ACKNOWLEDGING THIS ORDER CANVASSING PROPOSITION NO. 2
AND DECLARING THE TROPHY CLUB CRIME CONTROL AND
PREVENTION DISTRICT CREATED;PROVIDING FOR THE
INCORPORATION OF PREMISES; PROVIDING FOR THE
CONFIRMATION OF VOTE TABULATIONS; PROVIDING FOR
ENACTMENT OF THE PROPOSITION;PROVIDING FOR THE
ISSUANCE OF CANVASS OF JOINT SPECIAL ELECTION;
PROVIDING A DECLARATION OF CREATION OF THE DISTRICT;
PROVIDING FOR SEVERABILITY; PROVIDING FOR ENGROSSMENT
AND ENROLLMENT; AND PROVDING AN EFFECTIVE DATE.
WHEREAS
,the Temporary Directors of the proposed Trophy Club Crime Control
and Prevention District (hereinafter “Directors”) convened in an open public meeting on
February 20, 2013 and pursuant to Section 363.054 of the Texas Local Government
Code adopted an Order to call a Special Election on May 11, 2013 for the purpose of
creating the Trophy Club Crime Control and Prevention District; and
WHEREAS
, subsequent to the Temporary Board’s issuance of its Order of
Election and pursuant to the Board’s request, the Trophy Club Town Council included
Proposition No. 2 for the creation of the Trophy Club Crime Control and Prevention
Temporary Crime Control & Prevention DistrictPage 4 of 17May 20, 2013
District and the levy of a local sales and use tax at a rate of one-fourth of one-percent
on the Town’s May 11, 2013 ballot as part of a Joint Special Election; and
WHEREAS
,prior to calling the May, 2013 election, the Directors complied with all
notice and hearing requirements of Chapter 363 of the Texas Local Government Code
and developed a proposed two year Crime Control Plan and a proposed Two Year
Budget Plan to fund the strategies and initiatives of the adopted crime control plan
through the levy of a local sales and use tax at a rate of one-fourth of one percent; and
WHEREAS
,Section 363.059 of the Texas Local Government Code provides that
if a majority of the votes cast at an election favor the creation of a District, the
Temporary Directors shall meet and canvas the returns of the election and
subsequently issue an order declaring the District created; and
WHEREAS
, the Temporary Directors of the proposed District is the authority
empowered tocanvass the results of the May 11, 2013 election pursuant to Section
363.059 of the Texas Local Government Code, and upon canvassing election results
evidencing that a majority of the votes castat the May 11, 2013 election were in favor of
the creation of the district, the Temprorary Board is required to issue an order declaring
the proposed Trophy Club Crime Control and Prevention District created; and
WHEREAS
,because theTown of Trophy Clubplaced Proposition No. 2 on its
May 11, 2013 ballot, the Temporary Directors hereby request that the Town include the
results of the May 11, 2013 election for Proposition No. 2 on its canvassing ordinance;
and
WHEREAS
, the returns of the Special Election, including the returns of the early voting
ballots, duly and legally made, showed that each Proposition received the following votes:

The creation of the Trophy Club Crime Control and Prevention District
dedicated to Crime Reduction Programs and the adoption of a proposed local
sales and use Tax at a rate of one-fourth of one percent.

NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHYCLUB, TEXAS:
Section 1.Incorporation of Premises.The above and foregoing premises are
true and correct and are incorporated into the body of this Orderand made a part hereof
for all purposes.
Section 2.Confirmation of Vote Tabulations.The resultsof the Joint Special
Temporary Crime Control & Prevention DistrictPage 5 of 17May 20, 2013
Election, as related to theSpecial Election on a measure to create the Trophy Club
Crime Control and Prevention District and adopting a local sales and use tax of one-
fourth of one-percentand as canvassed and tabulated above, reflect the expressed
desires of the resident, qualified voters of the Town. In accordance with the canvass
and tabulation of the results of the Joint Special Election, the Temporary Board hereby
declares that Proposition No. 2 received the following votes:

Section 3. Enactment of Proposition.In accordance with the canvass and
tabulation of the results of the Joint Special Electionon Proposition No. 2 and consistent
with the Section 363.059 of Texas Local Government Code and the Texas Election
Code, Proposition No. 2 has been duly enacted pursuant to the canvass, tabulation, and
Election Order for Proposition No. 2 as set forth herein, and the Temporary Directors
hereby enter this Order canvassing the May 11, 2013 election results.
Section 4.Issuance of Canvass of Joint Special Election.The Chair of the
Temporary Board is hereby authorized and directed to execute and deliver the Canvass
of the Joint Special Election, a copy of which is attached hereto as Exhibit “A”, in
accordance with the election laws of the State of Texas, and to take all other action
necessary in connection therewith.
Section 5.Declaration of Creation of District. Having duly canvassed the results
of the May 11, 2013 election and having found that the majority of votes cast at that
election favored the creation of the Trophy Club Crime Control and Prevention District,
the Board hereby declares the Trophy Club Crime Control and Prevention District
created.
Section 6.Severability.If any section, article, paragraph, sentence, clause,
phrase or word in this Ordinance or application thereof to any person or circumstance is
held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall
not affect the validity of the remaining portions of this Ordinance, and the Town Council
hereby declares it would have passed such remaining portions of this Ordinance despite
such invalidity, which remaining portions shall remain in full force and effect.

Section 7. Engrossment and Enrollment.
Trophy Club is hereby directed to engross and enroll this Orderin the official records of
the Town
Section 8.Effective Date.This Order shall take effect upon adoptionas
authorized by law.

CONSIDERANDO QUE
,posterior a laemisión por parte de la Junta Temporal, de
la Orden de Elección y de acuerdo con la petición de la Junta, el Concilio del Poblado
deTrophy Club incluyó laProposiciónNo. 2 para la creación delDistrito para la
Prevención y Control del Crimen de Trophy Cluby la recaudación de un impuesto local
sobre ventas y uso a una tasa de un cuarto de uno por ciento en la balota del Poblado
del 11de mayo de 2013, como parte de la Elección Especial Conjunta y;
CONSIDERANDO QUE
,previo a la llamada a la elección de mayo de2013, los
Directores dieron cumplimiento a todos los avisos y audiencias requeridos en el
Capítulo 363 del Código de Gobierno Local de Texas y desarrollaron y un Plan
Propuestode Control del Crimen de dos años y un Plan Propuesto de un Presupuesto
de dos años para dar fondos a estrategias e iniciativas del planadoptadopara control
del crimen, por medio de la recaudación deun impuesto local sobre ventas y uso auna
tasa de un cuarto de uno por cientoy;
CONSIDERANDO QUE
,la Sección 363.059 del Código deGobierno Local de
Texas establece que si una mayoría de votos depositados en una elección favorece la
creación de un Distrito,los Directores Temporales deben reunirse y hacer el escrutinio
del conteo de votos de la elección y posteriormente emitir una orden declarando el
Distrito creadoy;
CONSIDERANDO QUE
,los Directores Temporales del Distrito propuesto son la
autoridad facultada para hacer el escrutinio de los resultados de la elección del 11 de
mayo de 2013 de acuerdo con la Sección 363.059 del Código deGobierno Local de
Texas y,al hacer el escrutinio de la elecciónen quelos resultados evidencian que una
mayoría de los votos depositados en la elección del 11 de mayo de 2013 fueron a favor
de la creación del distrito, es requerido que la Junta Temporalemita una orden
declarando como creado el Distrito para la Prevención y Control del Crimen de Trophy
Clubpropuestoy;

por medio del presente, declara creado el Distrito para la Prevención y Control del
Crimen de Trophy Club.
Sección 6.Divisibilidad.Si una sección, artículo, párrafo, oración, cláusula,
frase opalabra en esta Ordenanza o aplicación de ella a cualquier persona o
circunstancia es considerada inválida o inconstitucional por un tribunal de jurisdicción
competente, dicha consideración no debe afectar la validez de las porciones que
permanecen de esta Ordenanza y, el Concilio del Poblado, por medio del presente,
declara que habría pasado dichas porciones que permanecen de esta Ordenanza a
pesar de dicha invalidación, de la cual, las porciones que permanecen tendrán pleno
vigor y efecto.
Sección 7. Formato legal e inscripción.La Secretaria del Poblado del Poblado
deTrophy Club es, por medio del presente instruida para que pase a formato legal e
inscriba esta Orden en los registros oficiales del Poblado.
Sección 8.Fecha de vigencia.Esta Orden entrará en vigor a partir de su
adopción de acuerdo a lo autorizado por la ley.
