Request: The applicant, Rosemarye Bartlett, is requesting approval of a Special Exception for herfence with an automated gate that is flush with the front elevation of her home (setback zero feet (0’)), rather than adhering to the required 10-ft setback. Zoning: The subject property is located in Planned Development No. 22 within Waters Edge at Hogan’s Glen. Current Conditions: The subject property is approximately 19,518 square feet in size and contains a home of approximately 4,771 total square feet, including garages and patios. As shown on the fence plan and in the photos, a wing wall was built in-line with the front elevation. This is a common connection point for a gate, regardless of the location of garage doors. Special ExceptionRequest: Section (B) of the Development Standards for PD-22 states: “Non-Specified Regulations: Any regulations not specifically addressed herein shall be governed by the zoning laws of the Town of Trophy Club or all other ordinances amending or replacing the zoning laws and all other ordinances of the Town.” Zoning Board of Adjustments4 of 42Meeting Date: Thursday, April 12, 2018 EntityThursday, April 12, 2018 Due to that statement, we must defer to the Trophy Club Code of Ordinances, Section 14.02.351(C)(1), which states: “Front elevation. All fences shall be located a minimum of ten feet (10') behind the front elevation of the primary structure.” The applicant is requesting approval of a Special Exception for her fence with an automated gate that was constructed within the frontelevation setback. The house was constructed with the northern-facing garage at the front, making it impossible to later adhere to the 10’ setback regulation and keep that garage protected behind the gate, as shown on Exhibits C & D. The automated wrought iron gate extends from the wing wall at the front of the home, crosses the driveway, and meets the remaining wrought iron fence return that runs to the side property line and connects to the side fence of the same material. Exhibit E presents the approval for the fence and automated gate provided by the Hogan’s Glen Homeowners’ Association (HOA); the applicant did not apply for a permit from the Town because she states that she was told she only needed approval from the HOA. This request is similar to recent requests for Special Exceptions pertaining to automated gates encroaching on the front elevation setback on Tenison Trail and Durango Drive. The positionof this gate is common at many homes in Trophy Club. For reference, the subject property is outlined on the attached Final Plat (Exhibit B). The applicant has already applied for the required permit for a fence and automated gate, and that construction is allowed without special permission from the Board when compliance is met; this request is only in reference to the location at which the gate crosses over the driveway. The fence permit will be issued if the Special Exception is granted, and inspections will be performed if conditions deem it necessary. Special Exception Authority: Section 14.02.351(P) of the Trophy Club Code of Ordinances authorizesthe Zoning Board of Adjustment to consider and allow waivers to the fence requirements as a Special Exception. The language from the ordinance reads: “The Zoning Board of Adjustment shall have the power to grant a Special Exception waiving or modifying these regulations where the literal enforcement of this Ordinance would result in practical difficulty or unnecessary hardship and the relief granted would not be contrary to the public interest but would do substantial justice and would be in accordance with the spirit of this Ordinance. A public hearing is not required for Zoning Board of Adjustment consideration of a Special Exception under this Section. Zoning: The subject property is located in zoning district R-OH Oak Hill. Property Conditions: The subject property is vacant and approximately 12,000 square feet in size. It is a triangular lot spanning 150 feet across the front that diminishes to a point in the rear and is very steep, with a 26 foot vertical elevation rise from front to back. The proposed home will have approximately 3,400 square feet of air-conditioned space, plus a garage of approximately750 square feet.The home will be constructed with brick, stone, and/or stucco in a modern/contemporary styleand will contain an elevator. Directly below the table, lot numbers are categorized into lot types; the subject property is lot 56, putting it in the Town and Country View lot category, as stated above. In addition, the Code of Ordinances contains an illustration in Section 14.02.451 in relation to half-stories which the applicant has included and discussed in the submittal. The thorough explanation provided by the applicant (Exhibit C) categorizes the special conditions introduced by the property and should be read thoughtfully to understand the proposed project. Furthermore, the applicant has provided several renderings to help one visualize the layout and understand the hardship associated with this property. Triangular lots and sloped lots are textbook reasons to grant a variance, but other items should be considered, such as those listed in the Zoning Board of Adjustment Authority section below. The purpose of hearing this variance request is not to alter the design and construction of the future home; this request is only in reference to the number of stories allowed to be built. Public Notification: Public notice was published in the newspaper and sent to those who own property within 200 feet of the subject property. To date, staff has only received one phone call from a neighbor that was neither in support or opposition of the request, but rather looking for more information. Zoning Board of Adjustment Authority: The Zoning Board of Adjustment has the authority to act upon a request for variance. The following should be considered. 1.Is the request owing to a distinct condition inherent in the property itself (e.g., irregularly-shaped lot, unusual topography, etc.)? 2.Is the condition unique to the property (e.g., unusual slope, odd location, etc.)? 3.Is the condition self-imposed or self-created? 4.Is the request owing to a financial hardship? 5.Will a literal enforcement of the zoning ordinance result in an unnecessary hardship? 6.Will the hardship prevent any reasonable use whatsoever? 7.Will the granting of the variance be contrary to public interest? 8.Is the request within the spirit of the ordinance and does it further substantial justice?
