ORDINANCE NO. 98-29 P&Z Ordinance 96-16 Ordinance 2000-06 TOWN OF TROPHY CLUB, TEXAS AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS AMENDING ORDINANCE NO. 94-09, THE SAME BEING THE COMPREHENSIVE ZONING ORDINANCE, BY: (1) ADDING A NEW PROVISION RELATING TO THE WIDTH OF LOTS ADJACENT TO A SIDE STREET TO THE FOLLOWING ZONING DISTRICTS: R-15 SINGLE FAMILY DISTRICT, R-12 SINGLE FAMILY DISTRICT, R -I1 SINGLE FAMILY DISTRICT, R-10 SINGLE FAMILY DISTRICT, R-9 SINGLE FAMILY DISTRICT, R-8 SINGLE FAMILY DISTRICT, AND MH -HUD CODE MANUFACTURED HOME AND INDUSTRIALIZED HOUSING DISTRICT, AND (2) AMENDING SECTION 35 (ACCESSORY STRUCTURES AND USES), PARAGRAPH G RELATING TO DETACHED GARAGES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town Council of the Town of Trophy Club, Texas (the "Town"), in accordance with a Comprehensive Plan, heretofore adopted a Comprehensive Zoning Ordinance for the Town, the same being Ordinance No. 94-09 (the "Comprehensive Zoning Ordinance"); and WHEREAS, the Town Council is authorized, pursuant to Chapter 211, Tex. Loc. Gov. Code (Vernon), as amended, and Section 52 of the Comprehensive Zoning Ordinance to amend the Comprehensive Zoning Ordinance; and WHEREAS, after public notices were given in compliance with State law and the Comprehensive Zoning Ordinance and public bearings were conducted, and after considering the evidence and information submitted at the said public hearing and all other relevant information and materials, the Planning and Zoning Commission of the City has recommended to the City Council the adoption of the amendments to the Comprehensive Zoning Ordinance as set forth herein; and WHEREAS, after due deliberations and consideration of the recommendation of the Planning and Zoning Commission and the evidence, information and other materials submitted and received at the public hearing and in connection therewith, the City Council has concluded that the adoption of this Ordinance is in the best interests of the City and of the public health, safety and welfare. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: -1- DOC #: 427107 Section 1. Incorporation of Premises. The above and foregoing premises are true and correct and are incorporated herein and made a part hereof for all purposes. Section 2. Amendments to Com rehensive Zoning Ordinance. Ordinance No. 94-09 of the Town of Trophy Club, Texas, the same being the Town's Comprehensive Zoning Ordinance, is hereby amended in the following particulars, and all other chapters, sections, paragraphs, sentences, phrases and words are not amended but are hereby ratified and affirmed: A. Section 14 (R-15 Single Family District Regulations) is amended by renumbering subparagraphs 10 and 11 of Paragraph F ("Area Regulations") as subparagraphs 11 and 12, respectively, and by adding a new subparagraph 10 to Paragraph F to read as follows: "10. Width of lot, feet.......... 110 feet minimum adjacent to side street (measured at front building line)" B. Section 15 (R-12 Single Family District Regulations) is amended by renumbering subparagraphs 10 and 11 of Paragraph F ("Area Regulations") as subparagraphs 11 and 12, respectively, and by adding a new subparagraph 10 to Paragraph F to read as follows: 10. Width of lot, feet.......... 110 feet minimum adjacent to side street (measured at front building line)" C. Section 16 (R-11 Single Family District Regulations) is amended by renumbering subparagraphs 10 and 11 of Paragraph F ("Area Regulations") as subparagraphs 11 and 12, respectively, and by adding a new subparagraph 10 to Paragraph F to read as follows: "10. Width of lot, feet.......... 100 feet minimum adjacent to side street (measured at front building line)" D. Section 17 (R-10 Single Family District Regulations) is amended by renumbering subparagraphs 10 and 11 of Paragraph F ("Area Regulations") as subparagraphs 11 and 12, respectively, and by adding a new subparagraph 10 to Paragraph F to read as follows: 10. Width of lot, feet.......... 95 feet minimum adjacent to side street (measured at front building line)" E. Section 18 (R-9 Single Family District Regulations) is amended by renumbering subparagraphs 10 and 11 of Paragraph F ( "Area Regulations") as subparagraphs 11 and 12, respectively, and by adding a new subparagraph 10 to Paragraph F to read as follows: -2- DOC #: 427107 "10. Width of lot, feet.......... 85 feet minimum adjacent to side street (measured at front building line)" F. Section 19 (R-8 Single Family District Regulations) is amended by renumbering subparagraphs 10 and 11 of Paragraph F ("Area Regulations") as subparagraphs 11 and 12, respectively, and by adding a new subparagraph 10 to Paragraph F to read as follows: 10. Width of lot, feet.......... 75 feet minimum adjacent to side street (measured at front building line)" G. Section 25 (MH -HUD Code Manufactured Home and Industrialized Housing District Regulations) is amended by renumbering subparagraphs 3, 4, 5 and 6 of Paragraph G ("Area Regulations") as subparagraphs 4, 5, 6 and 7, respectively, and by adding a new subparagraph 3 to Paragraph G to read as follows: 113. Width of lot, feet.......... 60 feet adjacent to side street (measured at front building line)„ H. Section 35 (Accessory Structures and Uses), Paragraph G (Garage Requirements) is amended so that it shall hereafter read as follows: "G. Garage Requirements: 1. A detached garage, used to meet the minimum off street parking requirements shall be permitted_ as an accessory use in a residential district. The garage shall have a minimum interior dimension of „twenty- one(21)_feet by twenty-two (22) fet. The garage shall also be constructed so as to accommodate the enclosed parking of at least two (2) automobiles. 2. A detached garage, which is provided in. addition to the required two (2) car garage, shall be ermitted as an accessoLy use in a residential district. 3. An detached garage shall be set back at lest fort -five 45 feet from the front property line of a residential lot. 44.. An attached garage structure, which, is provided in addition to the required two (2) car garage, may face any street if the garage sits back at least forty-five (45) feet from the front property line of a residential, lot -3- DOC #: 427107 5. Anygarage structure, provided in addition to the repuired two (2) car arae shall have a minimum interior dimension of 10 112 x 22 feet for RE a minimum of thirty-five (35) feet from .the side street:yrpvided, however, that no drive cuts will be allowed from any ,street classified as a major or minor collector street. Section 3. Purpose. The amendment to the Comprehensive Zoning Ordinance herein made has been made in accordance with the Comprehensive Plan of the Town for the purpose of promoting the health, safety and welfare of the community, and with consideration of the reasonable suitability for the particular use and with a view of conserving the value of the buildings and encouraging the most appropriate use of land within the community. Section 4. Savings. This Ordinance shall be cumulative of all other ordinances of the City affecting the regulation of land and zoning and shall not repeal any of the provisions of those ordinances except in those instances where the provisions of those Ordinances are in direct conflict with the provisions of this Ordinance. Section 5. Severability. The sections, paragraphs, sentences, phrases, clauses and words of this Ordinance are severable, and if any section, paragraph, sentence, phrase, clause or word in this Ordinance or application thereof to any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance, and the Town Council hereby declares that it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 6. Effective date. This Ordinance shall become effective from and after its date of adoption as provided by law.
