Trophy Club Drive, south of Roaring Creek Court by expanding the total lease area from 0.006 acres to 0.016
acres, Case CUP-16-008.
Mayor Sanders opened the public hearing at 7:16 p.m.
There was no one present that wished to speak regarding the item.
Mayor Sanders closed the public hearing and reconvened into Regular Session at 7:17 p.m.
REGULAR SESSION
12. Consider and take appropriate action regarding the acceptance of the Audit for the Town of Trophy Club,
Fiscal Year 2015.
John DeBurro, Senior Audit Manager with Weaver and Tidwell, LLP, provided the Audit presentation, which
included: the Engagement Team; Audit Process; Required Communications to those in Charge of Governance;
Auditor Results; Financial Highlights; and Standards Required to be Implemented in Fiscal Year 2016. Additionally,
he advised that the Town was issued an unmodified opinion, which is the highest level opinion that the Town could
receive.
Town Manager Seidel thanked Mr. DeBurro and his team for their hard work. He recognized Assistant Town
Manager/CFO Steven Glickman, Town Controller Amber Karkauskas, Chief Financial Analyst April Ezell, and
Strategic Services Coordinator John Zagurski for their assistance during the process.

Motion made by Council Member Rowe, seconded by Council Member Parrow, to accept the Audit for the Town of
Trophy Club, Fiscal Year 2015.
Motion passed unanimously.
13. Consider and take appropriate action regarding Trophy Club Drive at Marshall Creek for road improvements
and bridge; receive a presentation from Teague Nall & Perkins; discussion of same.
Town Engineer Tom Rutledge provided a presentation, which included the following exhibits: existing Trophy Club
Drive bridge at Marshall Creek; Trophy Club Storm Water Master Plan from 2011; Option of a 100-year event level
structure - 450’ bridge structure with the roadway being raised by approximately six feet; Option of a 25-year
event level structure - eight barrel 12’x10’ box culverts with the roadway being raised by approximately six feet;
and sample photos of bridges. He explained that a 100-year storm event refers to rainfall totals that have a one
percent probability of occurring at that particular location in that year, and a 25-year storm event occurs more
frequently and the probability rises. He discussed the related cost for the 25-year event level structure and for the
100-year event level structure. Additionally, he advised that the roadway will have to be kept open during
construction, which will be approximately nine months.
Council Member Shoffner pointed out that projects that have been completed within the last five years have been
designed as 100-year event level projects. He believed that the bridge at Trophy Club Drive and Marshall Creek

should be designed as a 100-year event level, which connects both sides of the Town.
Council Member Rowe commented that he would like to see what the projected impact would be for the
immediate surrounding area if it were to be a 100-year event project.
Discussion took place regarding the development of the Town of Westlake and the possibility that the Town of
Trophy Club will receive additional water runoff that cannot be absorbed into the ground.
Mayor Sanders commented that he would like to see statistics regarding flooding in the area. He asked that the
item regarding the bridge be brought back to the Council for additional discussion.
No action was taken on this item.
14.Consider and take appropriate action regarding a preliminary plat for Trophy Club Town Center Addition
containing 26.4 acres located within the PD 30 zoning district between State Highway 114, Trophy Club
Drive and Indian Creek Drive, Case PP-15-029.
Town Planner Ruthven presented the Preliminary Plat update and advised the Planning and Zoning (P&Z)
Commission approved the item at their March 10, 2016 meeting, with the following conditions:
(1)That the Town home lots be redesigned to conform to the PD, specifically 20 foot wide;
(2)That property lines come off of road and not in the centerline;
(3)That common areas in the circulation zone be individually identified with common area lots;
(4)That the metes and bounds property description conform to the PD zoning description; and
(5)That all building lots be located outside of the flood plain.
Joshua Millsap, with Bury representing JSB Properties, LP, stated that they have addressed Condition Items 1-4. He
commented that the townhome developer could have the ability at a future date to make modifications to the
flood plain, regarding Condition Item No. 5, which would affect two or three of the townhome lots.
Dennis Sheridan, Chair of the P&Z Commission, commented that a building permit could still be issued if part of
the property is in the flood plain. He advised that a mortgage company has the ability to require the homeowner
to carry flood insurance.
Discussion took place regarding options that could be done to solve the flood plain issue by possibly pursuing a
Conditional Letter of Map Revision.

Motion made by Council Member Reed, seconded by Council Member Parrow, to approve the preliminary plat for
Trophy Club Town Center Addition containing 26.4 acres located within the PD 30 zoning district between State
Highway 114, Trophy Club Drive and Indian Creek Drive, Case PP-15-029, with the five conditions made by the P&Z
Commission.
Discussion took place that there have been other plats that have been approved that had portions of the property
within a flood plain.
The vote was taken.
Motion carried 6-1-0 with Mayor Sanders and Council Members Parrow, Reed, Rowe, Kurtz and Shoffner voting
for, and Mayor Pro Tem Lamont voting against.

15. Consider and take appropriate action regarding a request to install an electronic message board within an
existing monument sign located at 101 Trophy Club Drive, Fellowship United Methodist Church, being
located in the NS-Neighborhood Services zoning district, Case ME-16-002.
Town Planner Ruthven advised that the P&Z Commission approved the request as presented at their March 10,
2016, meeting.
Mr. Sheridan commented that the P&Z Commission was divided and that their concern was over the sign flashing
and traffic safety. He advised that the applicant would lower the brightness of the sign at a certain hour.
Jeff Wright, General Manager with Legacy Signs of Texas representing Fellowship United Methodist Church,
advised that the display length of time can be changed. He stated that the average nits, measure of brightness, is
brighter during the day but reduces automatically by about 60 percent during the night.
Mayor Pro Tem Lamont clarified that each request to install an electronic message board would have to be
approved by the Council.
Council Member Reed commented that he believed that there could potentially be a light issue if they continue to
approve request for electronic message boards.

Motion made by Mayor Sanders, seconded by Mayor Pro Tem Lamont, to approve a request to install an electronic
message board within an existing monument sign located at 101 Trophy Club Drive, Fellowship United Methodist
Church, being located in the NS-Neighborhood Services zoning district, Case ME-16-002.
Council Member Shoffner stated that the Council has made a conservative effort to control signage within the
Town because of the prior issues with a plethora of placements of signage. He believed that having constant
signage would open the door for other requests and it would be difficult to mandate which ones to allow.
Mayor Sanders recognized that Fellowship United Methodist Church would have the capability to adjust their
signage if they received complaints about brightness.
Chris Rauch, 2 Overhill Drive, clarified that the sign will not be flashing. He stated that they have a large portion of
residents that attend their church, and that their intention is to invite and inform the residents.
Pastor Edlin, Fellowship United Methodist Church, stated that they will do what is needed to be a good neighbor
and that they would be willing to turn the sign off at a certain time.
The vote was taken.
Motion carried 4-3-0 with Mayor Sanders, Mayor Pro Tem Lamont, and Council Members Rowe and Kurtz voting
for, and Council Members Parrow, Reed, and Shoffner voting against.

Motion passed unanimously.
18. Consider and take appropriate action regarding the scope and budget of the Town Hall project; discussion of
same.
Council Member Reed stated that he placed this item on the agenda. He was concerned that the current under
budget amount would not be valid in the near future because he had firsthand experience that the cost of
materials is increasing at a rapid pace. He addressed concerns that have been on social media regarding
diminishing the quality of the facility and stated that he believed that the Council was delivering a quality product.
Motion:
Motion made by Council Member Reed, seconded by Council Member Rowe, to remove the fencing around the
Police Department parking lot.
Council Member Reed commented that there are other Police Departments in the area that are in close proximity
to the highway that do not have security fencing. He was concerned about the facility being over budget and he
believed that this item could be installed at a later time.
Council Member Parrow believed that the fence could be more costly to install if they delayed the installation.
Mayor Sanders was not supportive of the motion and he commented that he would support the option to pursue
the fencing as a separate bid.
Discussion took place regarding action that the Crime Control and Prevention District Board took at their February
25, 2016, meeting for funding of the new Police Department, which included secured fencing.
Council Member Rowe supported the motion because it is an external feature that can be added at a future date.
He was concerned that they could be put in a position to have to reduce items too far into the process, putting
them in an even harder predicament.
Town Manager Seidel commented that many items are being bid as add alternates and that this item could be
added to that list.
The vote was taken, to remove the fencing around the Police Department parking lot.
Motion carried 5-2-0 with Mayor Pro Tem Lamont and Council Members Reed, Rowe, Kurtz, and Shoffner voting
for, and Mayor Sanders and Council Member Parrow voting against.

Main Motion:
Motion made by Council Member Reed, seconded by Council Member Rowe, to remove the two holding cells
designed to be in the Police Department.
Council Member Reed commented that currently individuals are taken to Denton County. When compared to the
expense to construct the cells, the amount of dedicated space they will take up, and the limited amount of time
they would be used for, he believed the space could be utilized for an additional office or storage space needed in
the future.
Discussion took place that the plumbing would have to be planned out today if a holding cell were to ever be
added in the future.
Council Member Parrow commented that the current situation would not reflect the possible future increase in
arrests with additional development about to take place.
Council Member Shoffner spoke in favor of the motion because additional storage will become a necessity in the
future. He commented that the Town has not had a holding facility for 30 years and if arrests are made they are
taken to Denton County. He added that other alternatives are being explored, such as using Roanoke or Keller.
Motion to Amend:
Motion to Amend made by Mayor Pro Tem Lamont, seconded by Council Member Rowe, to plumb for one holding
cell under the slab.
Motion to Amend carried 6-1-0 with Mayor Sanders, Mayor Pro Tem Lamont and Council Members Reed, Rowe,
Kurtz, and Shoffner voting for, and Council Member Parrow voting against.
Discussion took place about the approximate expense of the two holding cells versus plumbing for one holding cell.
The vote for the Main Motion as Amended was taken, to remove the two holding cells designed to be in the
Police Department, and to plumb for one holding cell under the slab.
Main Motion as Amended carried 5-2-0 with Mayor Pro Tem Lamont and Council Members Reed, Rowe, Kurtz, and
Shoffner voting for, and Mayor Sanders and Council Member Parrow voting against.
19. Consider and take appropriate action regarding a Resolution repealing Resolution No. 2015-23 and adopting
a new Resolution appointing a Town Council Liaison to serve on the Animal Shelter Advisory Board;
reaffirming existing appointments; and providing an effective date.

Motion made by Council Member Rowe, seconded by Mayor Pro Tem Lamont, to approve Resolution No. 2016-08,
repealing Resolution No. 2015-23 and adopting a new Resolution appointing Council Member Philip Shoffner as
the Town Council Liaison to serve on the Animal Shelter Advisory Board; reaffirming existing appointments; and
providing an effective date of March 22, 2016.
Council Member Shoffner commented that the Council has tasked the Board with items that are still pending and
that he believed having a Council Liaison will assist connecting the Animal Shelter Advisory Board with the Parks
and Recreation Board.

This item allows Council to request the placement of items on upcoming agendas when the topic of discussion
requires research and review that cannot be accomplished in the time frame between regular Council meetings.
However, a Council Member may request that an item be placed on the next regularly scheduled meeting without
first placing that item on the Future Agenda Items list. All requests for agenda items must comply with Charter
requirements.
Mayor Sander requested to have Item No. 7, from the Town Council Future Agenda Items list, as an action item on
the April 12, 2016 Council agenda: Discussion to change park hours to stay open until 10 p.m. and clearly note
change on new signage. (Reed 1/12/2016) (1-April 12, 2016).

1. Public hearing regarding a request to amend certain designated Planned Development No. 30 (PD-30)
conditions on an approximately 26.4 acre tract of land located generally at the northeast corner of Trophy
Club Drive and State Highway 114, bordered on the north by Indian Creek Drive and on the east by the rear
property lines of the residential lots located on Brook Hollow Drive, Case PD-AMD-16-048.

Mike Pacillio, 4956 North O’Connor Road, Irving, Texas, stated that they have a full development team in place
which included: Beck Properties, North American Properties, Green Brick Partners, Inc., Kriya Hotels, and
Weitzman Group. He presented the following Planned Development (PD) 30 exhibits: Approved Preliminary Site
Plan; Proposed Preliminary Site Plan; Improvements to PD-30; side by side comparisons of the Approved versus
Proposed Site Plan; Amendment Specifics; Benefits of Amendments; Trophy Club Drive Elevation; Material
examples of Exterior Elevation; Preliminary Multi-Family Unit Mix; Green Brick Partners, Inc. – Townhomes; Kriya
Hotels – Hyatt Place or A-Loft Hotel; Drainage and Detention; and Detention Street and Site Views.
Bill Dahlstrom, Partner with Jackson Walker L.L.P., thanked the Planning and Zoning (P&Z) Commission and Staff
for their assistance through the process. He stated that they received a recommendation of approval from the
P&Z Commission for the PD-30 modifications. He advised that the recommendation to put gates at both ends of
the street for the townhomes was to deter traffic from going down the street. He stated that they had no issues
with a traffic deterrent system, but pointed out that the gate may not be the appropriate tool. They preferred to
come forward with a traffic deterrent system at the time of approval for their Preliminary Plat and Site Plan to
allow further review.
Erich Smith, 243 Oak Hill Drive, stated that PD-30 was approved in 2012 and that Beck Ventures had committed to
a mixed use development with the apartments to house the people that shopped in the retail space. He stated
that a large number of citizens objected to PD-30 because they did not want the additional apartments. He
explained a condition that the prior Council made that the retail space and apartments would be built
simultaneously. In 2014, PD-30 was amended to allow the apartments to be used on the first floor if after two
years retail space remained unoccupied. He believed that with the hotel will produce less tax revenue than
originally proposed since there would be no restaurant and have less meeting space. He felt that the detention
area would be a catch area for rain runoff that will attract mosquitos and collect trash. He urged the Council to
vote for the Town of Trophy Club and a development that enhances the community.
2. Public hearing regarding a request for a Specific Use Permit for a Hotel (limited-service) on an
approximately 2.075 acre tract located within the PD 30 Zoning District, located generally at the northeast
corner of Trophy Club Drive and State Highway 114, bordered on the north by Indian Creek Drive and on the
east by the rear property lines of the residential lots located on Brook Hollow Drive, Case SUP-16-008.
Nina Chudasama, Managing Partner/General Counsel with Kriya Hotels, stated that they are seeking approval to
develop an upscale select service hotel with a minimum of 105 rooms. She explained that full service restaurants
in hotels are diminishing in current hotel developments, and the new direction is a boutique style/work life
balance hotel. She stated that they will have a full commercial kitchen allowing for food and beverage to be
offered throughout the day.
Mayor Sanders closed the public hearing and reconvened into Special Session at 7:29 p.m.
SPECIAL SESSION
3. Consider and take appropriate action regarding an Ordinance amending certain designated Planned
Development No. 30 (PD-30) conditions on an approximately 26.4 acre tract of land located generally at the
northeast corner of Trophy Club Drive and State Highway 114, bordered on the north by Indian Creek Drive
and on the east by the rear property lines of the residential lots located on Brook Hollow Drive; providing
for amendments and providing an effective date.
Town Planner Ruthven advised that this item was for proposed amendments to the original PD-30 approved in
2012, which was further amended in 2014. He stated that the proposed amendments would include reducing the
total multi-family units from 283 to 250; eliminating the ground floor retail ready units; reducing the overall height
of the urban residential down to four stories; and eliminating the efficiency units. He advised that nine additional
townhomes are proposed bringing the total to 39 units. He stated that a new Preliminary Site Plan will be

presented for consideration with a different configuration of retail and office, and that the phasing has been
eliminated but the developer will be required to install the infrastructure and parking around the pad sites along
Highway 114 at the same time the urban residential will be built. He commented that a rowhouse definition had
been added, which would require urban residential facing Trophy Club Drive to resemble brownstones, and that a
limited service hotel definition was added to the regulations. Additionally, he stated that the P&Z Commission
voted to approve the amended PD-30 at their March 24, 2016 meeting with the conditions as listed in the PD
District Development Standards, Exhibit “B” that was provided prior to the meeting tonight.
Council Member Reed addressed Mr. Smith’s comments and stated that as the development was moving forward
and being prepared to be built, the current Council tried to create a development that would benefit the
community. He stated that the current Council did their due diligence to push the apartment complex away from
Highway 114 and then lower the height of the buildings. He believed that the retail spaces will benefit from being
brought closer to the street and having green space that would allow shoppers to walk around. Additionally, he
stated that he believed this development now offers the retail a chance to thrive.
Mayor Pro Tem Lamont pointed out that he was not on Council in 2012 and that he voted against the PD-30
amendments when he was on Council in 2014.
Chase McCrea, Chief Financial Officer with Beck Ventures, spoke about their commitment to ensure the retail
spaces by installing the infrastructure, grading the entire site, and building the roads. He stated that the detention
facility is intended to be dry and will be hidden. He added that the new plan would allow for a restaurant to have
an L-shaped facility, which will help engage it with the multi-family and hotel. Additionally, he commented that
the clock tower is an important piece of the Town, which will either be relocated or be recovered to match the
architecture that will be built.
Mike Twichell, President of Michael Twichell, L.P., commented that it is better for the retail spaces to have visibility
from Highway 114 and since the hotel will be a destination location, they pushed it further back.
Council Member Rowe pointed out that the main item was to review the land use. He added that the zoning locks
in the commercial pad sites as commercial use and if any uses were to be modified, it would have to come back
before Council for consideration.
Carter Kendall, Land Acquisitions Manager with Green Brick Partners, Inc., advised that they are discussing with
the owners about the possibly of a screening wall with landscaping for the townhomes from the hotel.
Council Member Rowe commented that the townhomes are a particularly new type of residential for the Town
and he inquired about the opportunity to possibly have the townhomes come back through a Site Plan process,
which is not required due to the conditions of PD-30.
Mr. McCrea stated that the only item for townhomes was to increase the number and that adding another step
would delay the development process.
Dennis Sheridan, Chair of the P&Z Commission, stated that the townhomes, as approved, had separation in the
front and was shown on the original 2014 Site Plan.
Ms. Chudasama addressed concerns regarding the reduction of meeting space and stated that the reason was due
to the return on the square footage. She added that their larger meeting spaces are typically used for corporate
meetings.
Glenn Strother, 1 Overhill Drive, encouraged the Council to create a retail development time table for shells to be
built. He believed that the proposed modifications are a great improvement from what was previously approved.
Louis Goldstein, 68 Cypress Court, commented that he had attended some of the original hearings. He stated that
the development continues to change in order to sell the product, which he believed may not be for the benefit of
the community. He was concerned that the road that cuts through to Hogans Glen will be used as a pass through
street.

Mayor Sanders discussed the addendum of changes to Exhibit B of Ordinance No. 2016-11 P&Z, that was provided
at the dais.
Mr. Pacillio advised that in the original PD-30, balconies are prohibited; therefore they requested balconies to be
allowed on units facing Trophy Lake Drive, not to exceed a total of six units. He advised that subsequent to the
P&Z Commission meeting, they discovered that they would need to have the same ability on the other
brownstone.
Mr. Dahlstrom suggested the following amendment to the first sentence of Item No. 5, Townhome Residential
Requirements, subsection a, Townhome Residential General, romanette ix, on page 56: Prior to the issuance of any
building permit authorizing construction of any Townhome allowed by this ordinance, the developer shall provide
a means of deterring non-resident traffic from entering the Townhome street such as electronic controlled access
gates shall be installed across the main road providing access to the Townhomes on each end of the Townhome
development such that access to the Townhomes is restricted to Townhome residents and guest only.
Town Attorney Adams advised that the PD-30 document is silent to many of the Site Plan requirements and
regulations would revert to the Town of Trophy Club Code of Ordinances.
Town Planner Ruthven suggested the following language for Item No. 5, Townhome Residential Requirements,
subsection a, Townhome Residential General, romanette ix, on page 56: Prior to the issuance of any building
permit authorizing construction of any Townhome allowed by this ordinance, the main road providing access to
the Townhomes shall be constructed such that through traffic is restricted by keeping one end of the road closed
with the additional placement of approved traffic calming devices designed to slow the speed of traffic along the
road. The final design of the devices designed to restrict and calm traffic shall require the approval of the Town
Engineer, the Fire Chief, and the Town Manager or their designee.
Discussion took place that a gate would not be allowed next to Texas Department of Transportation (TxDOT) right-
of-way, that it could create stacking issues on Highway 114, and that an exit only could not be done due to the
location of the on-ramp but it could possibly be a right entrance only.
Town Engineer Rutledge stated that in similar situations a solution could be to install removable bollards at the
end of the cul-de-sac and space them far enough apart to allow for golf carts and be removable to allow
emergency vehicles to access the area.
Council Member Rowe suggested the following language for Item No. 5, Townhome Residential Requirements,
subsection a, Townhome Residential General, romanette ix, on page 56: Prior to the issuance of any building
permit authorizing construction of any Townhome allowed by this ordinance, bollards shall be installed at the end
of the main road providing access to the Townhomes that is nearest to Indian Creek Drive. Said bollards shall be
spaced to accommodate passage by a standard golf cart, and meet all requirements of the Town’s fire code and
shall require the final approval of the Fire Chief and Town Manager.
Mr. McCrea and Mr. Kendall agreed to the bollards.
Per previous discussion, Mayor Sanders suggested adding wording to the end of Item No. 4, Urban Residential
Specific Requirements, subsection b, on page 54 so that it reads: Urban Residential buildings facing Trophy Club
Drive shall be designed as rowhouses, as defined in this ordinance, and each ground floor urban residential unit
facing Trophy Club Drive shall be designed to have a separate pedestrian entrance. There shall be no limit on the
number of rowhouses that may be connected to each other. Each individual rowhouse shall be separated by a
minimum two foot offset per unit elevation. Balconies shall be allowed on units facing Trophy Club Drive at two
locations for a maximum total of 12 balconies.

Mr. Sheridan pointed out that Item No. 8, Design and Location of Stormwater Detention Facilities, subsection d, on
page 75, was missing the Detention Site View exhibit that the P&Z Commission requested to add.
Discussion took place regarding installing landscaping to assist with screening of the detention area, and that
access to the pond will be needed.
Council Member Rowe suggested adding subsection e to Item No. 8, Design and Location of Stormwater Detention
Facilities, on page 75, so that it reads: Where wrought iron fences are present surrounding the detention area,
these fences shall be screened with a living screen with a minimum height of 42”, excluding access gates.
Additionally, he suggested adding subsection iii to Item No. 1, on page 14, so that it reads: A minimum of two
enhanced paving features as defined in this section shall be installed within the road that runs between the
apartment property and the hotel property, with the specific intent of calming traffic.
Discussion took place that the intent is to have variations from an architectural standpoint regarding the
townhomes.
Joshua Millsap, with Bury representing JSB Properties, LP, advised that at this time they did not intend to do
reclamation pertaining to the flood plain line. He stated that they performed a study for the Country Club creek
and submitted a full drainage study. He advised that they have two conditions, which are the existing Federal
Emergency Management Agency (FEMA) and the fully developed conditions that reflect Westlake being fully
developed. He added that two lines are shown, one from where FEMA shows the current flood plain and one
depicted based upon their topography. He added that from the corner of Highway 114 to the corner of Indian
Creek Drive, there is a slope and as part of their improvements they will install underground storm drainage to
take water to the detention pond.
Town Engineer Rutledge explained that the FEMA map is not matching the topography. He stated that before
pursuing a Letter of Map Amendment Revision (LOMAR), they had requested that Bury survey the creek, do the
topography, and then run a model to see how it lines with FEMA. He advised that FEMA has not accurately
mapped the area that reflects what is really on the ground, and if a LOMAR was filed, then it will technically move
the flood plain onto those residents. He commented that their approach was not to do a LOMAR because it would
push the flood plain onto those residents.
Mr. Sheridan recommended inserting “staggered” within subsection b of Item No. 5, Townhome Residential
Requirements, on page 56, so that it reads: Townhome Residential maximum density: the maximum number of
Townhome/Townhouse units is 39 staggered units.
Discussion took place regarding a minimum sound transmission class (STC) between the walls and the floors of the
hotel, and that the Towns adopted Code requires a minimum of 50 STC for hotels.
Ms. Chudasama commented that Hyatt Place offers a full hot breakfast and has a full commercial kitchen. She
added that they are pursing building a Hyatt Place Hotel but that their second choice would be to build an A-Loft
Hotel.
Discussion took place related to increasing the minimum number of rooms to 150 within the Hotel (limited-service)
definition and the ability of allowing fewer by a Specific Use Permit (SUP).

Motion made by Mayor Sanders, seconded by Council Member Reed, to approve the amendments to Exhibit B of
the Planned Development 30 document and to approve the amendments made by and agreed to by the applicant
and P&Z Commission.
Discussion took place that it would be appropriate to make a motion to approve Ordinance No. 2016-11 P&Z, and
then make a motion to amend to approve the proposed amendments to Exhibit B of the Planned Development 30

Explanation:
Recent Public Utility Commission of Texas ("Commission") proceedings related to approval of
conversion of Oncor into a Real Estate Investment Trust ("REIT") resulted in the Commissioners'
desire to share $200 million to $250 million in annual federal income tax ("FIT") savings with
Oncor ratepayers. Since the proceeding involving a change of ownership and control of Oncor
was not a rate case, the Commission had no jurisdiction to order a reduction in rates. The new
owners of Oncor indicated an intent to file a rate case in mid-2017 to become effective in 2018.
Believing that a two year wait to factor FIT savings into rates was too long to wait, the Steering
Committee of Cities Served by Oncor decided to initiate a rate case against Oncor.
Whereas Clauses Explained
Cities have original rate making jurisdiction over Oncor's rates and services within their
municipal limits. The Commission has original jurisdiction over the environs outside municipal
limits and appellate jurisdiction over city rate mailing orders.
As a regulatory authority, Cities that retain original jurisdiction may initiate rate making
proceedings by filing a resolution requiring a public utility to show cause why rates should not
be reduced.
The City works with other similar Oncor Cities on regulatory issues through the Steering
Committee of Cities Served by Oncor which has functioned continuously since 1988.

The Executive Committee of the Steering Committee recommends that member Cities pass
show cause resolutions to initiate a rate case so that Oncor rates may be reduced.
Resolved Sections Explained
Section 1 provides notice to Oncor that it is compelled to file information that would otherwise
be required if the Company filed a request to increase rates at the Commission by September 1,
2016. This Section requires that historic data from calendar year 2015 be filed to demonstrate
that its rates should not be reduced.
Section 2 authorizes Cities' representatives to file requests for information which shall be
answered by Oncor within 15 days of receipt.
Sections 3 and 4 set other dates critical to the procedural process for rate setting. Cities' report
will be due on October 13, 2016 and the Oncor rebuttal will be due November 10, 2016.
Section 5 establishes that a hearing will occur and final order will be issued between November
15, 2016 and December 15, 2016.
Section 6 provides that the procedural schedule may be amended by the City and that other
orders may be extended. For example, once the REIT conversion is finalized, Cities may enter
interim orders requiring a sharing of tax savings that benefit ratepayers.
Section 7 authorizes the hiring of legal counsel and authorizes the Executive Committee to hire
consultants.
Section 8 confirms that Cities will seek reimbursement of their rate making expenses from
Oncor.
Section 9 confirms that the resolution was passed in compliance with Open Meeting laws.
Section 10 directs the distribution of this Resolution to Oncor and Steering Committee council.

NOTING COMPLIANCE WITH OPEN MEETINGS LAW; PROVIDING
NOTICE OF PASSAGE.
WHEREAS
, the Town of Trophy Clubis a regulatory authority under the Public
Utility Regulatory Act (“PURA”) and has original jurisdiction over the rates of Oncor
Electric Delivery Company, LLC (“Oncor”) to determine if such rates are just and
reasonable; and
WHEREAS
, Sections 33.021, 36.003 and 36.151 of PURA empower a
regulatory authority, on its own motion or on a complaint by any affected person, to
determine whether the existing rates of any public utility for any service are
unreasonable or in any way in violation of any provision of law, and upon such
determination, to determine the just and reasonable rates; and
WHEREAS
, the Town of Trophy Clubhas reason to believe that Oncor is over-
earning and its rates are excessive; and
WHEREAS
, the Town of Trophy Clubis a member of the Steering Committee of
Cities Served By Oncor; and
WHEREAS
, the Executive Committee of the Steering Committee of Cities
Served by Oncor has recommended that cities pass a resolution that requires Oncor to
show cause why its transmission and distribution rates should not be reduced; and

WHEREAS
, the Town of Trophy Club, and the TownCouncil of the Townof
Trophy Clubdesires, on its own motion, to exercise its authority under Sections 33.021,
36.003 and 36.151 of PURA; and
WHEREAS
, a procedural schedule should be established for the filing of certain
information by Oncor, procedures to be followed to obtain and review information from
Oncor, the filing of an analysis of such information by the Town, the filing of rebuttal
information from Oncor, and a public hearing at which time the Townshall make a
determination whether the existing rates of Oncor are unreasonable or are in any way in
violation of any provision of law, and if such rates should be revised, and just and
reasonable rates determined for Oncor.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWNCOUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
SECTION 1. This resolution constitutes notice of the Town’s intent to proceed
with an inquiry into the transmission and distribution rates charged by Oncor. On or
before September 1, 2016, Oncor shall file with the Town of Trophy Clubinformation
that demonstrates good cause for showing that Oncor’s transmission and distribution
rates should not be reduced. Specifically, Oncor shall file with the Town of Trophy Club
information for the test year beginning January 1, 2015 and ending December 31, 2015,
regarding Oncor’s cost of service elements, including, but not limited to, the elements
detailed by the Public Utility Commission as necessary for the filing of a Statement of
Intent to Change Rates. The test year may be updated for more current data and shall
be adjusted for known and measureable changes.
SECTION 2. Town’s designated representatives shall have the right to obtain
additional information from Oncor through the filing of requests for information, which
shall be responded to withinfifteen (15) days from the receipt of such request for
information.
SECTION 3. Town’s designated representatives shall file their analysis of
Oncor’s filing and information on or before October 13, 2016.
SECTION 4. Oncor shall file any rebuttal to the analysis of Town’s
representatives on or before November 10, 2016. With its rebuttal, Oncor may present
whatever additional information it desires to defend its current rates.
SECTION 5. A public hearing shall be conducted by the TownCouncil for the
Town of Trophy Clubduring a regular council meeting scheduled between November
15 and December 15. Atsuch hearing a representative of Oncor and a representative
of the Town of Trophy Club’s consultants will each be allowed to address the Town
Council and summarize previously filed reports for no more than 15 minutes. Based
upon such hearing, a determination of the reasonableness of the existing rates of Oncor
shall be made by the TownCouncil and, if necessary, just and reasonable rates shall be

determinedto be thereafter observed and enforced for all services of Oncor within the
Town of Trophy Club, Texas.
SECTION 6. The TownCouncil may, from time to time, amend this procedural
schedule and enter additional orders as may be necessary in the public interest and to
enforce the provisions hereof.
SECTION 7. Subject to the right to terminate employment at any time, the Town
of Trophy Clubhereby ratifies the Steering Committee’s selection of Geoffrey Gay with
the law firm of Lloyd, Gosselink, Rochelle & Townsend as legal counsel to assist the
Town of Trophy Clubin its ratemaking and to prosecute any appeals to the Texas
Public Utility Commission or court. The Executive Committee of the Steering
Committee of Cities Served by Oncor shall retain appropriate consultants to prepare a
report and make rate recommendations.
SECTION 8. Fees and expenses of attorneys and consultants assisting the
Townin the Steering Committee’s review of the reasonableness of Oncor’s rates will be
processed through the Steering Committee but the Townreserves the right to seek
reimbursement from Oncor pursuant to the PURA Section 33.023.
SECTION 9.That it is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law, and that
public notice of the time, place, and purpose of said meeting was given all as required
by Section 551.041, Texas Government Code.
SECTION 10.That a copy of this Resolution shall be sent to E. Allen Nye, Jr.,
Senior Vice President, General Counsel and Secretary,Oncor Electric Delivery
Company LLC, 1616 Woodall Rodgers Freeway, Dallas, Texas 75202, and to Geoffrey
Gay, General Counsel to the Steering Committee of Cities Served by Oncor, at Lloyd
Gosselink Rochelle & Townsend, P.C., P.O. Box 1725, Austin, Texas 78767-1725.

A PROCLAMATION OF THE TOWN COUNCIL OF THE TOWNOF TROPHY
CLUB, TEXAS, TO RECOGNIZE MAY 5, 2016 AS THE DAY OF PRAYER IN
TROPHY CLUB; RECOGNIZING THAT 2016 IS THE 65TH CONSECUTIVE
ANNUAL OBSERVANCE OF THE NATIONAL DAY OF PRAYER; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS
,our nation was founded upon a firm bedrock of faith and throughout our
history, Americanshave prayed as a means of seeking comfort, giving thanks and asking for
guidance during times of strength and times of weakness, in moments of joy and moments of
despair;and
WHEREAS
, public prayer and national days of prayer have a long and significant
history in American tradition dating back to the first call to prayer in 1775 when the
Continental Congress asked the colonies to pray for wisdom in forming a nation; and
WHEREAS
, these times of national supplication were made official in 1952 when
President Harry Truman signed a joint resolution of the U.S. Congress which enacted
legislation setting aside an annual day of prayer for the nation, and in 1988 this law was
amended permanently setting the day as the first Thursday of every May; and
WHEREAS
, the National Day of Prayer belongs to all Americans and is a day that
transcends differences, bringing together citizens to honor God and give Him thanks for the
many liberties and blessings we have received, among them the freedom to gather, worship
and pray; and
WHEREAS
, Thursday, May 5, 2016, is the 65thobservance of the National Day of
Prayerwith the theme “Wake Up America” as inspired by Isaiah 58:1a which says, “Shout it
aloud, do not hold back. Raise your voice like a trumpet”; and
WHEREAS,
on this day leaders and citizens across our nation and state will join
togethertoseek the face of Almighty God to acknowledge our dependence on Him, to seek
His grace, guidance, strength and protection upon us as a people and a nation;and to pray
for peace throughout the world during these trying and challenging times.

Explanation:
Trophy Club was founded on resident volunteerism, and that tradition remains strong today
with many community leaders working behind the scenes to make Trophy Club 'A Great Place
to Call Home'. Citizen of the Year (COY) Recognition showcases the people who go above and
beyond to make Trophy Club better and provides formal acknowledgment of deserving
individuals.
A total of nine 2015 COY nominations were received; each Adult nomineereceived two
nominations each.

Evaluation & Selection Process
The Citizen of Year Committee, made up of past Citizen of the Year recipients, reviews the
nominees and selects an Adult Citizen of the Year and Youth Citizen of the Year. Any member of
the committee sharing a close, personal relationship with a nominee (such as a relative, etc.)
must recuse themselves from voting.
Adult Citizen of the Year - recognized for their outstanding work with a non-profit organization
(for example raising funds, coordinating philanthropic events for the organization, overseeing
distribution of funds, etc.), work in schools, local government, parent teacher organizations,
Boy Scouts of America, Girl Scouts of America, 4H Clubs, etc.
Youth Citizen of the Year - a citizen 18 years or younger who made a difference in the Trophy
Clubcommunity or schools.

REQUEST:
The Town of Trophy Club is requesting approval of the site plan package for the new Town Hall
facility to be constructed at One Trophy Wood Drive.
CURRENT CONDITIONS AND ZONING:
The subject property contains 5.596 acres, is platted and undeveloped. The current zoning of
the property is GU-Government Use.
DEVELOPMENT DETAILS:
The proposed development includes a single building, which will be 23,874 square feet in size
and contain 123 parking spaces. The building will be a single story structure with the exterior
wall composed of brick and stone.
The plans submitted include the following:

Landscape Plan
Photometric Plan
Building Elevations
Conceptual Sign Exhibits
The plans meet the requirements of the Code of Ordinances and the GU zoning district with the
following exception: The Code of Ordinances requires a minimum eight (8) foot masonry wall
to be constructed between non-residential uses and residential uses. Therefore, said wall is
required to be constructed along the northern property line adjacent to existing single family

homes. The required wall is not shown on the plans. An existing six foot wood fence with
masonry columns is located along said property line.
PLANNING AND ZONING COMMISSION RECOMMENDATION:
The Planning and Zoning Commission considered this item on April 21, 2016 after the Council
packet was sent. Staff will provide an update to the Council concerning the Commission’s
action prior to the start of the April 26, 2016 meeting.
STAFF REVIEW AND RECOMMENDATION:
With exception of the screening wall requirement, the proposed development complies with
the GU zoning and Code of Ordinances requirements. Representatives from the architectural
and engineering design firms and the construction management company will be present at the
meeting to answer any questions.
Staff recommends approval.

Description:
The purpose of this item is seek final Council direction on the aesthetics of the noise wall to be
built TxDOT along SH 114 in Trophy Club in conjunction with the widening of the highway from
four main lanes to six. On February 9, 2016, representatives from TxDOT presented details
concerning the proposed sound wall to the Council. Discussion included wall location,
dimensions and aesthetics. Since the February 9, 2016 meeting, the final wall location and
dimensions have been determined and are shown on the 95% project specifications and
engineering plans. The wall will be built approximately three feet off the property line for the
single family residential homes with some minor deviations to accommodate for utilities. The
western portion of the wall (west of Trophy Club Drive and east of Trophy Lake Drive) will be
built to a height of 14 feet above grade. The eastern portion of the wall (between Trophy Club
Drive and Lake Cities Church of Christ) will be built to a height of 12 feet.
To be determined are the wall aesthetics, which includes the wall texture and wall color.
Consistent with the February 9, 2016 presentation from TxDOT, the wall texture options are as
follows:

TxDOT states that the wall may be painted to match any color preference. However, staff
recommends that the color be consistent with the existing color scheme along SH 114 in

Westlake, which is beige to dark brown. Additionally, two shades of gray are added as an
option for the stone texture should it be chosen.
The following are the draft minutes from the February 9, 2016 Town Council meeting
concerning discussion of the noise wall:

presentation by Texas Department of Transportation regarding construction of
a sound wall along State Highway 114 in conjunction with the reconstruction
and widening of the highway; discussion of same.
Nancy Cline, TxDOT Denton County Area Engineer, provided an update regarding
the SH 114 project, which included area maps, the project description, and
schedule. She commented that the construction let date is July 2016 and plans
have to be received in Austin by May 2016. She provided two options for the
sound wall location, which was to either place it in TxDOT right-of-way or the
Town’s right-of-way.
John Polster, with Innovative Transportation Solutions, Denton County
Transportation Consultant, clarified that the residents that are affected by the
sound wall will be able to vote on a color and texture and that the Town will be
able to vote on the traffic side of the wall.
Discussion took place that the Town would encourage those residents that are
affected by the wall to extend their side yard fence to the sound wall.
Council Member Rowe pointed out that if not all the affected residents extended
their side yard fence that would leave potential for the Town to have to maintain
those three foot sections that were not accessible.
Nelson Underwood, TxDOT Project Manager, commented that if the wall were to
be placed on the back property line that would complicate the project because
they would have to maintain agreements from all the affected residents, which
would compromise their construction let date of July 2016.
Mrs. Cline commented that TxDOT was seeking input from the Council regarding
the wall location.
Council Member Parrow stated the he would lean towards the three foot option
and have the affected residents contacted to make them aware that they will
have the ability to vote on the surface and that they will be able to extend their
side yard fence to the sound wall.
Council Member Reed commented that he did not have a preference.
Council Member Rowe abstained because his preference was not listed.

Mayor Sanders, Mayor Pro Tem Lamont, and Council Member Kurtz were in favor
of the three foot option.
Council Member Shoffner was in favor of the three foot option but he would like
Staff to present options to mitigate those issues for affected residents at a future
date.
Mrs. Cline suggested that Staff meet with TxDOT representatives to discuss the
fence material and color.
Council Member Rowe requested that they be cognizant if the color is applied by
paint because he did not want to create a maintenance issue for the affected
residents.
Mr. Polster clarified that the residents that would be contacted would be those
that were identified through the noise analysis as benefit receptors to the
project. He advised that those residents will be able to choose from basic form
liners that the State offers at no additional cost and that they will be able to
choose from a set palette of colors.
Mayor Sanders thanked Mrs. Cline, Mr. Underwood, and Mr. Polster for their
presentation.
April 12, 2016 Noise Workshop:
On April 12, 2016, TxDOT conducted a noise workshop at Medlin Middle School to receive input
on whether or not they wanted the wall to be built. TxDOT presented the proposed wall
location, dimensions and texture options. There was no discussion concerning, nor any
presentation regarding, proposed wall color options. Representatives from TxDOT explained
that the wall location and dimensions were essentially set and could not be altered. However,
regarding wall aesthetics, the representative explained that the final decision would rest with
the Town.
In order to build the wall, TxDOT needed the affirmative vote of a majority of the property
owners notified. 46 property owners were notified. Therefore, an affirmative vote of 24
property owners would allow the construction of the wall to move forward.
On April 18, 2016, TxDOT notified the Town that, to date, a total of 26 affirmative votes in
support of building the wall were received from the property owners that were notified with
zero “no” votes received. Therefore, final preparations for wall construction may proceed.
Next Steps:
In order to determine the final aesthetic preference for the residential side of the wall, staff
sent the attached letter to all 46 residents on Monday, April 25, 2016 informing them of the
process for voting on the final wall color and texture. Once voting is closed, staff will forward

the results, along the Council’s aesthetic preference for the wall portion facing SH 114 no later
than May 11, 2016.
Given these conditions, the following is a breakdown on final steps for constructing the noise
wall:
May 11, 2016: Send final wall aesthetic preferences and signed wall maintenance
agreement to TxDOT
June, 2016: Final 100% project specifications and engineered plans completed
including final noise wall details.
July, 2016: Project letting
Fall, 2016: Construction begins
Staff seeks final Council direction on the final color and texture preference for the portion of
the noise wall facing SH 114.

Dear Trophy Club Property Owner:
Earlier this month you were sent a letter (attached) from the Texas Department of
th
Transportation (TxDOT) concerning a noise workshop that was held on April 12. The purpose
of the workshop was to gather feedback concerning construction of a proposed noise wall
along State Highway 114 adjacent to your home. Included in the presentation from TxDOT
were specific dimensions and locations for the proposed wall. The wall dimensions are
determined by TxDOT based a scientific noise analysis of the future impact of the widening of
the highway. Likewise, the wall location was placed closer to the backs of homes along the
highway in order to maximize its effectiveness. The location of the wall, as well as the wall
dimensions, have been finalized.
Given these factors, the last items to be determined prior to construction of the wall are the
aesthetics of the wall, including wall texture and color. The texture and color for the side of the
wall facing State Highway 114 are determined by the Town Council. However, the side facing
toward Trophy Club residences, including your property, will be determined by a majority vote
of the residential property owners facing the proposed wall.
In order to vote on the preferred wall texture and color options, please visit the following web

preferences are kept confidential. Please complete the survey no later than May 3, 2016. A
simple majority vote in favor of the preferred texture option and the preferred color option will
determine the final wall aesthetic, which will then be forwarded to TxDOT to be included in the
final plan specifications and engineering documents for the freeway widening project.

Explanation:
Council has requested an update on the various capital projects/items funded in the current
budget year. The list of projects and theircompletionstatus is as follows:
1.Lakeview Soccer Fields – This project was bid and the bid was awarded to Greenscaping
– the project will be completed and the fields operational before September.
2.Install a new filter for the small pool - Completed.
3.Resurface the small pool - Contractors have sand blasted away the existing surface and
th
they should have any defects removed and the pool recoated by April 30.
4.Change the alignment of the large slide within the splash pad - Contractors began on-
site work on April 20 and should be finished by the following week.
5.Remove and ship several spray pad features to be refinished - Shipped in early March
and are to be returned and reinstalled the first week of May.
6.Bleacher replacement at Harmony Park - Council instructed staff to not move forward
on this item and instead instructed them to remove wooden bleachers - which has been
completed.
7.Purchase of Zero-turn mower - The mower was purchased and is operational.
8.Rehabilitate 8-10 cul-de-sac medians - This project’s scope of work will utilize in-house
resources and the option of removing these medians to become part of the surrounding
road is now being discussed.The project will be completed this summer.
9.Install the NEOS system at Independence West - The system has been disconnected and

is scheduled to be removed from Harmony Park on April 22. It will be installed at
Independence West in late May-early June.

Explanation:
Two new bills were passed last legislative session that affect both sales and property taxes:
House Bill 157 eliminates the cap of 1% for general sales taxes and caps on special
districts to allow the governing body to call an election to allocate the sales tax in the
most beneficial way to that particular government. The Town must stay within the 2%
overall cap, but it allows a myriad of possibilities within the overall cap.
Senate Bill 1760 requires governments that are proposing a tax rate above the effective
tax rate to do so with a minimum of 60% approval. For Trophy Club five of the seven
Council members must vote in favor of a proposed tax rate in order to ratify that rate.
In addition, the bill requires additional language be added to notices and ballots when a
tax rate exceeding the effective rate is proposed. The required language must state
what the additional tax revenue is to be used to fund.

financial condition as exhibited by higher than anticipated general fund revenues in multiple

Dear Town Council,
At the midpoint of the Town of Trophy Club’s Fiscal Year, Town Management presents the
Fiscal Year 2016 Mid-Year Financial Report. The report contains summary information regarding
st
the financial status of the Town’s funds. Through March 31, the Town has received 77% of the
budgeted revenues in the General Fund, while expenditures total only 43% of the budgeted
amount.
For the General Fund, Property Tax revenues are 98% received through March 2016. Revenues
for Sales Tax, as well as Licenses and Permits, are exceeding their respective budgets. Franchise
Fees are 29% received mainly due to the annual Oncor electric payment (which represents 38%
of the budget in this category) that is scheduled for receipt in May. Fines and fees are only at
18% of budgeted revenues which is primarily due to recreational fees (which represent 66% of
the budget in this category) that will not start generating revenue until the summer months.
Charges for Service are at 30% of the budgeted amount due to delayed payment from NISD
funding the Town’s Student Resource Officers (which represents 39% of the budget in this
category).
Expenditures overall are mostly consistent with the budget. Departmental slight overages
include Human Resources at 40% remaining budget due to employee relations and benefits
consulting spending, as well as Facilities Maintenance at 31% remaining budget due to annual
insurance prepayment that was lower than the budgeted amount.
All other funds are proportionate to the budget with the exception of Trophy Club Park. The
revenues are only 8% received which can be attributed to the closed status of the park while it
is under repair from last year’s flood. The expenditures, however, underbudget thus far in the
year at 69% remaining.
The Town staff will continue to be exercise discipline in the utilization of tax dollars while
deliver the best service possible. As always our organization will continue to make Trophy
Club “a great place to call home!”

Agenda Item:
Consider and take appropriate action regarding an Ordinance amending various provisions of
Article 2.01, “General Provisions” of Chapter 2, “Animal Control” of the Town of Trophy Club
Code of Ordinances adopting provisions regulating the keeping of Fowl within the Town;
providing a penalty not to exceed $2,000 for each offense; and providing an effective date
(Staff).
Explanation:
The Trophy Club Animal Shelter Advisory Board and the Animal Control Officer have reviewed
and amended the Animal Control Ordinance as it pertains to the following areas:
Added to Section 2.01.001 Definitions:
Coop. An enclosure in which Fowl are confined.
Fowl. Chickens, turkeys, pheasants, peacocks, quail, geese, ducks, or similar feathered
anumals, regardless of age, sex, or breed, excluding Roosters.
Added toSection 2.01.020 Special Requirements for Keeping Miniature Pigs, Ferreta, and Fowls:
(3) Coop Required – Permit Required for Maximum Size. A permit shall be required for the
construction of a Coop. Fowl shall be secured in a Coop at all times, in order to provide safe
and healthy living conditions for the animals and to minimize negative impact on neighbors.
It shall be unlawful for a Person to keep, harbor, maintain, or allow Fowl to roam at large,
whether upon property owned by the Person owning, controlling, keeping, harboring, or
maintaining the Fowl or upon the property owned by another Person. The maximum size
of a Coop shall be of one-hundred and twenty (120) square feet. The Coop shall be
enclosed on all sides, shall include a roof, and all openings shall be covered with predator
and bird proof wire. It is not required that the Coop contain any masonry materials.

(5) Nuisance. It shall be unlawful for any Person who owns, controls, has custody of, keeps,
maintains, or harbors Fowl to intentionally, knowingly or recklessly cause, allow, or
maintain property, including but not limited to yards, pens, sheds, Coops, or other
enclosures in which Fowl are confined, in such a manner as to give off odors offensive to
persons of ordinary sensibilities residing in the vicinity; or in such condition as to attract
flies, mosquitoes or other noxious insects or rodents and/or the breeding of flies,
mosquitoes or other noxious insects or rodents; or in any manner or condition that
endangers the public health, safety or welfare, or creates a public nuisance as defined
herein or by state law; or to cause or allow the encroachment of associated debris of any
nature or feces across any property line.

AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS;
AMENDING SECTION2.01.001,“DEFINITIONS”, ANDADDING
SUBSECTION “(c)” ENTITLED, “FOWL” TO SECTION2.01.020AND
AMENDING THE TITLE OF SECTION 2.01.020 TO BE ENTITLED
“SPECIAL REQUIREMENTS FOR KEEPING MINIATURE PIGS,
FERRETSAND FOWL” OF ARTICLE 2.01, “GENERAL PROVISIONS”
OF CHAPTER 2, “ANIMAL CONTROL” OF THE TOWN OF TROPHY
CLUB CODE OF ORDINANCES; PROVIDING FOR THE
INCORPORATION OF PREMISES, PROVIDING FOR AMENDMENTS;
PROVIDING A CUMULATIVE REPEALER CLAUSE; PROVIDING A
SEVERABILITYCLAUSE; PROVIDING FOR ENGROSSMENT AND
ENROLLMENT;PROVIDING A MISDEMEANOR PENALTY NOT TO
EXCEED THE SUM OF TWO THOUSANDDOLLARS ($2000.00) FOR
EACH OFFENSEAND A SEPARATE OFFENSE SHALL BE DEEMED
COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION
OCCURS OR CONTINUES; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,
the Town Council of the Town of Trophy Club, Texas (the “Town”) is
a home rule municipality empowered to do all acts and make all regulations which may
be necessary or expedient for the promotion of the public health, safety and general
welfare; and
WHEREAS
, the Town Council of the Town of Trophy Club, Texas (the “Town”) is
authorized to adopt ordinances as necessary to protect the public health, safety and
welfare; and
WHEREAS
, the Town Council has adopted Article 2.01, entitled “General
Provisions” of Chapter 2, entitled “Animal Control” of the Town of Trophy Club Code of
Ordinances in an effort to regulate the keeping of various animals within the Town; and
WHEREAS
, in an effort to address the keeping of chickens and other fowl upon
properties located within the Town, and to implement regulations to safeguard the public
health, safety and welfare, the Town Council has determined itnecessary to amend
various sections of Article 2.01of Chapter 2, of the Town of Trophy Club Code of
Ordinances in order to regulate the keeping of fowl within the corporate limits of the
Town; and
WHEREAS
, the Town Council hereby finds and declares that it is in the interest
of the public health, safety and general welfare to establish the regulations set forth in
this ordinance for the control of chickens and other types of fowl within the corporate
limits of the Town of Trophy Club; and

WHEREAS
, theTown Council of the Town of Trophy Club, Texas, hereby adopts
this Ordinance amending Article 2.01, “General Provisions” of Chapter 2, “Animal
Control” to add definitions to Section 2.01.001, “Definitions”, to amend the title of
Section 2.01.020so that it is entitled “Special Requirements for Keeping Miniature Pigs,
Ferrets, and Fowl”; and to add Subsection “(c)”, “Fowl” to Section 2.01.020in order to
adopt specific regulations relative to the keeping of chickens and other fowl within the
Town.
NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
SECTION 1.
INCORPORATION OF PREMISES
All of the above and forgoing premises are true and correct and are hereby
incorporated in the body of this Ordinance as if fully set forth herein.
SECTION 2.
AMENDMENT
2.01
Section 2.01.001 entitled “Definitions” of Article 2.01, entitled “General
Provisions” of Chapter 2, entitled “Animal Control”, of the Town of Trophy Club Code of
Ordinances is hereby amended so that the definition of “Coop”, “Fowl,” and “Prohibited
Animals” shall be read as follows in their entirety, with the remaining definitions not
specifically amended hereby continuing in full force and effect:

Prohibited Animals. Shall mean an animal not normally considered domesticated
including, but not limited to, venomous lizard, poisonous snake, boa, python,
raccoon, skunk, fox, bear, elephant, kangaroo, monkey, chimpanzee, antelope,
deer, any protected, threatened, or endangered species as defined by the Texas
Wildlife Commission and the U.S. Fish and Wildlife Service, or any other Wild
Animal capable of, or inflicted to do, serious bodily harm to humans or other
animals of any kind.”

2.02
Section 2.01.020, entitled “Special Requirements for Keeping Miniature Pigs and
Ferrets” of Article 2.01, entitled “General Provisions” of Chapter 2, entitled “Animal
Control”, is hereby amended so that the title of Section 2.01.020 shall be entitled
“Special Requirements for Keeping Miniature Pigs, Ferrets, and Fowl” and so that
subsection “(c)”, entitled “Fowl” is added and shall be read in its entirety as set forth
below with all provisions not expressly amendedherebyremaining in full force and
effect:
“CHAPTER 2 ANIMAL CONTROL

ARTICLE 2.01GENERAL PROVISIONS

Section 2.01.020Special Requirements for Keeping Miniature Pigs, Ferrets,
and Fowl
. . .
(c)Fowl.
(1)Location and Maximum Number. Fowl shall only be allowed on property
zoned for single-family residential use. It shall be unlawful for any Person
to keep, harbor, maintain, or allow more than four (4) Fowl of any species
six (6) months of age or older upon property owned, leased or controlled
by such Person within the corporate limits of the Town of Trophy Club.
(2)Roosters Prohibited. It shall be unlawful for any Person to own, control,
keep, harbor, maintain, or allow one (1) or more Roosters upon property
owned, leased, or controlled by such Person within the corporate limits of
the Town of Trophy Club.
(3)Coop Required– Permit Required for Maximum Size.A permit shall be
required for the construction of a Coop. Fowl shall be secured in a Coop
at all times, in order to provide safe and healthy living conditions for the
animals and to minimize negative impact on neighbors. It shall be
unlawful for a Person to keep, harbor, maintain, or allow Fowl to roam at

(4)Location and Other Requirements for Coops. A Coop shall comply with
the following requirements. A Coop shall:
Be a minimum of twenty feet (20’) from any street right-of-way; and

Be located a minimum of ten feet (10’) from rear and side lot lines; and
Not be located in any front or side yard(s); and
Be fully screened from public view in accordance with applicable Town
regulations.
(5)Nuisance. It shall be unlawful for any Person who owns, controls, has
custody of, keeps, maintains, or harbors Fowl to intentionally, knowingly or
recklessly cause, allow, or maintain property, including but not limited to
yards, pens, sheds, Coops, or other enclosures in which Fowl are
confined, in such a manner as to give off odors offensive to personsof
ordinary sensibilities residing in the vicinity; or in such condition as to
attract flies, mosquitoes or other noxious insects or rodents and/or the
breeding of flies, mosquitoes or other noxious insects or rodents; or in
any manner or condition that endangers the public health, safety or
welfare, or creates a public nuisance as defined herein or by state law; or
to cause or allow the encroachment of associated debris of any nature or
feces across any property line.”
SECTION 3.
SAVINGS AND REPEALER
That this Ordinance shall be cumulative of all other Ordinances of the Town
affecting animals and Animal Control and shall not repeal any of the provisions of such
Ordinances except in those instances where provisions of those Ordinances are in
direct conflict with the provisions of this Ordinance; whether such Ordinances are
codified or uncodified, and all other provisions of the Ordinances of the Town of Trophy
Club, codified or uncodified, not in conflict with the provisions of this Ordinance, shall
remain in full force and effect. Notwithstanding the foregoing, any complaint, action,
cause of action or claim which prior to the effective date of this Ordinance has been
initiated or has arisen under or pursuant to such repealed Ordinance(s) shall continue to
be governed by the provisions of that Ordinance and for that purpose the Ordinance
shall be deemed to remain and continue in full force and effect.
SECTION 4.
SEVERABILITY
If any section, article, paragraph, sentence, clause, phrase or word in this
Ordinance, or its application to any person or circumstance is held invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of this Ordinance; and the Town Council hereby
declares it would have passed such remaining portions of the Ordinance despite such
invalidity, which remaining portions shall remain in full force and effect.

SECTION 5.
ENGROSSMENT AND ENROLLMENT
The Town Secretary of the Town of Trophy Club is hereby directed to engross
and enroll this Ordinance in accordance with the Home Rule Charter of the Town.
SECTION 6.
PENALTY
It shall be unlawful for any person to violate any provision of this Ordinance, and
any person intentionally, knowingly or recklessly violating or failing to comply with any
provision of this Ordinance shall be fined, upon conviction, not less than One Dollar
($1.00) nor more than Two Thousand Dollars ($2,000.00), and a separate offense shall
be deemed committed upon each day during or on which a violation occurs or
continues. This remedy shall be cumulative of all other remedies allowed by law.
SECTION 7.
EFFECTIVE DATE
This Ordinance shall become effective from and after its date of adoption and
publication as provided by law, and it is so ordained.
