ORDINANCE NO. 2003- 20
AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS REPEALING
ORDINANCE NO. 85-6 DESIGNATING THE FELLER CITIZEN AS THE
OFFICIAL NEWSPAPER OF THE TOWN; PROVIDING FOR THE
INCORPORATION OF PREMISES; PROVIDE FOR THE DESIGNATION OF THE
TROPHY CLUB TIMES AS THE NEW OFFICIAL NEWSPAPER; PROVIDING
SEVERABILITY; PROVIDING A CUMULATIVE REPEALER CLAUSE ;
PROVIDING FOR PUBLICATION; PROVIDING FOR ENGROSSMENT AND
ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on May 27, 1985, the Town enacted Ordinance No. 85-6 designating The Grapevine
Sun as the official newspaper of the Town, and on May 21, 1991, the Town amended Ordinance No. 85-
6 designating the Keller Citizen as the official newspaper of the Town; and
WHEREAS, the Town Council of the Town of Trophy Club, Texas (the "Town") desires to
change the official newspaper of the Town from the Keller Citizen to the Trophy Club Times publication
of the Alliance Regional Newspapers (hereinafter "Trophy Club Times"); and
WHEREAS, the Council finds that the Trophy Club Times satisfies all of the requirements of
State law to serve as the official newspaper of the Town and finds it in the best interests of the Town to
contract with the Trophy Club Times to serve as the Town's official newspaper in accordance with
Section 52.004 of the Texas Local Government Code.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
TROPHY CLUB, TEXAS, THAT:
SECTION 1.
INCORPORATION OF PREMISES
The above and foregoing premises are true and correct and are incorporated herein and
made a part hereof for all purposes.
SECTION 2.
DESIGNATION OF OFFICIAL NEWSPAPER
The Trophy Club Times is hereby designated as the official newspaper of the Town of Trophy
Club and shall serve as the Town's official newspaper in accordance with Texas Local Government Code
Section 52.004, as amended, other applicable laws, and a contract between the Town and the Trophy CIub
Times.
SECTION 3
SEVERABILITY
If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance, or
application thereto, any person or circumstance is held invalid or unconstitutional by a Court of
competent jurisdiction, or otherwise, such holding shall not affect the validity of the remaining portions of
this ordinance; and the Town Council hereby declares it would have passed such remaining portions of
the ordinances despite such invalidity, which remaining portions shall remain in full force and effect.
SECTION 4
CUMULATIVE REPEALER CLAUSE
This Ordinance repeals Ordinance No. 85-6 and replaces it with this Ordinance designating the
Trophy Club Times as the official newspaper of the Town of Trophy Club. Notwithstanding the
foregoing, if there are any publications that are part of a series of publications required by law or prior
practice of the Town, the Town shall complete its publication of those items in the Keller Citizen pursuant
to Ordinance No. 85-06. This Ordinance shall be cumulative of all other Ordinances and shall not repeal
any of the provisions of such Ordinances except those instances where there are direct conflicts with the
provisions of this Ordinance. Ordinances or parts thereof in force at the time this Ordinance shall take
effect and that are inconsistent with this Ordinance are hereby repealed to the extent that they are
inconsistent with this Ordinance.
SECTION 5
PUBLICATION
The Town Secretary of the Town of Trophy Club is hereby directed to publish the Caption,
Penalty and Effective Date of this Ordinance as required by Section 52.011 of the Texas Local
Government Code.
SECTION 6
ENGROSSMENT AND ENROLLMENT
The Town Secretary of the Town of Trophy Club is hereby directed to engross and enroll this
Ordinance by copying the exact Caption, Penalty and Effective Date in the minutes of the Town Council
and by filing this Ordinance in the ordinance records of the Town
SECTION 7
EFFECTIVE DATE
This Ordinance shall become effective December 1, 2003 as provided by law.
