ORDINANCE NO. 0 87-13
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN
OF TROPHY CLUB, TEXAS PROHIBITING THE
PARKING OF VEHICLES ON AND WITHIN CERTAIN
DEFINED STREETS; REPEALING ORDINANCES NO.
65-22 AND 65-14 OF THE TOWN OF TROPHY CLUB;
PROVIDING A PENALTY NOT TO EXCEED THE SUM OF
TWO HUNDRED DOLLARS (200.00) FOR EACH
OFFENSE AND A SEPARATE OFFENSE SHALL BE
DEEMED COMMITTED UPON EACH DAY DURING OR ON
WHICH A VIOLATION OCCURS; PROVIDING A
SAVINGS CLAUSE; PROVIDING A SEVERABILITY
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY
CLUB, TEXAS:
Section 1. The following definitions shall apply to
this Ordinance:
A. Motor Vehicle: Every vehicle which is self
propelled.
B. Recreational Vehicle: Self propelled living
quarters equipped or used for sleeping and eating which may be
moved from one location to another over a public street.
C. Trailer: Every vehicle without motive power
designed or used for carrying property or passengers wholly on
its own structure and to be drawn by a motor vehicle.
Section 2. Parking of Vehicles - Prohibited.
It shall be unlawful for any person, driver, operator or
owner to leave, park or stand any motor vehicle, mobile home,
motor home, recreational vehicle, trailer or boat upon the
following portions of the specified public streets located
within the Town:
a. Indian Creek between the intersection of Trophy
Club Drive and Heritage Court;
b. Trophy Club Drive from its intersection with
Indian Creek Drive to the most westerly line
extended of the cemetery that fronts on Trophy
Club Drive.
C. Along the south bound and west bound lane of
Indian Creek Drive between Timberline Drive and
Hillcrest Court.
d. Along both sides of Trophy Lake Drive from State
Highway 114 to Trophy Club Drive.
e. Along the south side of the entire length of
Fairway Village Drive.
f. Along the south side of the entire length of
Summit Cove Drive.
Section 3. All emergency vehicles shall be exempt from
the restrictions as set forth in Section 2. Emergency vehicles
shall include ambulances, fire trucks and equipment, police
vehicles and all governmental vehicles used for necessary
governmental purposes.
Section 4. That it shall be unlawful for any person to
violate any provision of this ordinance, and any person
violating any provision of this ordinance shall be deemed
guilty of a misdemeanor and upon conviction thereof shall be
subject to a fine in an amount not less than One Dollar ($1.00)
nor more than Two Hundred Dollars (200.00), and a separate
offense shall be deemed committed upon each day during or on
which a violation occurs or continues.
Section 5. That ordinance shall be cumulative of all
other ordinances of the Town affecting traffic and streets, and
shall not repeal, except as provided in Section 6, any of the
provisions of said ordinances except in those instances where
provisions of those ordinances are in direct conflict with the
provisions of this ordinance.
Section 6. Ordinances No. 85-22 and 8614 of the Town
of Trophy Club are hereby expressly repealed.
Section 7. if any section, article, paragraph,
sentence, clause, phrase or word in this Ordinance or
application thereto any person or circumstance is held invalid
or unconstitutional by a Court of competent jurisdiction such
holding shall not affect the validity of the remaining portions
of the Ordinance; and the Town Council hereby declares it would
have passed such remaining portions of the Ordinance despite
such invalidity, which remaining portions shall remain in full
force and effect.
Section 8. This ordinance shall become effective from
and after the date of its passage and publication and it is
accordingly so ordained.
