The Town Council of the Town of Trophy Club, Texas, met in a Regular Session on Tuesday, September 24, 2019.
The meeting was held within the boundaries of the Town and was open to the public.

Mayor Sanders announced the date of September 24, 2019, called the Town Council to order and announced a
quorum at 7:00 p.m.
The Invocation was offered by Senior Pastor Barry Clingan with The Church at Trophy Lakes.
The Pledges to the American Flag and Texas Flag were led by Council Member Geraci.
CITIZEN PRESENTATIONS
This is an opportunity for citizens to address the Council on any matter whether or not it is posted on the agenda.
The Council is not permitted to take action on or discuss any presentations made to the Council at this time
concerning an item not listed on the agenda. The Council will hear presentations on specific agenda items prior to
the Council addressing those items. You may speak up to four (4) minutes or the time limit determined by the
Mayor or presiding officer. To speak during this item, you must complete the Speaker's form that includes the
topic(s) of your statement. Topics of presentation should be limited to matters over which the Council has authority.
Brock Harwell, 55 Sonora Drive, spoke of a plumbing issue he has had since May 2019 that involved a backed up
sewer line. He had contacted a plumber to repair the issue and the plumber explained that the issue was on the
Town’s side. Then he spoke with Mr. Carman with the Trophy Club Municipal Utility District (TCMUD) No. 1 to
repair the issue. The TCMUD No. 1 investigated the issue and reported the responsibility was theirs as the
homeowner although it was in the easement. It was unclear to him how this would be his responsibility and stated
that he experienced a previous issue a few years ago underneath his driveway with the main waterline.

Vicki Harwell, 55 Sonora Drive, commented that the current issue was not far over from the previous issue they
experienced under their driveway. She received a copy of the TCMUD No 1 bylaws that stated it was the
homeowner’s responsibility to repair the plumbing up to where the pipe connected to the TCMUD’s No. 1 main
waterline. It did not seem justifiable for them to be responsible for a portion of the pipe that was under the street.
Mayor Sanders remarked that he spoke with Mr. and Mrs. Harwell before the meeting and explained that their
concern should be addressed with the TCMUD No. 1 Board of Directors.
ANNOUNCEMENTS AND REPORTS
1. Receive Interim Town Manager Carroll’s Update and provide input regarding the following (W. Carroll):
Community Night – Scheduled for Saturday, October 5, 2019, from 6:00 p.m. to 10:00 p.m. at Harmony
Park. The event would include children’s activities, backyard games, and a Halloween themed movie.
Homecoming Parade – Byron Nelson High School would be hosting their annual homecoming parade on
Wednesday, October 2, 2019, beginning at 6:15 p.m. The Trophy Club Police Department will be
protecting pedestrians and directing traffic for the event, with pedestrians allowed to gather on the
Trophy Club Drive median to enjoy the parade festivities. The north and south bound traffic lanes will be
open on Trophy Club Drive. The parade route was available on the Town’s website.
Fall Community Garage Sale – The Trophy Club Women’s Club was holding their annual Fall Community
Garage Sale on Saturday, October 5, 2019, from 8:00 a.m. to 2:00 p.m. Permits were available at the
Sassy Flamingo. Any unsold items could be brought to donation trucks in the Tom Thumb parking lot after
2:00 p.m., excluding furniture and appliances.
Excellence of Achievement Award – Interim Fire Chief Cochran announced that the Trophy Club Fire
Marshal’s Office was given the Excellence of Achievement Award through the Texas Fire Marshal’s
Association that included eight different categories and subcategories. This award was accomplished
through the hard work of Anita Otterson, who diligently worked on the collection of the required data.
The Fire Department will be accepting this award on October 24, 2019 at the State Fire Marshal’s
Conference in Austin, Texas.

No. 1 Services Rules and Policies are applicable to customers within the PID No. 1; and providing a penalty
and effective date (W. Carroll).
7. Case TUP-19-003 (Medlin Construction Trailer)
Consider and take appropriate action regarding a request for a Temporary Use Permit to allow a
construction trailer at Medlin Middle School, generally located west of Parkview Drive and south of
Marshall Creek Road (W. Carroll).

Motion made by Mayor Pro Tem Jensen, seconded by Council Member Bone, to approve Consent Agenda Items

PUBLIC HEARING
8. Conduct a Public Hearing relative to the Service and Assessment Plan for Authorized Services (Emergency
Services) for the Trophy Club Public Improvement District No. 1 (The Highlands at Trophy Club), the
proposed Assessment Roll, and the levy of Special Assessments against the property in PID No. 1 and
matters contained in the proposed Ordinance (W. Carroll).
Mayor Sanders opened the public hearing at 7:13 p.m.

Mayor Sanders closed the public hearing and reconvened into Regular Session at 7:14 p.m.
REGULAR SESSION
9. Ceremonial Oath of Office and presentation of Certificate of Election to Karl Monger, Council Member Place 4
(W. Carroll).
Presiding Municipal Court Judge Ransleben administered the ceremonial Oath of Office to Karl Monger, elected to
Council Member Place 4.
Mayor Sanders presented the Certificate of Election to Council Member Monger.
Council Member Monger stated it was an honor and privilege to be of service to the community. He thanked his
wife, Sara, for her help and encouragement throughout his campaign. Throughout the election cycle he wanted to
convey a theme that reflected the big three: “Do what is right”, “Do the best you can”, and “Treat others as you
would like to be treated”.
Mayor Sanders welcomed Council Member Monger and thanked him for his willingness to volunteer and serve on
Town Council.
Council Member Fleury thanked Council Member Monger for serving the Town and she felt that he would be a
great addition.

10. Case SP-AMD-19-002 (Church at Trophy Lakes Shade Structure)
Consider and take appropriate action regarding a request to amend the site plan at The Church at Trophy
Lakes, generally located west of Trophy Club Drive and north of Village Trail (W. Carroll).
Town Planner Payne stated that the purpose of this item was to consider an amended site plan for The Church at
Trophy Lakes. The strategic link was Nature and Beautification - Maintain Town assets, services, and codes of
ordinances that preserve the natural beauty of the Town. The Church at Trophy Lakes requested to amend their
site plan in order to allow for a shade structures over the existing playground. The two structures would be 25 feet
by 25 feet and 12 feet in height with blue shade covers and white posts. The playground was more than 200 feet
away from Trophy Club Drive and Village Trail. The Planning and Zoning Commission considered this item at their
September 5, 2019 meeting and unanimously recommended approval of the amended site plan as submitted.
Additionally, Staff recommended approval of the amended site plan.
Senior Pastor Clingan with The Church at Trophy Lakes was present to address any questions.

(Church at Trophy Lakes Shade Structure), a request to amend the site plan at The Church at Trophy Lakes,
generally located west of Trophy Club Drive and north of Village Trail.
Council Member Shoffner inquired if there had been complaints received regarding the blue color shade structures
at Harmony Park.
Council Member Fleury commented that there were previous discussions to move forward with more natural
colors of tan and green at the parks and to stay with the blue color for the pool structures.
Mayor Sanders believed that prior complaints were due to the different color schemes throughout Town.
Interim Town Manager Carroll confirmed that the majority of the complaints were due to different color schemes
throughout Town and there had been a need for color consistency.

mail out that was sent to citizens within the PID. Interim Town Manager Carroll responded that he received one

an easier document to understand.

Motion:
Motion made by Council Member Shoffner, seconded by Council Member Bone, to approve the contract as
discussed in Executive Session for Steve Norwood as the new Town Manager.
Council Member Fleury stated that a few weeks ago she had been instructed to only speak on talking points
supplied by a public relations firm that the Town hired regarding the new Town Manager hire. She did not believe
it would be right to change her vote tonight to show unity. Her approach was that it was not her obligation to
provide a person with a third or fourth chance and it was not her obligation to help provide personal favors. This
was a position for the Town using citizen tax dollars. She stated that Trophy Club was still a party to an open and
ongoing FBI investigation; there have been resignations of council members; two special elections; and a
settlement with the previous Town Manager. Additionally, she remarked that she believed that there were other
viable candidates that had been interviewed.
Council Member Monger remarked that he had concerns since he was not on Council through the entire process of
interviewing candidates, but he respected the process. He had asked some tough questions during tonight’s
Executive Session and he was provided with answers. He believed that the contract was poor in terms of giving
too much to the candidate, but they were in a place where the Town needed to move forward; therefore the
candidate had his support.

Mayor Sanders stated he would vote in favor of the contract. The Town found themselves in a difficult position to
fill the Town Manager position. They received 35 applications with approximately seven of those being ruled out
due to lack of qualifications. The Council reviewed the remaining applications, resumes, and references in order to
narrow the list to about seven candidates. Then the Council discussed who they wished to interview from that
pool and reduced it to three candidates. All three candidates were the best qualified for the Town of Trophy Club.
It became clear to him that they needed to hire someone who had the most municipal leadership experience as
the Town could afford because salaries and benefits have risen significantly over the last couple of years for Town
Manager positions in North Texas. It was time to move forward and support the candidate. The Charter gave the
authority to the Council to hire and terminate the Town Manager position. He thanked Wade Carroll for serving as
the Interim Town Manager during this transition period and recognized Mr. Carroll for his professionalism and
dedication.
The vote was taken.
Motion carried 6-1-0, with Mayor Sanders, Mayor Pro Tem Jensen, and Council Members Bone, Monger, Geraci,
and Shoffner voting in favor, and with Council Member Fleury voting against.

Background and Explanation:
Section 54.016 of the Texas Water Code requires the Trophy Club Municipal Utility District No.
1 (MUD) to obtain the written consent of the Town of Trophy Club prior to the annexation of
property into the MUD’s boundaries.
The property being considered for annexation by the MUD is 56 Meadowbrook Lane, which is
the former Venable property. The unplatted tract is approximately one acre and is located
within Town limits. The new landowner, McJunkin Signature Homes, LLC has submitted a
preliminary plat and a final plat for the property creating two single family half-acre lots which
will be presented to the Planning & Zoning Commission and Town Council in the coming weeks.
McJunkin is petitioning to Town Council to provide written consent for annexation into the
MUD boundaries so that firefighting services, water services, and sewer services may be
provided to the property. Currently, the property relies on none of these services because it
existed long before the Town did and used a well and a septic tank. It was not included in any of
the platted subdivisions or utility agreements from the 1970’s or 1980’s.

Not applicable.The costs to provide services to the subject property are incurred by the MUD
and the property owner.

described in Exhibit “A”,(hereinafter the “Property’) a copy of which is attached
hereto and incorporated herein, have filed a petition tothe Town of Trophy Club
seeking the written consent of the Town Councilto the annexation of the
Property into the boundaries of Trophy Club MunicipalUtility District No. 1
(hereinafter “MUD1”), a copy of the Landowner’s petition is attached hereto and
incorporated herein asExhibit “B”; and
WHEREAS,because the Property is located within the Town’s corporate
limits, Section 54.016 of the Texas Water Code requiresthat MUD1obtain the
written consent of the Town prior to the annexation of the Property into MUD1;
and
WHEREAS,a necessity exists and MUD1will provide firefighting services
to the Property; and
WHEREAS,a necessity exists and MUD1 will provide for the construction,
extension, improvement, maintenance, and operation of water and sewer
services to the Property; and
WHEREAS,the Town Council of the Town of Trophy Club determines it
appropriate to adopt this Resolution authorizing consent to the inclusion of the
Property into MUD1.

NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF
THE TOWN OF TROPHY CLUB, TEXAS:
Section 1.That the matters set forth in the preamble hereof are true
and correctandare hereby adopted.
Section2.That the Town Council of the Town of Trophy Club hereby
finds that the Landowner has complied with all legal requirements to request
consent to annexation of the Property and hereby specifically gives its written
consent, as required by Section 54.016 of the Texas Water Code, to the inclusion
of the Property identified inExhibit “A”,withinMUD1 as requested in the
Landowner’s Petition, Exhibit “B”.
Section3. This Resolution shall become effective from and after its
date of passage in accordance with law.

A PROCLAMATION OF THE TOWN COUNCIL OF THE TOWN OF TROPHY
CLUB, TEXAS, SUPPORTING OCTOBER 2019 AS BULLYING PREVENTION
AWARENESS MONTHIN TROPHY CLUB; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS,bullying is the repeated physical, verbal, sexual, and/or emotional harm or
intimidation intentionally directed at a person or group of people; and
WHEREAS,bullying occurs in neighborhoods, playgrounds, schools, and through
technology, such as the Internetand cell phones; and
WHEREAS,bullying is the most common form of violence, affecting millions of U.S.
children and adolescents with28% of students in grades 6–12 having experienced bullying,
approximately 30% of studentsadmittingto bullying others and70.6% of young people say they
have seen bullying in their schools; and
WHEREAS,children who bully are at greater risk of engaging in more serious violent
behaviors; and children who witness bullying often feel less secure, more fearful, and intimated;
and
WHEREAS, researchers and child psychologists believe educating our children while
they are young, helps them to copewith adversity, trauma, tragedy, threats, andsignificant
sources of stress; and
WHEREAS, more than 55% of bullying situations stopwithin 10 seconds when a peer
intervenes and school-based bullying prevention programs decrease bullying by up to 25%; and
WHEREAS, studies show adults can help prevent bullying by talking about bullying,
modeling kindness and respect, and encouraging children to get help when theyand/or others
are involved in bullying.
NOW, THEREFORE, I, MAYOR C. NICK SANDERS, IN CONJUNCTION WITH THE
TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS, DO HEREBY PROCLAIM:
OCTOBER 2019 AS BULLYING PREVENTION AWARENESS MONTH

A PROCLAMATION OF THE TOWN COUNCIL OF THE TOWN OF
TROPHY CLUB, TEXAS, SUPPORTINGOCTOBER 2019 AS BREAST
CANCER AWARENESS MONTH IN TROPHY CLUB; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS,breast cancer isthe most common cancer among women in the
United States accounting for 30% of newly diagnosed cancers; and
WHEREAS,in 2019, about 268,600new cases of invasive breast cancer will be
diagnosed in women and 2,670 cases will be diagnosed in men in the United States;
and
WHEREAS,every 2 minutes, one case of breast cancer is diagnosed in a
woman in the United Statesand one in 8 women will be diagnosed with breast cancer in
her lifetime; and
WHEREAS,mammography, an “x-ray of the breast,” is recognized as the single
most effective method of detecting breast changes long before physical symptoms can
be seen or felt. Early detection and improved treatment is believed to have significantly
reduced the number of deaths caused by breast cancer; and
WHEREAS,researchers, scientists, and numerous nonprofit organizations, are
dedicated to discovering the cure for breast cancer. During the month of October, we
acknowledge the extraordinary commitment and effort invested in this cause; and
WHEREAS,we recognize that over two and a half million Americans are breast
cancer survivors that give us hope of a better future.
NOW, THEREFORE, I,MAYOR C. NICK SANDERS, IN CONJUNCTION WITH
THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS, DO HEREBY

TROPHY CLUB, TEXAS, SUPPORTING OCTOBER 2019 AS
NATIONAL DOMESTIC VIOLENCE AWARENESS MONTH IN TROPHY
CLUB; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,for the past thirty-nineyears, Denton County Friends of the Family
has provided compassionate, comprehensive services those impacted by rape, sexual
abuse, and domestic violence in the Denton community while partnering with the
community to promote safety, hope, healing, justice, and prevention; and
WHEREAS,by working together, shelters, affiliated programs, municipalities, and
concerned individuals can change social attitudes about, and the response to, intimate
partner violence; and
WHEREAS,all persons have the right to live without fear, abuse, or oppression;
and
WHEREAS,one in three Texans will experience domestic violence in their
lifetimes; and
WHEREAS,Denton County Friends of theFamily received 2,974crisis calls from
victims of domestic violence and provided 9,412days of emergency shelter to women
and children in the past year; and
WHEREAS,the Denton County Friends of the Family individuals and groups with
over 34,013hours of services through counseling, advocacy, case management and
support services; and
WHEREAS,domestic violence is not confined to any specific group or people,
but affects people of all races, backgrounds, economic levels, education levels, family
structures, ages and religions; and
WHEREAS,the crime of domestic violence violates members of our community’s
privacy, dignity, security and humanity in the form of physical, emotional, sexual,
psychological, religious, and economic abuse; and
WHEREAS,advocates, professionals, volunteers and community members
concerned with domestic violence will devote the month of October to raising
awareness about the causes, interventions and prevention of this devastating crime.

A PROCLAMATION OF THE TOWN COUNCIL OF THE TOWN OF
TROPHY CLUB, TEXAS, SUPPORTING THE WEEK OF OCTOBER 6-
12, 2019 AS FIRE PREVENTION WEEK IN TROPHY CLUB; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS,the Town of Trophy Club, Texas is committed to ensuring the safety
and security of all those living in and visiting the Town of Trophy Club; and
WHEREAS,U.S. fire departments responded to 357,000home fires in 2017,
according to the National Fire Protection Association (NFPA); and
WHEREAS,U.S. home fires resulted in 2,630civilian deaths in 2017,
representing the majority (77 percent) of all U.S. fire deaths; and
WHEREAS,newer homes are built with lightweight materials that burn faster
than older home constructions; and
WHEREAS,many of today’s products and furnishings produce toxic gases and
smoke when burned, making it impossible to see and breathe within moments; and
WHEREAS,these conditions contribute to a much smaller window of time for
people to escape a home fire safely, with people having as little as one to two minutes
to escape from the time the smoke alarm sounds; and
WHEREAS,a home fire escape plan provides the skill set and know-how to
quickly and safely escape a home fire situation; and
WHEREAS,a home fire escape plan includes two exits from every room in the
home; a path to the outside from each exit; smoke alarms in all required locations; and
a meeting place outside where everyone in the home will meet upon exiting; and
WHEREAS,home fire escape plans should be developed by all members of the
household; and
WHEREAS,practicing a home fire escape plan twice a year ensures that
everyone in the household knows what to do in a real fire situation;and
WHEREAS,the Town of Trophy Club’sfirst responders are dedicated to
reducing the occurrence of home fires and home fire injuries through prevention and
protection education; and

WHEREAS,the Town of Trophy Club’sresidents are responsive to public
education measures and are able to take personal steps to increase their safety from
fire, especially in their homes; and
WHEREAS,the 2019 Fire Prevention Week theme, “Not Every Hero Wears a
Cape. Plan and Practice Your Escape!” effectively serves to educate the public about
the vital importance of developing a home fire escape plan with all members of the
household and practicing it twice a year.
NOW, THEREFORE, I, MAYOR C. NICK SANDERS, IN CONJUNCTION WITH
THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS,DO HEREBY
PROCLAIM:
OCTOBER 6-12, 2019 AS FIRE PREVENTION WEEK
Section 1.I urge all the people of Trophy Clubto develop a home fire escape
plan with all members of the household and practice it twice a year, and to participate in
the many public safety activities and efforts of Trophy Club’sfire and emergency
services during Fire Prevention Week 2019.

Consider and take appropriate action regarding a request for a replat for the purpose of
splitting one residential lot into two residential lots containing approximately 0.567 acres of
land and generally located on the northeast corner of Palmetto Court and Oakmont Drive (W.
Carroll).
Strategic Link:
Nature & Beautification – Maintain Town assets, services, and codes of ordinances that
preserve the natural beauty of the Town.
Background and Explanation:
The applicant lives on Palmetto Court at the corner of Oakmont Drive on Lot 12 in the Trophy
Club Section 1 subdivision and would like to split his lot into two so that he may build a new
house that will face Oakmont Drive on the second lot. This overall 0.567 acre (24,712 square
foot) property is zoned R-10 Single Family Residential (Exhibit B) and when subdivided, the two
lots continue to meet the minimum lot size of 10,000 square feet. The required front, side, and
rear setbacks have been added or adjusted on each proposed lot to meet the R-10 regulations,
and easements have been created or increased in order to comply with the easement
requirements listed on the final plat (Exhibit C). The front building line on Lot 12R-2 is set back
53 feet from the front property line in order to comply with the zoning regulation requiring lot
width to be a minimum of 80 feet across when measured at the front building line. The plot
plan (Exhibit D) is provided to show that the new common property line is 25 feet away from
the rear of the existing house, meeting the 25 foot rear setback requirement.
Public notice was published in the newspaper and sent to those who own property within 200
feet of the subject property, as required by State Law when considering residential replats. Six

residents spoke during the public hearing at the June 26,2019 Planning and Zoning meeting and
nine residents spoke at the July 23, 2019 Council meeting with concerns including property
values and the subdivision’s Covenants & Restrictions(C&Rs). Town Council voted to continue
the public hearing at the August 27, 2019 Town Council meeting and directed staff to hold a
meeting for the neighbors of the proposed replat to address their concerns.
The neighborhood meeting was held on August 14, 2019 where staff and residents discussed
the subdivision’s Covenants & Restrictions. Staff explained that the Town cannot enforce the
C&Rs because it is not a Town Council-approved document, and further explained that the
authority to enforce the C&Rs lies with the residents of that subdivision. It was also explained
that plat approval is a ministerial duty as required by the State.
At the August 27, 2019 Council meeting, the Town Council closed the public hearing and
referred this agenda item to the October 8, 2019 Council meeting. The item was referred to
provide time for the Council and the Town Attorney to investigate how the pending legal action
between neighbors regarding the subdivision’s C&Rscould potentially affect the Town.
The proposed replat conforms to the Town’s Subdivision Regulationsand Zoning Regulations. In
Section 212.010 “Standards for Approval” in the Texas Local Government Code, it states:
(a) The municipal authority responsible for approving plats shall approve
a plat if:
(1) It conforms to the general plan of the municipality and its
current and future streets, alleys, parks, playgrounds, and public
utility facilities.
(2) It conforms to the general plan for the extension of the
municipality and its roads, streets, and public highways within the
municipality and in its extraterritorial jurisdiction, taking into
account access to and extension of sewer and water mains and
the instrumentalities of publicutilities.
Financial Considerations:
Not applicable.
Legal Review:
Town Attorney has reviewed this item and concurs with the Staff recommendation.
Planning and Zoning Commission Recommendation:
The Planning and Zoning (P&Z) Commission considered this item on June 27, 2019. Resident
concerns included privacy, protecting property values, and the enforcement of the subdivision’s
Covenants & Restrictions. The proposed replat was unanimously approved by the P&Z
Commission.
