ORDINANCE NO. 0 87-16
AN ORDINANCE OF THE TOWN OF TROPHY CLUB,
TEXAS AMENDING ORDINANCE NO. 86-18 OF THE
TOWN RELATING TO SWIMMING POOLS BY REQUIRING
THAT WATER IN ALL SWIMMING POOLS BE OF
SUFFICIENT CLARITY SUCH THAT THE BOTTOM OF
THE SWIMMING POOL IS VISIBLE; REQUIRING THAT
EACH SWIMMING POOL HAVE MINIMUM FEE RESIDUAL
CHLORINE OF ONE (1) PART PER MILLION AND
THAT THERE BE NO ACID REACTION TO A STANDARD
PH TEST; PROVIDING THAT SWIMMING POOLS
CONSTRUCTED PRIOR TO THE EFFECTIVE DATE OF
THIS ORDINANCE SHALL COMPLY WITH THE
AMENDMENT TO ORDINANCE NO. 86-18 ON OR
BEFORE August 15, , 1987 ; PROVIDING
A SAVINGS CLAUSE; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY
CLUB, TEXAS:
Section 1. That Ordinance No. 86-18 is hereby amended
in the following particulars, and that all other sections,
subsections, paragraphs, sentences, phrases and words in said
Ordinance are not amended but are hereby ratified, verified,
approved and affirmed:
A. That a new section 10.A. be added to read as
follows:
"10.A. The water in all swimming pools
within the Town, public or private, shall be
of sufficient clarity such that the bottom
of the swimming pool is visible to the naked
eye. In order to help achieve this
objective, each swimming pool shall have
minimum fee residual chlorine of one (1)
part per million. In addition, no swimming
pool water shall have an acid reaction to a
standard pH test."
Section 2. That water in swimming pools constructed
prior to the effective date of this ordinance shall comply with
the terms of the amendment to Ordinance No. 86-18 on or
before August 115 , 1987.
Section 3. That this ordinance shall be cumulative of
all other ordinances of the Town affecting swimming pools and
shall not repeal any of the provisions of said ordinances
except in those instances where provisions of those ordinances
are indirect conflict with the provisions of this ordinance.
Section 4, if any section, article, paragraph,
sentence, clause, phrase or word in this ordinance, or
application thereto any person or circumstances is held invalid
or unconstitutional by a Court of competent jurisdiction, such
holding shall not affect the validity of the remaining portions
of this ordinance; and the Town Council hereby declares it
would have passed such remaining portions of the ordinance
despite such invalidity, which remaining portions shall remain
in full force and effect.
Section 5. That this ordinance shall be effective from
and after its date of passage as provided by law, which
effective date is the 13 _ day of July _ , 1987 .
