AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS
ADOPTING THE 2000 EDITION OF THE INTERNATIONAL ENERGY
CONSERVATION CODE WITH LOCAL AMENDMENTS SET FORTH
HEREIN, REGULATING AND CONTROLLING THE DESIGN,
CONSTRUCTION, QUALITY OF MATERIALS, ERECTION,
INSTALLATION, ALTERATION, REPAIR, LOCATION, RELOCATION,
REPLACEMENT, ADDITION TO, USE OR MAINTENANCE OF THE
BUILDING ENVELOPE, MECHANICAL, LIGHTING AND POWER
SYSTEMS IN THE TOWN OF TROPHY CLUB; PROVIDING FOR THE
INCORPORATION OF PREMISES; PROVIDING FOR THE ADOPTION
OF CODE AND AMENDMENTS THERETO; PROVIDING FOR
ADMINISTRATION OF THE ORDINANCE; PROVIDING A
CUMULATIVE REPEALER; PROVIDING A SAVINGS CLAUSE;
PROVIDING SEVERABILITY; PROVIDING A PENALTY NOT TO
EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR
EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED
COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION
OCCURS OR CONTINUES; PROVIDING FOR PUBLICATION;
PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Town of Trophy Club, Texas is a Type A General Law municipality
located in Denton County, Texas, created in accordance with the provisions of the Texas Local
Government Code and operating pursuant to enabling legislation of the State of Texas; and
WHEREAS, the Town Council of the Town of Trophy Club, Texas is empowered under
The Texas Local Government Code, Section 51.001 to adopt an ordinance or rule that is for the
good government of the City; and
WHEREAS, the North Central Texas Council of Governments (NCTCOG) is
established to assist local governments in planning for common needs, cooperating for mutual
benefit, and coordinating for sound regional development; and
WHEREAS, the NCTCOG has been active for more than thirty years in promoting
construction code uniformity in the region; and
WHEREAS, the NCTCOG has adopted the Intenzational Energy Consenlation Code,
2000 Edition, with specific amendments; and
WHEREAS, the adoption in this region of an energy conservation code is identified in
the Texas Natural Resources Conservation Commission's State Implementation Plan as a
necessary control measure to improve this region's air quality; and

WHEREAS, the Town Council of the Town of Trophy Club hereby determines that it is
in the best interest of the Town to adopt the aforementioned International Energy Conservation
Cade, 2000 Edition, with local amendments thereto.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
SECTION L
INCORPORATION OF PREMISES
The above and foregoing premises are true and correct and are incorporated herein and
made a part hereof for all purposes.
SECTION 2.
ADOPTION OF CODE AND AMENDMENTS THERETO
That certain documents, three (3) copies of which are on file in the office of the Building
Official of the Town of Trophy Club, Texas, being marked and designated as the International
Energy Conservation Code, as published by the International Code Council, be and hereby is
adopted as the code of the Town of Trophy CIub, Texas for regulating the design, construction,
quality of materials, erection, installation, alteration, repair, location, relocation, replacement,
addition to, use or maintenance of the building envelope, mechanical, lighting and power systems
in the Town of Trophy Club, Texas, and providing for the issuance of permits and collection of
fees therefore; and each and all of the regulations, provisions, conditions and terms of such
International Energy Conservation Code, 2000 Edition, published by the International Code
Council, with local amendments, on file in the office of the Building Official of the Town of
Trophy Club, Texas, are hereby referred to, adopted and made a part hereof as if fully set out in
this ordinance. The following sections of the International Energy Conservation Code, 2000
Edition are hereby amended in the following particulars, and all other articles, chapters, sections,
paragraphs, sentences, phrases and words are not amended but are hereby ratified and affirmed:
A. Section 101.3; is amended as follows:
101.3 Compliance. Compliance with this code shall be determined in accordance
with Sections 101.3.1, 101.3.2 or 101.3.3.
B. Section 101.3.3; is added as follows:
101.3.3. Alternative Compliance. A building certified through a voluntary
energy performance testing program approved as meeting or exceeding the
provisions of this code may be deemed to comply with the requirements of this
code.
N. Section 302.1; Blank Table 302.1 Exterior Design Conditions, is replaced
with the following:

D. Note "a" is deleted and replaced with the following:
a. These values are from ASHRAE Handbook of Fundamentals for
Dallas/Ft. Worth International Airport 99.6% Winter DB, 0.4% Summer
DB, and 0.4% Summer WB; and from Local Climatological Data for
Dallas -Ft. Worth published by the National Climatic Data Center, National
Oceanic and Atmospheric Administration. These values are for the
purpose of providing a uniform basis of requirements for North Central
Texas. This will not preclude licensed professionals from submitting
design analyses based on site measurements or published data more
specific to the building site. Adjustments shall be permitted to reflect
local climates which differ from the tabulated values, or local weather
experience determined by the code official.
E. Figures 302.1 (1-43,45-51) are deleted.
F. Section 502.1.1; exception #2 is deleted and the following is substituted:

G. Section 502.1.5; the following exceptions are added:
Exceptions:
Any glazing facing within 45 degrees of true north;
Any glazing facing within 45 degrees of true south which is shaded along its full
width by a permanent overhang with a projection factor of 0.3 or greater.
Any fenestration with attached screens where the screens have a rated shading
coefficient of .6 or less.
H. Section 502.2; Blank Table 502.2, Heating & Cooling Criteria, is replaced

distribution system shall be thermally insulated in accordance with Table
503.3.3.3 ar where such ducts or plenums operate at static pressures greater than 2
in. w.g. (500 Pa) in accordance with Section 503.3.3.4.1.

Section 803.3.6. Pressure classifications specific to the ducts stem shall be
clearly indicated on the construction documents in accordance with the
International Mechanical Code.
503.3.3.4.2 Low pressure duct systems. All longitudinal and transverse joints,
seams and connections of law ,-.,..,ss„r., supply and return ducts operating at static
pressures less than or equal to 2 in. w.g. (500 Pa) shall be securely fastened and
sealed with welds gaskets, mastics (adhesives), mastic -plus -embedded fabric
systems or tapes installed in accordance with the manufacturer's installation
instructions. Pressure classifications specific to the duct system shall be clearly
indicated on the construction documents in accordance with the International
Mechanical Code.

SECTION 3.
ADMINISTRATION OF ORDINANCE
Inspections required by this Ordinance shall be the responsibility of the applicant seeking
the requested approval from the Town. It shall be the responsibility of the applicant to obtain the
services of a professional meeting all state law licensing and other requirements who is qualified
to perform the inspections and testing required hereunder. Upon completion of such testing, the
applicant shall submit written documentation from such qualified professional for review by the
Town prior to the issuance of any permit or approval by the Town. The Town shall have the
right and discretion to reject such documentation submitted by applicant if that documentation
fails to provide sufficient information necessary for the Town to make its determination of
compliance with the Ordinance, if the professional firm or individual who performed the
inspection or test was not properly licensed or qualified as required by applicable law, or if such
documentation fails in any way to comply with this Ordinance or other applicable law. The
Town, may at its discretion, provide a Iist of firms and/or individuals that are appropriately
licensed to perform the inspections required by this Ordinance; however, any such action by the
Town is not and should not be construed as an endorsement of those firms and/or individuals, but
is merely a listing of firms/individuals who have represented to the Town that they are Iicensed
and qualified to perform the inspections and testing required by this Ordinance. Any
appropriately credentialed professional firm/individual desiring to be placed upon such list must
first register with the Town in accordance with the policies and procedures set forth by the
Building Official or his or her designee and adopted administratively.
SECTION 4.
CUMULATIVE REPEALER
This Ordinance shall be cumulative of all other Ordinances and shall not repeal any of the
provisions of such Ordinances except for those instances where there are direct conflicts with the
provisions of this Ordinance. Ordinances, or parts thereof, in force at the time this Ordinance
shall take effect and that are inconsistent with this Ordinance are hereby repealed to the extent
that they are inconsistent with this Ordinance. Provided however, that any complaint, action,
claim or lawsuit which has been initiated or has arisen under or pursuant to such other
Ordinances on the date of adoption of this Ordinance shall continue to be governed by the

provisions of such Ordinance and for that purpose the Ordinance shall remain in full force and
effect.
SECTION 5.
SAVINGS
All rights and remedies of the Town of Trophy Club, Texas, are expressly saved as to any
and all violations of the provisions of any other Ordinance affecting inspection activities and
enforcement of building provisions which have secured at the time of the effective date of this
Ordinance, and, as to such accrued violations and all pending litigation, both civil and criminal,
whether pending in court or not, under such Ordinances same shall not be affected by this
Ordinance but may be prosecuted until final disposition by the courts.
SECTION 6.
SEVERABILITY
If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance or
application thereof to any person or circumstance is held invalid or unconstitutional by a Court of
competent jurisdiction, such holding shall not affect the validity of the remaining portions of this
Ordinance, and the Town Council hereby declares it would have passed such remaining portions
of this Ordinance despite such invalidity, which remaining portions shall remain in full force and
effect.
SECTION 7.
PENALTY
It shall be unlawful for any person to violate any provision of this Ordinance, and any
person violating or failing to comply with any provision hereof shall be fined, upon conviction,
in an amount not more than Two Thousand Dollars ($2,000.00), and a separate offense shall be
deemed committed each day during or on which a violation occurs or continues.
SECTION 8.
PUBLICATION
The Town Secretary of the Town of Trophy Club is hereby directed to publish the
Caption, Penalty and Effective Date of this Ordinance as required by Section 52.011 of the Texas
Local Government Code.
SECTION 9.
ENGROSSMENT AND ENROLLMENT
The Town Secretary of the Town of Trophy Club is hereby directed to engross and enroll
this Ordinance by copying the exact Caption, Penalty and Effective Date in the minutes of the
Town Council and by filing this Ordinance in the ordinance records of the Town.

This Ordinance shall become effective from and after its date of adoption and publication
as provided by law, and it is so ordained.
