Discussion and recommendation regarding a request for a Specific Use Permit for alcoholic
beverage sales for on-premise consumption in conjunction with a restaurant use to be
operated as part of a Holiday Inn Hotel, on Lot 3R3, Block B, Trophy Wood Business Center
located at 725 Plaza Drive.
REQUEST:
The applicant, Raj Patel, is requesting approval of a Specific Use Permit (SUP) for the sale of
alcoholic beverages for on-premise consumption for a restaurant inside the new Holiday Inn
currently under construction at 725 Plaza Drive. The restaurant will be called “The Crooked Pint
Ale House” and will be located inside the hotel.
A similar request was approved by the Planning and Zoning Commission on June 23, 2016 by a
5-0 vote but was denied without prejudice by the Town Council on August 9, 2016 with the
Council directing the applicant that, if they wished to reapply for the SUP, the following items
are requested by the Council as copied from the August 9, 2016 Town Council minutes:
Submittal of an “action plan or presentation that showed the concept of Crooked Pint”;
“Either documentation be provided or a representative from Holiday Inn be present to
advise that they believed the development would be successful with the sale of
alcohol.”

The following are the minutes from the August 9, 2016 Town Council meeting for original SUP
request:

operated as part of a Holiday Inn Hotel, on Lot 3R3, Block B, Trophy Wood Business Center,
located at 725 Plaza Drive, Case SUP-16-009 (Staff).
Council Member Parrow inquired when Holiday Inn planned to open the hotel. Raj Patel, Owner
of the Holiday Inn, stated that they planned to open November 16, 2016.

Council Member Reed asked Mr. Patel to expand on the franchisor. Mr. Patel responded that the
franchisor was Green Mill Restaurant, out of North Dakota, and that this would be the first
location in Texas. He stated that he purchased the franchise rights for two locations that would
both be located in hotels, one in Trophy Club and one in the Lancaster/Desoto area. He advised
that a separate manager would be hired for the restaurant and the franchisor would train the
employees. Additionally, he stated that he currently operated 20 restaurants and three (3)
hotels with a restaurant and bar.
Conversation took place that the hotel was adequately parked but the restaurant was not, and
that breakfast would be served to hotel guests through the restaurant kitchen.
Motion:
Motion made by Mayor Pro Tem Lamont, seconded by Mayor Sanders, to approve Ordinance
No. 2016-26 P&Z, for a Specific Use Permit (SUP) for on-premise alcohol sales in conjunction
with a restaurant called The Crooked Pint Ale House to be operated as part of a Holiday Inn
Hotel, on Lot 3R3, Block B, Trophy Wood Business Center, located at 725 Plaza Drive, Case SUP-
16-009.
Council Member Kurtz inquired when the restaurant would open. Mr. Patel stated that the
restaurant and hotel would have to open at the same time. Additionally, he confirmed that the
franchisor approved the plans for the prior approved footprints of the restaurant and that they
were not requiring any changes.
Discussion took place that if the SUP were not approved then Holiday Inn would not be able to
open because a requirement of Holiday Inn was to have a full service hotel with restaurant and
bar. Council voiced their concerns that there was a lengthy delay from when the Site Plan was
initially approved and when the Specific Use Permit was applied for, and that the operating
manager of the restaurant had not yet been hired.
Council Member Kurtz requested that Mr. Patel provide the Council with a list of hotels that he
owned that had a restaurant and served alcohol. Mr. Patel stated that he would provide a list
and gave an example of a Hilton Garden in New Braunfels.
Mr. Patel explained that the grading permit was approved on January 14, 2014 and the building
plans were approved prior to January 1, 2014. He stated that he lost the franchise on January
13, 2014 because he was unable to start construction by January 1, 2014; therefore he had to
apply for the franchise again causing the initial delay in construction for three to four months.
Council Member Shoffner inquired about the reason Mr. Patel was unable to start construction
on time because a special meeting had been called specifically for consideration of the replat of
the property on December 30, 2013. Mr. Patel responded that he was unable to break ground
on time, which referred to when the slab was poured.

Council Member Shoffner asked Mr. Patel if he had any Texas Alcohol Beverage Commission
(TABC) violations at any of his other hotel locations. Mr. Patel stated that he had not received
any violations.
Development Services Manager Cooke commented that annual building and fire inspections are
performed on hotels and if the hotel were not in compliance with the Town’s ordinances and
regulations then there would be the ability to not renew the annual TABC license. Town Planner
Ruthven advised that the Council had the ability to impose conditions on the SUP.
Council Member Kurtz asked Mr. Patel how long he knew that he needed to apply for the TABC
license. Mr. Patel stated that this was the first time he had to go before Council for approval of
an SUP but he knew from the beginning that the hotel would have a restaurant and bar.
The vote was taken.
Motion failed for lack of majority 3-4-0 with Mayor Sanders, Mayor Pro Tem Lamont, and
Council Member Rowe voting for, and Council Members Parrow, Reed, Kurtz, and Shoffner
voting against.
Conversation ensued that if the SUP were denied then the applicant would have to wait 12
months before the SUP could be considered again but if the SUP were denied without prejudice
then the SUP could be considered again without a waiting period.
Motion to Reconsider:
Motion made by Mayor Pro Tem Lamont, seconded by Council Member Kurtz, to reconsider Item
No. 16, Consider and take appropriate action regarding an Ordinance for a Specific Use Permit
for on-premise alcohol sales in conjunction with a restaurant to be operated as part of a Holiday
Inn Hotel, on Lot 3R3, Block B, Trophy Wood Business Center, located at 725 Plaza Drive, Case
SUP-16-009.
Motion to Reconsider passed unanimously.
Motion to Deny without Prejudice:
Motion made by Council Member Reed, and seconded by Council Member Parrow, to deny
Ordinance No. 2016-26 P&Z without prejudice.
Council Member Kurtz commented that he would be in favor of reconsidering the SUP with an
action plan or presentation that showed the concept of Crooked Pint. Mayor Sanders suggested
that either documentation be provided or a representative from Holiday Inn would be present
when the item was reconsidered to advise that they believed the development would be
successful with the sale of alcohol.
Town Planner Ruthven noted that a new application would have to be submitted in order for the
item to be reconsidered and that it would go through the entire process again.

RESTAURANT DETAILS:
According to the restaurant’s web site, www.crookedpint.com, the restaurant is described as
follows:

According to the ground floor plan included in the approved site plan for the hotel, the
restaurant floor area will contain approximately 5,000 square feet and will be located on the
ground floor, south side of the hotel to the west of the main entrance.
DISTANCE REQUIREMENTS AND PROXIMITY INFORMATION:
The Trophy Club Code of Ordinances states that no alcoholic beverages may be sold within
three hundred feet (300’) of a church, public school or private school, or public hospital.
The following measurements detail the proximity of the restaurant to the uses listed below. All
measurements are calculated based on a straight line drawn from the front door of the
restaurant to the closest point of the building mentioned below. For churches and hospitals the
required measurement method prescribed by the Code of Ordinances would yield a
significantly greater distance than is shown below:

Discussion andrecommendation regarding a request to amend the approved site plan for
Trophy Club Country Club located at 500 Trophy Club Drive. Case SP-16-037
REQUEST:
The applicant, Stephen Schwind with RLG, on behalf of the property owner, Clubcorp, is
requesting approval of an amendment to the existing site plan for the Trophy Club Country Club
main clubhouse. The request involvesconstructing a resort pool and lap pool with support
facilities to the area just north of the existing clubhouse and the addition of 56 parking spaces
located south of the main clubhouse just west of the main entry drive.
Based on information provided by the applicant, “two new swimming pools are proposed on
the hillside north of the existing clubhouse. The upper pool, located directly north of the
clubhouse will be a free-form resort-style pool which includes both shallow reefs & deeper
areas up to approximately 4’ in depth, children’s splash pad equipment, and possible water
slide. Surrounding this pool will be a concrete pool deck with accompanying cabana structures.
The lower pool, located to the north of the resort-style pool, will be a competitive lap pool. This
rectangular-shaped pool will be suitable for competitive team swimming and will include 6 lap
lanes. The surrounding concrete pool deck, cabana structures and nearby bar will provide
seating around the pool.”
“The resort pool support facilities include an entry building containing restrooms, showers and
changing areas; a pool equipment building; a “turn" building to serve golfers and members
using the pool; and shade structures (cabanas) located around both pool decks. The turn
building will house restrooms, a snack bar with serving windows on the pool and golf course
sides of the building, and a bar with seating for golfers on one side and pool users on the other.
Immediately adjacent to the turn building will be a patio for golfers using the nearby practice
putting green and driving range.”
CURRENT CONDITIONS AND ZONING:
The subject property is zoned CR-Commercial Recreation. The CR district allows both a
commercial swimming pool and a golf course with a clubhouse. The subject property is platted
as two separate lots: Lot 1, Block 1, Trophy Club Country Club Addition (201 acres), and Lot 1,

Block 1, The Fourth Nine at Trophy Club (28 acres). These lots are developed as the Trophy
Club Country Club and contain all existing country club amenities including the golf course.
The amended site plan shows a 21.6 acre tract upon which the clubhouse, parking lot,
accessory structures and proposed pool additions are located. It is important to note that this
tract is not a separate platted lot. Rather it is merely a portion of the platted lots noted above
for the purpose of approving the site plan amendment given the extremely large size of the lots
upon which the country club and golf course are located.
STAFF ANALYSIS:
The plans submitted by the applicant include the following:
Civil Site Plan: This plan shows the existing and proposed structures, swimming
pool and parking. The parking requirements in the zoning regulations do not
adequately address parking requirements for a country club use and are
ambiguous. However, based on a retail parking requirement of one space per
200 square feet of gross floor area, based on the gross floor area of all buildings
upon completion of this project of 42,419 square feet, the total proposed
parking, including the additional spaces, 365 spaces, far exceeds the minimum
required. The civil site plan complies with the CR zoning regulations.
Building Elevations: The CR regulations require masonry walls on all buildings.
The new structures comply with this requirement.
Landscape plan: The landscape plan complies with the CR zoning regulations and
the landscape regulations.
Photometric plan: The photometric plan is in compliance.
No new signage is proposed. The country club possesses an existing SUP for on-premise alcohol
sales.
In terms of residential proximity, the closest residential home to the new additions will be
approximately 500 feet.
STAFF REVIEW AND RECOMMENDATION:
The proposed site plan amendment complies with all Town development requirements. This
item requires final approval by the Town Council. Staff recommends approval.
