The Town Council of the Town of Trophy Club, Texas, met in a Regular Session on Tuesday, September 24, 2019.
The meeting was held within the boundaries of the Town and was open to the public.

Mayor Sanders announced the date of September 24, 2019, called the Town Council to order and announced a
quorum at 7:00 p.m.
The Invocation was offered by Senior Pastor Barry Clingan with The Church at Trophy Lakes.
The Pledges to the American Flag and Texas Flag were led by Council Member Geraci.
CITIZEN PRESENTATIONS
This is an opportunity for citizens to address the Council on any matter whether or not it is posted on the agenda.
The Council is not permitted to take action on or discuss any presentations made to the Council at this time
concerning an item not listed on the agenda. The Council will hear presentations on specific agenda items prior to
the Council addressing those items. You may speak up to four (4) minutes or the time limit determined by the
Mayor or presiding officer. To speak during this item, you must complete the Speaker's form that includes the
topic(s)of your statement. Topics of presentation should be limited to matters over which the Council has authority.
Brock Harwell, 55 Sonora Drive, spoke of a plumbing issue he has had since May 2019 that involved a backed up
sewer line. He had contacted a plumber to repair the issue and the plumber explained that the issue was on the
Town's side. Then he spoke with Mr. Carman with the Trophy Club Municipal Utility District (TCMUD) No. 1 to
repair the issue. The TCMUD No. 1 investigated the issue and reported the responsibility was theirs as the
homeowner although it was in the easement. It was unclear to him how this would be his responsibility and stated
that he experienced a previous issue a few years ago underneath his driveway with the main waterline.
Vicki Harwell, 55 Sonora Drive, commented that the current issue was not far over from the previous issue they
experienced under their driveway. She received a copy of the TCMUD No 1 bylaws that stated it was the
homeowner's responsibility to repair the plumbing up to where the pipe connected to the TCMUD's No. 1 main
waterline. It did not seem justifiable for them to be responsible for a portion of the pipe that was under the street.
Mayor Sanders remarked that he spoke with Mr. and Mrs. Harwell before the meeting and explained that their
concern should be addressed with the TCMUD No. 1 Board of Directors.
ANNOUNCEMENTS AND REPORTS
1. Receive Interim Town Manager Carroll's Update and provide input regarding the following(W.Carroll):
• Community Night—Scheduled for Saturday, October 5, 2019, from 6:00 p.m. to 10:00 p.m. at Harmony
Park. The event would include children's activities, backyard games, and a Halloween themed movie.
• Homecoming Parade—Byron Nelson High School would be hosting their annual homecoming parade on
Wednesday, October 2, 2019, beginning at 6:15 p.m. The Trophy Club Police Department will be
protecting pedestrians and directing traffic for the event, with pedestrians allowed to gather on the
Trophy Club Drive median to enjoy the parade festivities. The north and south bound traffic lanes will be
open on Trophy Club Drive. The parade route was available on the Town's website.
• Fall Community Garage Sale —The Trophy Club Women's Club was holding their annual Fall Community
Garage Sale on Saturday, October 5, 2019, from 8:00 a.m. to 2:00 p.m. Permits were available at the
Sassy Flamingo. Any unsold items could be brought to donation trucks in the Tom Thumb parking lot after
2:00 p.m.,excluding furniture and appliances.
• Excellence of Achievement Award — Interim Fire Chief Cochran announced that the Trophy Club Fire
Marshal's Office was given the Excellence of Achievement Award through the Texas Fire Marshal's
Association that included eight different categories and subcategories. This award was accomplished
through the hard work of Anita Otterson, who diligently worked on the collection of the required data.
The Fire Department will be accepting this award on October 24, 2019 at the State Fire Marshal's
Conference in Austin,Texas.
CONSENT AGENDA
All matters listed as Consent Agenda are considered to be routine by the Town Council and will be enacted by one
motion. There will not be a separate discussion of these items. If discussion is desired, that item will be removed
from the consent agenda and will be considered separately.
2. Consider and take appropriate action regarding the Town Council Regular Session Minutes dated September
10,2019(W.Carroll).
3. Consider and take appropriate action regarding the Town Council Special Session Minutes dated September
18,2019(W.Carroll).
4. Consider and take appropriate action regarding the financial and variance report dated July 2019 (W.
Carroll).
5. Consider and take appropriate action regarding an Ordinance of the Town Council of the Town of Trophy
Club accepting and approving an Update of the Service and Assessment Plan and an Updated Assessment
Roll for the Town of Trophy Club Public Improvement District No. 1(Authorized Improvements Assessment);
making and adopting findings; accepting and approving the annual Service Plan Update and Updated
Assessment Roll;and providing an effective date(W.Carroll).

6. Consider and take appropriate action regarding an Ordinance of the Town amending Appendix A, Fee
Schedule,to establish fees and rates for water and wastewater services to customers within the boundaries
of Trophy Club Public Improvement District(PID) No. 1; providing that Trophy Club Municipal Utility District
No. 1 Services Rules and Policies are applicable to customers within the PID No. 1; and providing a penalty
and effective date(W.Carroll).
7. Case TUP-19-003(Medlin Construction Trailer)
Consider and take appropriate action regarding a request for a Temporary Use Permit to allow a
construction trailer at Medlin Middle School, generally located west of Parkview Drive and south of
Marshall Creek Road(W.Carroll).
Motion:
Motion made by Mayor Pro Tem Jensen, seconded by Council Member Bone, to approve Consent Agenda Items
No.2 through No. 7.
Motion carried unanimously 6-0-0.
PUBLIC HEARING
8. Conduct a Public Hearing relative to the Service and Assessment Plan for Authorized Services (Emergency
Services) for the Trophy Club Public Improvement District No. 1 (The Highlands at Trophy Club), the
proposed Assessment Roll, and the levy of Special Assessments against the property in PID No. 1 and
matters contained in the proposed Ordinance(W.Carroll).
Mayor Sanders opened the public hearing at 7:13 p.m.
There was no one present that wished to speak on this item.
Mayor Sanders closed the public hearing and reconvened into Regular Session at 7:14 p.m.
REGULAR SESSION
9. Ceremonial Oath of Office and presentation of Certificate of Election to Karl Monger,Council Member Place 4
(W. Carroll).
Presiding Municipal Court Judge Ransleben administered the ceremonial Oath of Office to Karl Monger, elected to
Council Member Place 4.
Mayor Sanders presented the Certificate of Election to Council Member Monger.
Council Member Monger stated it was an honor and privilege to be of service to the community. He thanked his
wife,Sara,for her help and encouragement throughout his campaign. Throughout the election cycle he wanted to
convey a theme that reflected the big three: "Do what is right", "Do the best you can", and "Treat others as you
would like to be treated".
Mayor Sanders welcomed Council Member Monger and thanked him for his willingness to volunteer and serve on
Town Council.
Council Member Fleury thanked Council Member Monger for serving the Town and she felt that he would be a
great addition.

10. Case SP-AMD-19-002(Church at Trophy Lakes Shade Structure)
Consider and take appropriate action regarding a request to amend the site plan at The Church at Trophy
Lakes,generally located west of Trophy Club Drive and north of Village Trail(W.Carroll).
Town Planner Payne stated that the purpose of this item was to consider an amended site plan for The Church at
Trophy Lakes. The strategic link was Nature and Beautification - Maintain Town assets, services, and codes of
ordinances that preserve the natural beauty of the Town. The Church at Trophy Lakes requested to amend their
site plan in order to allow for a shade structures over the existing playground. The two structures would be 25 feet
by 25 feet and 12 feet in height with blue shade covers and white posts. The playground was more than 200 feet
away from Trophy Club Drive and Village Trail. The Planning and Zoning Commission considered this item at their
September 5, 2019 meeting and unanimously recommended approval of the amended site plan as submitted.
Additionally,Staff recommended approval of the amended site plan.
Senior Pastor Clingan with The Church at Trophy Lakes was present to address any questions.
Motion:
Motion made by Mayor Pro Tern Jensen, seconded by Council Member Bone, to approve Case SP-AMD-19-002
(Church at Trophy Lakes Shade Structure), a request to amend the site plan at The Church at Trophy Lakes,
generally located west of Trophy Club Drive and north of Village Trail.
Council Member Shoffner inquired if there had been complaints received regarding the blue color shade structures
at Harmony Park.
Council Member Fleury commented that there were previous discussions to move forward with more natural
colors of tan and green at the parks and to stay with the blue color for the pool structures.
Mayor Sanders believed that prior complaints were due to the different color schemes throughout Town.
Interim Town Manager Carroll confirmed that the majority of the complaints were due to different color schemes
throughout Town and there had been a need for color consistency.
The vote was taken.

11. Consider and take appropriate action regarding an Ordinance of the Town of Trophy Club accepting and
approving a Service and Assessment Plan for Authorized Services for the Town of Trophy Club Public
Improvement District No. 1(Emergency Services)and an Assessment Roll for the Town of Trophy Club Public
Improvement District No. 1 (The Highlands at Trophy Club); making a finding of special benefit to the
Property in the District; levying special assessments against Property within the District; providing for
payment of the assessments in accordance with law;and providing an effective date(W.Carroll).
Motion:
Motion made by Mayor Pro Tem Jensen, seconded by Council Member Bone, to approve Ordinance No. 2019-21,
accepting and approving a Service and Assessment Plan for Authorized Services for the Town of Trophy Club Public
Improvement District No. 1 (Emergency Services) and an Assessment Roll for the Town of Trophy Club Public
Improvement District No. 1 (The Highlands at Trophy Club); making a finding of special benefit to the Property in
the District; levying special assessments against Property within the District; providing for payment of the
assessments in accordance with law;and providing an effective date of September 24, 2019.
Mayor Sanders clarified that this item was the annual assessment for fire protection services for citizens that
resided in the Public Improvement District(PID).

Council Member Shoffner inquired if there had been any questions received regarding this item since there was a
mail out that was sent to citizens within the PID. Interim Town Manager Carroll responded that he received one
question and the rest was positive feedback specific to the new mailer.
Council Member Shoffner thanked Staff for creating an insert to go with the required mailed notice because it was
an easier document to understand.
The vote was taken.

12. Consider and take appropriate action regarding an Ordinance of the Town of Trophy Club, Texas adopting
and approving the budget for the fiscal year beginning October 1, 2019 and ending September 30,2020,for
Trophy Club Economic Development Corporation 4B; making appropriations; providing for expenditures as
allowed by applicable law;and providing an effective date(W.Carroll).

Motion made by Mayor Pro Tern Jensen, seconded by Council Member Monger, to approve Ordinance No. 2019-
22, adopting and approving the budget for the fiscal year beginning October 1, 2019 and ending September 30,
2020, for Trophy Club Economic Development Corporation 4B; making appropriations; providing for expenditures
as allowed by applicable law; and providing an effective date of September 24, 2019.

13. Consider and take appropriate action regarding an Ordinance of the Town of Trophy Club, Texas adopting
and approving the Budget for the fiscal year beginning October 1,2019 and ending September 30,2020,for
the Town of Trophy Club; making appropriations; providing for expenditures as allowed by applicable law;
providing for filing of documents; repealing conflicting ordinances; and providing an effective date (W.
Carroll).

increased by the adoption of a tax rate of $0.446442 per $100 valuation and approve Ordinance No. 2019-24,
fixing and levying Municipal Ad Valorem Taxes for the Town for the fiscal year beginning October 1, 2019 and
ending September 30, 2020; directing the assessment thereof; and providing an effective date of September 24,
2019.
Mayor Sanders clarified that the motion on the floor did not increase the tax rate but State law required that the
motion state that taxes were increased because the Town would realize additional revenue from taxes.

16. Discussion of items for Future Agendas to include agenda items for consideration on the October 8, 2019
Council agenda and items from the Town Council Future Agenda Items list(W.Carroll).
This item allows Council to request the placement of items on upcoming agendas when the topic of discussion
requires research and review that cannot be accomplished in the time frame between regular Council meetings.
However, a Council Member may request that an item be placed on the next regularly scheduled meeting without
first placing that item on the Future Agenda Items list. All requests for agenda items must comply with Charter
requirements.
There were no additions or changes to the October 8, 2019 Council agenda or the Town Council Future Agenda
Items list.

19. Consider and take appropriate action regarding a Resolution of the Town Council nominating one candidate
for each of the five positions to be filled on the Denton Central Appraisal District Board of Directors; and
providing an effective date(Mayor Sanders).

Motion made by Mayor Pro Tern Jensen, seconded by Council Member Bone, to approve Resolution No. 2019-33,
nominating Danny Mayer to serve on the Denton Central Appraisal District Board of Directors; and providing an
effective date of September 24,2019.
Motion passed unanimously 7-0-0.
20. Consider and take appropriate action regarding the Executive Session(W.Carroll).
Motion:
Motion made by Council Member Shoffner, seconded by Council Member Bone, to approve the contract as
discussed in Executive Session for Steve Norwood as the new Town Manager.
Council Member Fleury stated that a few weeks ago she had been instructed to only speak on talking points
supplied by a public relations firm that the Town hired regarding the new Town Manager hire. She did not believe
it would be right to change her vote tonight to show unity. Her approach was that it was not her obligation to
provide a person with a third or fourth chance and it was not her obligation to help provide personal favors. This
was a position for the Town using citizen tax dollars. She stated that Trophy Club was still a party to an open and
ongoing FBI investigation; there have been resignations of council members; two special elections; and a
settlement with the previous Town Manager. Additionally, she remarked that she believed that there were other
viable candidates that had been interviewed.
Council Member Monger remarked that he had concerns since he was not on Council through the entire process of
interviewing candidates, but he respected the process. He had asked some tough questions during tonight's
Executive Session and he was provided with answers. He believed that the contract was poor in terms of giving
too much to the candidate, but they were in a place where the Town needed to move forward; therefore the
candidate had his support.

Mayor Sanders stated he would vote in favor of the contract. The Town found themselves in a difficult position to
fill the Town Manager position. They received 35 applications with approximately seven of those being ruled out
due to lack of qualifications. The Council reviewed the remaining applications, resumes,and references in order to
narrow the list to about seven candidates. Then the Council discussed who they wished to interview from that
pool and reduced it to three candidates. All three candidates were the best qualified for the Town of Trophy Club.
It became clear to him that they needed to hire someone who had the most municipal leadership experience as
the Town could afford because salaries and benefits have risen significantly over the last couple of years for Town
Manager positions in North Texas. It was time to move forward and support the candidate. The Charter gave the
authority to the Council to hire and terminate the Town Manager position. He thanked Wade Carroll for serving as
the Interim Town Manager during this transition period and recognized Mr. Carroll for his professionalism and
dedication.
The vote was taken.
Motion carried 6-1-0,with Mayor Sanders,Mayor Pro Tern Jensen,and Council Members Bone,Monger,Geraci,
and Shoffner voting in favor,and with Council Member Fleury voting against.
