district regulations prescribed by the Town’s ordinances or the Subdivision Regulations. A planned development (PD) may include amenities which creatively complement each other and provide for variety and flexibility in the development of the site which promote the health, safety, and general welfare of the community. The Town Council is empowered to grant permits for planned developments after review and recommendation by the Planning and Zoning Commission. The Church of Jesus Christ of Latter-Day Saints is asking for consideration of the following: • A steeple, 70-ft. in height (35-ft. in height allowed) • A storage building, 10-ft., 7-inches in height (8-ft. allowed) • A pavilion with steel poles with a wood grain finish • An upward facing ground light for the monument sign • A shortfall of trees along the roadways The amenities that the Church is providing to the Town: • Landscaping of 62% of the site which significantly exceeds the required 15% landscaping requirement • 29,354 sq. ft. (0.6739 acres) of land dedicated to the Town to provide public access from Trophy Club Drive to Independence Park East • Landscaping, irrigation and a 7-ft. concrete walkway on Lot 2, Block 1 A recommendation of approval grants the above considerations and amenities.
