AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS
AUTHORIZING THE TOWN ATTORNEY TO REPRESENT THE TOWN IN
LITIGATION AND OTHER LEGAL MATTERS AFFECTING THE TOWN
AND RATIFYING ALL PREVIOUS ACTION TAKEN BY THE TOWN
ATTORNEY IN REPRESENTING THE TOWN; PROVIDING FOR THE
INCORPORATION OF PREMISES; PROVIDING AUTHORITY;
PROVIDING A CUMULATIVE CLAUSE; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Town Attorney for the Town of Trophy Club, Texas is the chief legal officer of
the Town; and
WHEREAS, in her capacity as the chief legal officer of the Town, she represents the Town in
legal matters affecting the Town, including but not limited to litigation matters; and
WHEREAS, the Town Council hereby authorizes (1) the Town Attorney to represent the Town,
including but not limited to its officers and employees, in litigation matters and other legal matters
affecting the Town; (2) ratifies all actions taken by the Town Attorney both in the litigation process and in
other legal representation of the Town; and (3) authorizes the Town Attorney to retain the services of
outside counsel as necessary and appropriate to represent the Town;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN
OF TROPHY CLUB, TEXAS:
SECTION 1.
INCORPORATION
All of the above premises are true and correct and are hereby incorporated in the body of this
Ordinance as if fully set forth herein.
SECTION 2.
AUTHORITY
The Town Attorney, in her capacity as the chief legal officer of the Town, represents the Town in
legal matters affecting the Town, including but not limited to litigation matters. The Town Attorney is
hereby authorized to represent the Town, including but not limited to its officers and employees, in
litigation matters and to retain the services of outside counsel as necessary and appropriate to represent
the Town. All other previous actions of the Town Attorney in representing the Town of Trophy Club are
hereby ratified, including but not limited to representation in litigation and other legal matters.
SECTION 3.
CUMULATIVE CLAUSE
This Ordinance shall be cumulative of all provisions of ordinances of the Town of Trophy CIub,
Texas, except where the provisions of this Ordinance are in direct conflict with the provisions of such
ordinances, in which event the conflicting provisions of such ordinances are hereby repealed.
SECTION 4.
SEVERABILITY CLAUSE
It is hereby declared to be the intent of the Town Council of the Town of Trophy Club, Texas,
that the phrases, clauses, sentences, paragraphs, and sections of this Ordinance are severable, and if any
phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the
valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs, or sections of this Ordinance, since the same
would have been enacted by the Town Council without incorporation of any such unconstitutional phrase,
clause, sentence, paragraph, or section.
SECTION 5.
ENGROSSMENT AND ENROLLMENT
The Town Secretary of the Town of Trophy Club is hereby directed to engross and enroll this
Ordinance by copying the exact Caption and Effective Date Clause in the minutes of the Town Council
and by filing this Ordinance in the ordinance records of the Town.
SECTION 5.
EFFECTIVE DATE
This Ordinance shall become effective from and after its date of passage and publication in
accordance with law.
