ZC-15-001:Rezoning from PD to GU, Lot 4, Block B, Trophy
Wood Business Center
SUBJECT
:
Consideration of a request to rezone 5.596 acres, located in the 100 block of Trophy
Wood Drive on Lot 4, Block B in the Trophy Wood Business Center, from the PD-
Planned Development zoning district to the GU-Government Use zoning district.
REQUEST:
TheTown of Trophy Club is requesting to rezone the subject property in order to develop
the property for a new joint Town hall and police station. Per the attached drawings, the
proposed building is currently approximately 24,000 square feet (sq ft) and includes:
Approximately8,800 sq ft for the Police Department includes an animal
holding facility
Approximately 6,400 sq ft of common space lobby areas, community meeting
room, training & voting room, public restrooms and Council chambers
Approximately7,800 sq ft for Town Staff includes all Town departments,
except Fire/EMS, which will remain at the Fire Station
Over the last couple of months the Town Council has continued to work with GSBS
Architects regarding the proposed Town Hall/Police Department joint facility. No final
decisions have been made regarding the cost, design, materials, etc., however the Council
has received citizen and staff input on a preliminary master site plan, floor plan, exterior
finishes and renderings. As of the date of this briefing, the Council plans to place the
Joint Facility Project bond on the November 3, 2015 election ballot for a citizen vote.
CURRENT CONDITIONS:
The subject property contains 5.596 acres, is platted and undeveloped. The current
zoning of the property, PD 33 (attached), was approved by the Council in August 2013,
and permits 35 single family detached residential units.

PROPOSED GU ZONING:
According to Chapter 13-Zoning in the Code of Ordinances, the purpose of the GU
zoning district is as follows:
The GU Governmental Use District is established to apply to those lands where national,
state or local governmental activities are conducted and where governments hold title to
such lands. Any lawful governmental activity is permitted in these districts. It is not
intended to classify all lands owned by government into this district, but only those lands
particularly and peculiarly related to the public welfare. It is generally intended to utilize
this district to implement the Comprehensive Master Plan.

Based on the above chart, the proposed use of the property for a joint Town hall and
in the GU district.
FUTURE LAND USE:
The 1997 Trophy Club Comprehensive Land Use Plan recommends
Institutional uses such as
the proposed joint Town hall and police station are considered compatible in any future
land use category. Therefore, the proposed use conforms to this recommendation.

PUBLIC NOTICE REQUIREMENT:
Per the requirements of the State of Texas and the Trophy Club Code of Ordinances, a
notice of public hearing concerning the zoning request was published in the Fort Worth
Star Telegram. Notice was also mailed to 27 property owners within 200 feet of the
subject property.To date no correspondence has been received.
STAFF REVIEW AND RECOMMENDATION
:
The proposed development shall meet all requirements of the Code of Ordinances and
any other applicable codes adopted by the Town. Upon approval of the rezoning request,
a site plan of the proposed development shall require approval by the Town Council prior
to issuance of any building permit.
Staff recommends approval.

Section 4.18 GU – Government Use District Regulations
A.Purpose: The GU GovernmentalUseDistrict is establishedto applyto thoselands wherenational,
state or localgovernmentalactivities are conducted andwhere governmentshold titletosuch lands.

B.Uses Generally: In a GU Governmental Use District,no landshallbe used andno building shallbe
installed,erectedfor or convertedtoany useother than as set forthinSection 3.03,UseTables, and

1.AccessoryUses:Accessoryuses shall bepermittedwithinthe GU-GovernmentalUse District
in accordance with the regulations providedin Section 5.03, Accessory Structures.

3.Limitation of Uses:Any use notexpressly permittedor allowed bypermit hereinis prohibited.

1.A plat,meetingallrequirementsoftheTownof TrophyClub, has been approvedbythe Town
Council and recorded in the official records of the County in which the property is located.

notice of public hearing concerning the zoning request was published in the Fort Worth

200 feet of the subject property.To date, one letter of support has been received.

The proposed amendment meets all requirements of the PD 32 ordinance and the Code of
Ordinances. Upon approval, a replat of the two affected properties will be required.

SUBJECT

Consideration of a request for a Conditional Use Permit for a Wastewater
Treatment Facility on 10.58 acres located in the Mary Medlin Survey, Abstract 832
on Junction Way.
REQUEST:
TheTrophy Club Municipal Utility District (MUD) is requesting a conditional use permit
(CUP) in order to expand the existing wastewater treatment plant located off of Junction
Way west of Indian Creek Drive. The plant was constructed approximately 40 years ago
and was expanded ten years later, all of which was completed prior to the incorporation
of the Townin 1985. Therefore, the plant has essentially been operating as a legal-non
conforming use since the Town of Trophy has been in existence; thus, the reason for this
request.
CURRENT CONDITIONS AND ZONING:
The subject property contains 10.58 acres and is not platted. In terms of zoning, the
southern 6.589 acres is zoned GU-Government Use district and the northern 3.991 acres
is zoned CR-Commercial Recreation district. Utility facilities are only permitted within
the GU district with the approval of a CUP. Therefore, only the southern 6.589 acres of
the subject property is permitted to have a wastewater treatment plant with the approval
of a CUP.According to the site plan provided by the applicant, the existing portion of
the plant and the proposed expansion will be completely contained within the GU zoned
portion of the subject property.
According to Chapter 13-Zoning in the Code of Ordinances, the purpose of the GU
zoning district is as follows:
The GU Governmental Use District is established to apply to those lands where national,
state or local governmental activities are conducted and where governments hold title to
such lands. Any lawful governmental activity is permitted in these districts. It is not
intended to classify all lands owned by government into this district, but only those lands
particularly and peculiarly related to the public welfare. It is generally intended to utilize
this district to implement the Comprehensive Master Plan.

Based on the above chart, the proposed use of the property for a wastewater treatment
plant is permitted with the approval of a CUP utility
facilitiesncluding distribution lines in the GU district.
PLATTING AND SITE PLAN REQUIREMENT
Approval of a preliminary and final plat is required for the subject property given that it
is not platted. A preliminary plat is included for consideration as separate agenda item.
A separate site plan will require approval by the Planning & Zoning Commission and
Town Council on a future agenda.
FUTURE LAND USE:
low density
residentialInstitutional uses such as the proposed
wastewater treatment plant are considered compatible in any future land use category.
Therefore, the proposed use conforms to this recommendation.

Council the following amendments to the sign ordinance regarding political signs as follows:
Section 4.05 Temporary Signs
B. Political Signs
1. No political sign may be erected or placed on private real property, including but not
limited tovacant lots or tracts, unless the property Owner or other person or having
custody or controlover the Property, has given written permission and suc
documentation is provided to theDesignated Official upon the Official’s request. Political
signs may be erected or placed onany private lot or property or on any trailer or vehicle
as specifically described in this Section4.05 –Temporary Signs, and in accordance with
the regulations governing temporary signs
No political sign may be erected or placed on private residential property unless the
property owner has given a minimum of a verbal permission. No political sign may be
erected orplaced on commercial property without written permission from the property
owner. Suchwritten permission shall be provided to the Designated Official upon the
request of the Designated Official. No political sign may be erected or placed on public
property. A property owner may remove a sign on their property without notice.
2. Duration
All political signs may be erected or maintained in any location for a maximum period of
forty five (45) days prior to an election. Political signs shall be kept in repair and a proper
state of preservation. All political signs shall be removed no later than ten (10) days
following the date of an election or a run-off election.

2.Number, Size and Placement:
A political sign shall not exceed thirty-sixsixteen(1636) square feet in area nor exceed six
. A political sign may not be illuminated or
(6)feet in height, as measured from the ground
haveany moving elements. No more than one (1) of such signs for each political
candidate andtwo signs perone sign for each side of anissue on the election ballot shall
be erected on anyparcel of land. As used in this section “parcel” shall mean a piece of
land having fixedboundaries, whether those boundaries are fixed by plat or by metes and
bounds.
The front and back surface of a political sign shall constitute one sign. For signs with
three ormore surfaces, each surface shall constitute a separate sign for purposes of size
requirements. Signs with three or more surfaces are prohibited on residentially zoned
parcelsof land.Signs with three or more surfaces are prohibited.

3.In the event that the number of political signs upon a lot or property exceeds the total
numberpermitted by this Article, the signs in excess of the number permitted shall be
deemed to be inviolation of this Article. The Designated Official shall notify the property
owner on which thepolitical signs are located of the violation; the property Owner must
then remove the signs inexcess of the permitted amount within twenty-four (24) hours
following the time of suchnotification.
The Designated Official is hereby authorized to remove without notice any political sign
that iserected or placed on public property, including medians, and right-of-ways. Such
sign shall beimpounded and may be destroyed by the Town.

4.Removal Period
Procedure in Event of Non-Removal
All political signs shall be removed within a period not to exceed tenthree(103) days after
thedate of the election for which the sign was placed. Failure to remove such signs
within thetenthree(103) day period shall give the Designated Official the authority to
remove suchsigns.

5.Vehicle Mounted Political Signs:
A political sign which is mounted or placed on any trailer or vehicle and which is not
permanently affixed to the trailer or vehicle is permitted. A vehicle with such a sign may
beparked on a public street in accordance with the Town’s parking regulations. For
purposes ofthis paragraph, a political sign is not required to be supported by the ground.

6.Zoning Districts
Political signs shall be allowed in all zoning districts of the Town.

7.Exemptions
Political signs shall not require a sign permit, and except as regulated by this Section, are
exempt from the remainder of the regulations contained in this Article.

1.That Section 3a in Exhibit “A” be deleted with the opening paragraph in Section 3 amended to read as follows:
“Minor changes of details within a site plan, which do not create a significant change to the physical and
aesthetic character to a previously approved site plan as approved by the Town Council, may be authorized by
the Town Manager or their designee when such minor changes will not cause any of the following
circumstances to occur:”
2.That the following language be added by staff: “No change may be granted by staff that would, otherwise,
require the approval of a variance or waiver to any code or zoning district requirement”.

SUBJECT
:
Discussion and recommendation regarding a request for approval of a Site Plan for
Meat-U-Anywhere B-B-Q Restaurant, Trophy Club Drive, Lot 3, The Village,
Trophy Club, TX
REQUEST:
The applicant has submitted a site plan in order to open a bar-b-que restaurant called
“Meat-U-Anywhere”. The restaurant will be a casual restaurant with no drive-through
service and no sale of alcohol for on-premise consumption.
ZONING:
The property is zoned PD-Planned Development District and is located within PD 13.
PD 13 was originally approved by Ordinance 95-20 on November 21, 1995. The
proposed use is permitted within this zoning district.
CURRENT CONDITIONS:
The subject property contains 1.6 acres and is undeveloped.The property is platted as
part of The Village subdivision.
SITE DETAILS:
The following is a breakdown of the development:
Building Gross Floor Area: 7.098 square feet
Total Parking: 72 spaces
The site plan, landscape plan and building elevations comply with the requirements of PD
13 and the Code of Ordinances. Signage will be reviewed and approved administratively.
Any signage waivers will require separate approval by the Town Council.

:
The proposed restaurant development complies with all requirements of the Code of
Ordinances and PD 13.

PP-15-028:Preliminary Plat for Trophy Club MUD
Wastewater Treatment Plant
SUBJECT
:
Consideration of a request for approval of a Preliminary Plat of Trophy Club
Municipal Utility District Wastewater Treatment Facility, Trophy Club, TX
REQUEST:
TheTrophy Club Municipal Utility District (MUD) is requesting a preliminary plat of
10.58 acres owned by the MUD in order to expand the existing wastewater treatment
plant located off of Junction Way west of Indian Creek Drive. The plant was constructed
approximately 40 years ago and was expanded ten years later, all of which was
completed prior to the incorporation of the Townin 1985. Therefore, the plant has
essentially been operatingas a legal-non conforming use since the Town of Trophy has
been in existence.
CURRENT CONDITIONS AND ZONING:
The subject property contains 10.58 acres and is not platted. In terms of zoning, the
southern 6.589 acres is zoned GU-Government Use district and the northern 3.991 acres
is zoned CR-Commercial Recreation district. Utility facilities are only permitted within
the GU district with the approval of a CUP. The preliminary plat includes all property
(10.58 acres) owned by the MUD
PLATTING PROCEDURE
Approval of a preliminary and final plat is required for the subject property given that it
is not platted. According to Chapter 12-Subdivision Rules and Regulations in the Code
of Ordinances, preliminary plats and final plats must be considered separately.
Therefore, the final plat will follow on a separate agenda.
If the Planning & Zoning Commission approves the plat it will then be forwarded to the
Town Council for final approval. If the Planning & Zoning Commission denies the
preliminary plat the process is then completed, the preliminary plat does not go to the
Town Council for consideration and the applicant must submit a new preliminary plat
application and fee in order for the plat to be considered again.

RIGHT-OF-WAY DEDICATION, ROADWAY CONSTRUCTION
REQUIREMENTS
Chapter 12-Subdivision Rules and Regulations in the Code of Ordinances requires that all
lots must have frontage along a public street. The subject property is landlocked and
currently derives sole access from a 30 foot wide road easement that links to Junction
Way. Therefore, as part of the platting process, the applicant is required to dedicate
sufficient right-of-way (ROW) in order to accommodate construction of the required
public street. In the case of the subject property, the ROW dedication requirement is
based on a scenario where Junction Way is extended to the west along the subject
property. Junction Way contains 50 feet of ROW. Since any extension of Junction Way
would run along the southern portion of the subject property, under State law, the
applicant (developer) is only required to dedicate (and construct) their half of the road.
Therefore, the applicant must dedicate 25 feet of ROW and construct one-half (13.5 of
pavement width) of the roadway. The following diagram shows the required cross-
section for a 50 foot street as shown in the Code of Ordinances:
In terms of future roadway construction requirements, the Master Thoroughfare Plan
contained within the 1997 Comprehensive Land Use Plan shows Indian Creek Drive and
Trophy Club Drive connecting. This connection is also shown on the latest version of the
North Central Texas Council of Governments (NCTCOG) Regional Mobility Plan.
However, when the adjacent development to the east where Indian Creek Drive
terminates, PD 31-Canterbury Hills, was approved, it did not account for a connection
between the two roads. Therefore, the only option remaining for a connection involves
an extension of Junction Way.
The attached plat does not indicate the required ROW dedication as the applicant is
requesting a waiver to this requirement as detailed below.
WAIVER REQUESTS
Per Exhibit B, the applicant is requesting a waiver to the ROW dedication and roadway
construction requirement described above along with other waivers that are not pertinent
to the platting process. The applicant mentions security concerns, building
encroachments and site constraints as reasons for the waiver request.

The Planning and Zoning Commission has the authority to approve the plat with the
waivers, which would then be forwarded to the Town Council for final approval. Upon
submittal of the final plat, the waivers would then be approved consistent with the
preliminary plat with final plat, including the waivers, filed with the Denton County
Clerk.
STAFF REVIEW AND RECOMMENDATION
:
Given the expansion to the plant, the property must be platted. The plant was initially
constructed prior to being annexed into the Town. As part of the requirements for
platting, ROW dedication and roadway construction are required along the southern
portion of the property. The applicant is requesting a waiver to these requirements.
While many of the points made by the applicant in considering the waiver request are
rational, as is standard with any plat waiver request, staff must recommend denial given
the technical non-compliance with the subdivision regulations.
Staff recommends denial of the plat due to technical non-compliance with Chapter 12-
Subdivision Rules and Regulations in the Code of Ordinances.

SUBJECT

Discussion and recommendation regarding an amendment to the approved Site Plan
for Lots 1 and 2, Block A, Wonderland Plaza Addition, Case SP-15-031
REQUEST:
The applicant, Savi Management Company, is requesting an amendment to the approved
site plan for the subject property. The amendment involves changes to the building size,
layout and square footage breakdowns. No other changes are proposed to the site plan,
landscape plan or building elevations.
PROPOSED AMENDMENTS:
The gross floor area (GFA) of the retail building has increased from 17,272
square feet to 19,114 square feet
Therestaurant GFA has been reduced from 6,000 square feet to 5,514 square feet
the retail GFA has increased from 11,272 square feet to 13,600 square feet.
The site plan approved by the Town Council (attached) showed three separate
retail buildings. Therevised site plan combines the three buildings into one.
Required parking has increased from 110 to 117, although the total parking
provided has not changed.
The changes to the GFA meet the parking requirements of Chapter 13-Zoning in the
Code of Ordinances.
STAFF REVIEW AND RECOMMENDATION
:
The proposed amendments comply with the requirements of PD 27 and the Code of
Ordinances.
