AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS,
RECOGNIZING THE VOLUNTEER EMERGENCY MEDICAL
SERVICE; REQUIRING WRITTEN PROCEDURES FOR THE
OPERATION OF EMERGENCY MEDICAL SERVICE
EQUIPMENT AND FACILITIES; PROVIDING FOR THE
ALLOCATION OF EQUIPMENT AND SPACE; PROVIDING
FOR PROFESSIONAL FEES; OUTLINING FINANCIAL
PROCEDURES, USE OF TOWN SUPPLIES, ISSUANCE OF
DIRECTIVES AND BUDGETARY PROVISIONS; PROVIDING
FOR THE FORFEITURE OF MEMBERSHIP RIGHTS IN THE
EMERGENCY MEDICAL SERVICE; AUTHORIZING THE
ISSUANCE OF BADGES; PROVIDING THE TOWN COUNCIL
WITH DISCRETION REGARDING DISABILITY RELIEF;
PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE OF ALL ORDINANCES OF THE TOWN
EXCEPT TO THE EXTENT OF CONFLICT HEREWITH;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Town Council of the Town of Trophy Club, Texas (the "Town")
desires to insure continued emergency medical service for the citizens of the Town;
and
WHEREAS, the Town Council desires to ensure a harmonious working
relationship between the Town and the Trophy Club Emergency Medical Service; and
WHEREAS, the Town must maintain proper books and records and must
utilize accepted legal financial practices; and
WHEREAS, the Town Council finds that including the Emergency Medical
Service as a part of the Town is in the best interest of the health, safety and
welfare of the citizens of the Town.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
Section 1. EmeEgency EmergencyMedical Service. That the Trophy Club Emergency
Medical Service ("EMS") shall be the major emergency medical organization within
the Town. The EMS is an autonomous volunteer organization entrusted by the Town
Council with the responsibility for providing emergency medical services within the
Town. The EMS shall select its own officers, enact a constitution and bylaws, and
establish procedures which regulate and define the scope and procedures of the EMS,
consistent with the emergency medical needs of the Town. The EMS shall file and
keep current with the Town Secretary a constitution and any bylaws, rules and
regulations pertaining to the EMS.

Section 2. Emergency Medical Services Board. There is hereby established a
governing board, called the Emergency Medical Services Board (the "Board"), to
promote cooperation and efficient operation of all emergency medical services. The
Board shall be composed of the Mayor, EMS chief, an emergency medical service
volunteer and two citizens as recommended by the EMS and confirmed by the Town
Council.
Section 3. Procedures. The Board shall formulate and draft written
procedures for the operation of emergency medical service activities, which shall
include, but not be limited to, the following:
A. Coordination of notices and procedures to be used by the EMS for the
safe and efficient maintenance of emergency medical equipment;
B. Development of emergency medical notification and logging
procedures for use by the EMS;
C. A listing of all persons authorized to maintain and use emergency
medical equipment and equipment related thereto;
D. Procedures to be used by the EMS for the submission of purchase
orders and the approval required before such purchase order is acted upon.
The above procedures and any additional procedures deemed necessary shall
be available at all times for inspection at the Town Hall, Trophy Club Municipal
Utility District Building, Trophy Club, Texas. Changes in these procedures may be
recommended by the EMS to the Board. If the Board does not approve the
recommended changes, the EMS may appeal the decision of the Board to the Town
Council. A decision by the Town Council shall be final.
Section 4. Equipment and Space Allocations. The Town Council shall
allocate space in Town facilities for the exclusive use of the EMS as shall be deemed
necessary by the Council. The emergency medical equipment and equipment related
thereto may be utilized and maintained by any authorized person. Any use of Town
owned emergency medical equipment and equipment related thereto for publicity,
parades, or public relations uses shall require prior written approval of the Town
Council. Town owned emergency medical equipment and equipment related thereto
shall not be used for private non -emergency purposes. All emergency eyk
medical equipment shall be the property of the Town.
Section 5. Professional Fees. The Town Council recognizes the need for a
well-trained, state certified volunteer Emergency Medical Service. Towards that
end, the Town Council shall, during its budget period, set aside funds for the training
of EMS members.
Section 6. Financial Procedures.
A. The Town Secretary shall establish concise, written procedures for
disbursement of Town funds budgeted for emergency medical services. The Town
Secretary shall have the authority to turn down any purchase order or request for
funds if said purchase:

1. Utilizes improper or illegal procedures; or
2. Has not been previously included in the budget approved by the
Town Council; or
3. Is not in the best interest of the Town as a whole.
The Town Secretary shall notify the Chief of the EMS as soon as practicable
of any rejected purchase order.
B. As a volunteer organization, the EMS may appeal any financial
decision made by the Town Secretary. Such an appeal shall be in writing and signed
by the EMS Chief. The appeal shall be given to the Mayor for his action. If the
Mayor's action is not satisfactory, the Chief of the EMS may then present its appeal
to the Town Council for a final decision.
Section 7. Training of Authorized Persons. The Town shall strive to ensure
that all persons authorized to use emergency medical equipment and equipment
related thereto, are trained in the proper use of such equipment.
Section 8. Emergency Medical Service Budget. The EMS Chief shall make a
recommendation to the Town Council with regard to the Budget for emergency
medical service activities.
Section 9. Forfeiture of Rights. Any member of the EMS failing or refusing
to comply with the bylaws, rules and regulations adopted by the EMS or herein
provided for, shall forfeit his rights derived from membership in the EMS, and the
use of the apparatus in his charge. Such apparatus shall be taken charge of by the
Chief of the EMS until such member or members shall comply with the rules and
regulations.
Section 10. Badges. The Town Council shall provide each member of the
EMS a badge descriptive of the office in which the said member is serving.
Section 11. Disahility Provisions. The Town Council may, within its sole
discretion, provide for the relief of members of the EMS temporarily or permanently
disabled in the discharge of their duties; and shall have the right to provide for the
old, disabled and infirm members of said EMS under such system, rules and
regulations, as may be deemed advisable whenever the finances of the Town will
justify the undertaking of this service and subject to the laws of the State of Texas.
Section 12. Repeal of Conflicting Ordinances. That this ordinance shall be
cumulative of all other ordinances of the Town affecting emergency medical
activities and shall not repeal any of the provisions of said ordinances except in
those instances where provisions of those ordinances are in direct conflict with the
provisions of this ordinance.
Section 13. Severability. If any section, article, paragraph, sentence, clause,
phrase or word in this ordinance, or application thereto any person or circumstance
is held invalid or unconstitutional by a Court of competent jurisdiction, such holding
shall not affect the validity of the remaining portions of this ordinance; and the

Town Council hereby declares it would have passed such remaining portions of the
ordinance despite such invalidity, which remaining portions shall remain in full force
and effect.
Section 14. Emergency. The fact that the present ordinances and regulations
of the Town of Trophy Club, Texas, are indadequate to properly safeguard the
health, safety, morals, peace, and general welfare of the inhabitants of the Town of
Trophy Club, Texas, creates an emergency for the immediate preservation of the
public business, property, health, safety, and general welfare of the public which
requires that this ordinance become effective from and after the date of its passage
and it is accordingly so ordained.
